Carlos Ghosn changes to hotshot attorney and a new defense strategy

TOKYO — Carlos Ghosn's chief defense attorney Motonari Otsuru resigned and was replaced by a team that includes hotshot lawyer Junichiro Hironaka, in a change of strategy from the ousted Nissan Motor chairman three months after his arrest. Ghosn, Nissan's one-time savior, has been held in detention since his Nov. 19 arrest. He's been indicted and accused of under-reporting his salary and breach of trust. He has denied the charges. The once-feted auto executive hired Hiroshi Kawatsu as head of a new defense team, his office said on Wednesday. Hironaka, 73, has won several high profile cases, helping acquit senior lawmaker Ichiro Ozawa and senior bureaucrat Atsuko Muraki. Hiring Hironaka would mean a more aggressive legal strategy, said Nobuo Gohara, a former prosecutor. Otsuru previously led the special prosecutors' office that is now handling Ghosn's case. "Otsuru was miscast. He worked at the heart of the special prosecutors office so he was not someone who was going to go after them aggressively," Gohara said. "Hironaka is an experienced defense lawyer who has won a number of cases. He will mount a more thorough and aggressive defense." Otsuru's office confirmed his resignation in a statement, but gave no reason for the move. A second member of Ghosn's defense team, Masato Oshikubo, had quit, it said. Go Kondo, Ghosn's third defense lawyer, was unavailable for comment. Ghosn released a short statement thanking Otsuru for his team's "tireless and diligent work," and called him a "very capable and intelligent man and lawyer." The sudden change in attorneys comes ahead of the expected start of informal meetings with prosecutors and judges to discuss pretrial preparations, an indication that there will be no new charges against Ghosn. "As we begin the trial phase, I have decided to engage Hironaka-sensei as my legal counsel," Ghosn said, using an honorific suffix. "I look forward to defending myself vigorously, and this represents the beginning of the process of not only establishing my innocence but also shedding light on the circumstances that led to my unjust detention." Ghosn, 64, told the Nikkei newspaper last month that Nissan executives opposed to his plans for closer ties with automaking partner Renault SA had plotted to remove him. Ghosn was widely credited with rescuing Nissan from near-bankruptcy after he was brought over to Japan in 1999 by Renault after the French automaker bought a chunk of Nissan.

EZ-Charge program will get rolled out for all vehicles [UPDATE]

UPDATE: It appears that Chargepoint has pulled out of the program. It looks like a myriad of vehicles will be eligible for the single-card recharging program under NRG Energy's NRG eVgo division. The EZ-Charge platform that Nissan said last month would allow Leaf owners to use multiple vehicle recharging networks with a single card will soon be offered to other plug-in vehicles. eVgo will start sending out EZ-Charge cards this summer to various markets in Northern and Southern California and Texas as well as the Pacific Northwest, Phoenix, Nashville and Washington, DC. EZ-Charge uses a single card that is good for eVgo stations as well as stations within the ChargePoint, Blink and AeroVironment networks. It will debut in 10 EZ-Charge markets on July 1. By mid-2015, 15 more markets will be added. Nissan announced the 'No Charge to Charge' program last month at the New York Auto Show. Nissan said at the time that Leaf buyers would get two years of free charging, but individual charging sessions were limited to 30 minutes at CHAdeMO stations and an hour at the more-common Level 2 stations. The automaker also estimated that the 25 markets included by next year account for more than 80 percent of US Leaf sales. Take a look at NRG's press release below. Lebanon may lift Ghosn's travel ban if files not received within 40 days

BEIRUT — Lebanon may lift a travel ban on ousted Nissan boss Carlos Ghosn if files pertaining to his case do not arrive from Japan within 40 days, caretaker justice minister Albert Serhan said in a statement on Friday. Ghosn fled Japan to Lebanon, his childhood home, last month as he awaited trial on charges of under-reporting earnings, breach of trust and misappropriation of company funds, all of which he denies. His dramatic escape has raised tensions between Japan and Lebanon, where Ghosn slammed the Japanese justice system at a two-hour news conference on Wednesday, prompting Japan's Justice Minister to launch a rare and forceful public response. Lebanon has no extradition agreement with Japan. Serhan said in the statement that he had met with the Japanese ambassador to Lebanon and reaffirmed the importance of the relationship between the two countries. He also said that Ghosn's wife Carole will also be questioned by Lebanese prosecutors when authorities receive an Interpol notice for her. "Carole will be subject to the same procedures that were followed for (Carlos) when the red notice was received from Interpol." Tokyo prosecutors on Tuesday issued an arrest warrant for Carole for alleged perjury related to the misappropriation charge against her husband. A spokeswoman for Carole said that she had voluntarily returned to Japan nine months ago to answer prosecutors' questions and was free to go without any charges, adding that the warrant was "pathetic". A fair trial? Carlos GhosnÂ’s lawyer on Friday told JapanÂ’s government that the authorities had failed to arrange for a fair trial that respected universal rights. Francois Zimeray, French lawyer for Ghosn, said that it had been for JapanÂ’s prosecutors to prove GhosnÂ’s guilt, not for Ghosn to prove his innocence. “It belongs to the prosecution to prove guilt and not to the accused person to prove its innocence,” Zimeray said in a statement. Japanese Justice Minister Masako Mori launched a rare and forceful public takedown of auto executive-turned-fugitive Ghosn after he blasted the countryÂ’s legal system as allowing him “zero chance” of a fair trial as he sought to justify his escape to Beirut.
