Carlos Ghosn, a year after arrest, still seeks trial date and access to evidence

TOKYO — A year after his arrest, Nissan ex-Chairman Carlos Ghosn remains stuck in Tokyo under stringent bail conditions and without a trial date as he seeks access to a trove of Nissan emails and other evidence to fight charges of financial misconduct. His lawyers have asked a court to grant access to 6,000 pieces of evidence collected from Nissan such as electronic communications, which they say is crucial for a fair trial, showed an Oct. 4 court filing seen by Reuters. The once-feted executive has spent 129 days in detention since his arrest shortly after his private jet touched down at a Tokyo airport on Nov. 19, 2018. He faces four charges — which he denies — including hiding income and enriching himself through payments to dealerships in the Middle East. Nissan sacked Ghosn, saying its internal investigations revealed misconduct ranging from understating his salary while he was its chief executive, and transferring $5 million of Nissan funds to an account in which he had an interest. An earlier court ruling allowed prosecutors to hand back evidence to Nissan during pretrial wrangling over witnesses and evidence similar to the U. S. discovery process. If prosecutors are "given the freedom to unilaterally delete the collected evidence and return it to relevant parties, this is equivalent to granting the investigative agencies the right to destroy evidence," showed the filing to the Tokyo District Court. The lawyers also asked the court to rescind the earlier ruling, saying some evidence could be erased by Nissan to protect confidential business information. They argued the "ruling deprives Mr. Ghosn of his right to receive a fair public trial by an impartial court," as it enabled prosecutors to view and use the evidence and withhold it from the defense. Prosecutors are not required to hand over all evidence they or the police gather during investigations unless ordered by the court, unlike in the U.S. discovery process where prosecutors and defense lawyers disclose the evidence they intend to present in court. A spokeswoman for the Tokyo prosecutors' office said the office could not comment on individual cases. A Nissan spokeswoman declined to comment. Ghosn's lawyers have also asked the court to dismiss all charges against him, accusing prosecutors of colluding with government officials and Nissan executives to oust him to block any takeover of the automaker by French alliance partner Renault SA, of which Ghosn was also chairman.

Nissan's purchase of Mitsubishi is officially official

After the company's announcement in May, the Nissan's purchase of a 34 percent stake in Mitsubishi is now official. The deal cost Nissan $2.3 billion, according to the Wall Street Journal, and brings Mitsubishi into the Nissan-Renault Alliance. The company explained that this new partnership will manifest itself in shared vehicle platforms and technology, joint purchasing, and shared manufacturing. Nissan also said that this purchase will make the company one of the three largest companies by volume in the world. Nissan also emphasized that Mitsubishi will very much be a partner in the current alliance with Renault. In addition, Carlos Ghosn, CEO of both Nissan and Renault, has been nominated to be the new chairman of the Mitsubishi board. With Ghosn at the head of the board, current Mitsubishi president and CEO, Osamu Masuko, will remain in his positions but Nissan's current chief competitive officer will join Masuko as co-chief executive officer at Mitsubishi. With these companies now working together, we'll probably start seeing more commonality between Nissan and Mitsubishi products here in the States. It would also be a great opportunity to get some of Mitsubishi's cooler products here. Perhaps Mitsubishi and Nissan will take our hint about the Delica. The Tesla Model S was the best-selling EV of 2015

According to numbers crunched over at Hybrid Cars, the Tesla Model S was the best selling pure electric vehicle last year with 50,366 deliveries. These numbers might not tell the whole story, since Tesla reports deliveries made in 2015 that might have been sold in a different calendar year, while other makers are tallying sales. However, it's inarguable that the Model S ended up in more worldwide driveways than the second-place Nissan Leaf, which did about 43,000 sales. In the US alone, Leaf sales were down 42.8 percent year-on-year, from 30,200 in 2014 to 17,269 last year, and that decline also increased throughout the year. That marks a great finish to a great start to 2015, when Tesla took the lead in EV sales in the US for the first quarter. On top of that, as of last year the Model S becomes the second-best selling EV ever, with 107,148 deliveries since the middle of 2012. It trails the Nissan Leaf, with well over 200,000 worldwide sales. The Chevrolet Volt/Opel Ampera combo takes a close third, with about 106,000 sales. The Nissan and Chevy rivals both launched at the end of 2010, a 16-month head start on the Tesla. Down the charts, the Mitsubishi Outlander PHEV which continues to be forbidden fruit for our market notched 39,000 sales. The BYD Qin PHEV sold 31,898 examples in China, and BYD would take the overall victory from Tesla with 58,728 deliveries if you counted all of its EV and PHEV production, such as its electric buses. The BMW i3 nabbed fourth place with 24,057 global sales. In 2011 the Munich automaker said it wanted to sell 30,000 i3s annually by 2014, but by the time the car launched the company considered 15,000 annual sales 'great for now,' so the 2015 number seems a fine place to wind up.
