Carlos Ghosn: What misconduct is he accused of?

TOKYO — Japan was shocked by news that Nissan Motor Co. Chairman Carlos Ghosn, who was widely respected for rescuing the carmaker from near bankruptcy, was arrested on Monday for alleged financial misconduct. Nissan said that Ghosn, who is also chairman and CEO of Renault and chairman of Mitsubishi Motors, would be fired from his post as Nissan chairman on Thursday. What is Carlos Ghosn accused of? Nissan CEO Hiroto Saikawa told a packed press conference on Monday night that the company had found that Ghosn had been using corporate money for personal purposes and under-reporting his income for years in official company filings to the Tokyo Stock Exchange. Another board member, Greg Kelly, was also deeply involved in the misconduct, Nissan said. Saikawa said he couldn't elaborate as the cases are being investigated by prosecutors, who have declined to comment. Prosecutors said that Ghosn and Kelly conspired to understate Ghosn's compensation over five years starting in fiscal 2010 as being about half of the actual 9.998 billion yen ($88.9 million). Public broadcaster NHK said Nissan paid billions of yen to buy and renovate homes for Ghosn in Rio, Beirut, Paris and Amsterdam, citing unnamed sources. The properties had no business purpose and were not listed as benefits in TSE filings, NHK said. Ghosn, 64, has not been formally charged. The Asahi newspaper reported that he and Kelly had submitted to prosecutors' questions after getting off a plane on Monday afternoon at Tokyo's Haneda Airport. Saikawa confirmed they had been arrested. Ghosn and Kelly have not been seen since, and their exact whereabouts are not known. Suspects are typically taken to the Tokyo Detention Center, which is linked to the Tokyo District Public Prosecutors Office. How did this come to light? Nissan's Saikawa said Ghosn's alleged improprieties came to light through a whistleblower, after which the company began an internal investigation and informed prosecutors. Japanese media reports say the informant is a member of Nissan's legal department. The Asahi reported, without citing sources, that the informant gave the prosecutors information in a plea bargain, implying the person may have provided evidence in exchange for a lighter sentence. How much control did Carlos Ghosn have? After becoming CEO of struggling Nissan in 2001, Ghosn was hailed as the automaker's savior by implementing an aggressive cost-cutting plan.

Renault, Nissan limit French government interference

Renault and Nissan are taking action to limit the influence that one can exercise over the other's operations. The measures, announced by both automakers after meetings of their respective boards in Paris and Tokyo, aim to keep each other at arm's length. But more than that, they seek to cap the degree of influence which the French government can bring to bear on either automaker. The steps are being taken in response to investment moves by the French state. While the government's investment arm – known as the Agence des Participations de l'Etat (or state participation agency) – previously controlled 15 percent of Renault's shares, it increased its holdings this April to 19.73 percent. The action sparked concerns at Renault that the French government would attempt to dictate operating procedures to both automakers, potentially to favor production in France over other locations. Given that Renault holds a 43-percent stake in Nissan, the Japanese automaker grew concerned over potential French state interference as well. To assuage those concerns, Renault, Nissan, and the French government came to an agreement with three vital clauses. Most importantly, despite its nearly 20-percent holdings, the French government will be granted only 17.9 percent of voting rights in Renault (to be extended up to 20 percent under certain exceptional circumstances). Renault (and by extension the French government) will also be prevented from interfering in Nissan's governance. With those measures in place, Nissan will not seek more voting rights based on the 15-percent stake which it, in turn, holds in Renault. Having successfully concluded the deal and hedged against the threat of government interference, the Renault board reasserted its confidence in Carlos Ghosn. Through the unique terms of their alliance, Ghosn serves as chairman and CEO of both Renault and Nissan. The two cooperate closely and share resources extending far beyond their chief executive, but remain distinct companies rather than merge, as Fiat and Chrysler have. The 2020 Chevy Corvette Stingray in its base form offers an astonishing amount of performance for the money. In fact, so impressive is the car's spec sheet that the Corvette kind of exists in two different competitive sets: one of cars priced similarly, and another with cars of similar performance and reputation. To get a feel for how it handles each of these segments, we've compiled specifications for those two sets of players. And as far as pricing goes, its closest competitor is the Porsche 718 Cayman, which also starts at just under $60,000. Both are mid-engined and rear-drive, but the Corvette offers an extra 195 horsepower and 190 pound-feet of torque. The Cayman does boast a curb weight of right around 3,000 pounds, so it weighs a few hundred pounds less than the Corvette, but it's likely not enough to make up for the power deficit. The Corvette's sub-3.0-second 0-60 time bears this out against the Cayman's best 4.5-second run. Impressively, though, the Cayman has more cargo space than the Corvette in a package that's nearly 10 inches shorter. The Cayman also still offers a manual option for those that prefer self-shifting. The 2020 Toyota Supra is on the cheap end of this sports car class, just crossing $50,000. It also boasts more power than the Cayman, though it's still down by 160 ponies and 105 pound-feet of torque to the C8. It's also about as roomy as the Corvette, despite being about the same size as the Cayman. Cargo space is a bit tighter. Its driving characteristics will likely differ, too as the Supra sits on a front-engine platform. It might even feel closer to a C7 Corvette in some ways. The other mid-engine entry in this price range is the 2019 Alfa Romeo 4C Spider. Its small 1.7-liter turbo inline-4 only makes 237 horsepower and 258 pound-feet of torque, but it's also far and away the lightest of this group at 2,487 pounds. That's roughly 1,000 pounds lighter than the Corvette. It isn't as fast as the Corvette in a straight line, but that lightness surely pays dividends in cornering and braking.
