2011-2012 Nissan Leaf class-action lawsuit finally settled

In 2012, a group of Nissan Leaf owners sued the automaker in a class-action lawsuit over the "wilting Leaf" issue. That describes the steadily decreasing battery capacity of the electric vehicle's battery pack, which didn't line up with drivers' expectations. At the time, Nissan said the lawsuit was without merit but the legal wranglings continued. A new, $24-million settlement will give Leaf owners a new (not repaired) battery if their current pack drops down to fewer than nine bars of energy capacity. There are also options for 90 days of free charging at some of the No Charge To Charge locations or, if they don't live near any of those, a $50 check. One of the main complaints of the lawsuit was that the initial ads for the EV were less-than-clear, telling people the car could go 100 miles when fully charged but, and here's the problem, the automaker recommended that Leaf owners not charge their cars up all the way in hot climates. The class action suit was filed on behalf of Leaf owners in California and Arizona. It reads, in part: Before purchase or lease, Nissan failed to disclose its own recommendations that owners avoid charging the battery beyond 80% in order to mitigate battery damage and failed to disclose that Nissan's estimated 100 mile range was based on a full charge battery, which is contrary to Nissan's own recommendation for battery charging. Following early reports of the wilting problem in warm climates and the initial filing of the lawsuit, Nissan upgraded its battery warranty. It also improved the EV's battery chemistry. The class action suit says that it's this new chemistry that needs to go into any "wilting Leafs" that are affected by the suit. There's more information at the class-action site. NHTSA investigating 200,000 Sentra, Versa models over brakes

The National Highway Traffic Safety Administration has opened a second investigation into Nissan in May. The first covered inaccurate fuel gauges in the 2007 Quest minivan. The latest affects the Sentra and Versa from the 2013 and 2014 model years and the 2014 Versa Note, because of complaints of long brake pedal travel. If NHTSA finds a problem, it could affect an estimated 200,000 vehicles.
At the moment, this is still only a preliminary evaluation "to asses the scope, frequency and safety-related consequences of the alleged defect," according to the report, but it could lead to the full recall. NHTSA is still trying to find whether or not there are accidents, injuries or fatalities related to the problem. At this time, much of the data in the document is still marked Confidential or TBD. Nissan told Reuters in a statement that the company is working with the agency on the investigation and supplying the regulator with further information.
According to NHTSA, its Office of Defects Investigation has received eight complaints about long pedal travel in these models. They allege that the brake pedal goes all the way to the floor when pressed in some cases and doesn't sufficiently slow the vehicle. FCA compromises with France, moving Renault merger bid forward

FRANKFURT/PARIS – Renault directors were preparing to review Fiat Chrysler's $35 billion merger offer on Tuesday, after the Italian-American carmaker resolved differences with the French government overnight, three sources said. The compromise on French government influence over a combined FCA-Renault may clear the way for Renault's board to approve a framework agreement beginning the long process of a full merger, unless new issues surface at the meeting. France, Renault's biggest shareholder with a 15% stake, had been pressing for its own guaranteed seat on the new board and an effective veto on CEO appointments. But after late-night talks with FCA Chairman John Elkann, the French government has accepted a compromise that would see it occupy one of four board seats allocated to Renault, balanced by four FCA appointees, the sources said. Renault would also cede one of its two seats on a four-member CEO nominations committee to the French state, they said. Renault, FCA and the French government all declined to comment on the discussions. The same evening that the compromise was was negotiated, activist hedge fund CIAM wrote to the board of Renault to say it "strongly opposed" a planned $35 billion merger with Fiat Chrysler. Calling the deal "opportunistic," the fund said the current deal terms strongly favored Fiat Chrysler and offered no control premium.
