Dutch court orders Ghosn to repay Nissan-Mitsubishi $6 million in wages

AMSTERDAM — A court in Amsterdam on Thursday ordered fugitive former car executive Carlos Ghosn to repay Nissan and Mitsubishi almost 5 million euros ($6.1 million) in wages he received from their Dutch registered joint venture Nissan-Mitsubishi BV in 2018. Nissan and Mitsubishi, which ousted Ghosn as chairman of their companies and of their joint venture after his arrest for financial misconduct in 2018, claimed Ghosn had wrongly granted the wages to himself. Ghosn had brought the case himself, demanding 15 million euros in compensation for missed wages and severance payments as he claimed Nissan and Mitsubishi had violated Dutch labor laws when they dismissed him from the Amsterdam-based joint venture in 2019. But the district court in Amsterdam sided with the car companies, stating that Ghosn did not have a valid employment agreement with the joint venture, as it lacked the required consent of the boards of Nissan and Mitsubishi. The amount Ghosn needs to repay equals the net payments he received from the joint venture between April and November 2018, the court said. Ghosn, who has denied wrongdoing, was chairman of both Nissan and Mitsubishi and chief executive of Renault when he was arrested in Japan in 2018 on charges of underreporting his salary and using company funds for personal purposes. He fled to Lebanon in December 2019 hidden in carry-on luggage on a private jet that flew out of Kansai Airport, and has remained in that country since. Arrest warrant for Ghosn's wife a 'pathetic' move by Japan, spokeswoman says

BEIRUT — A decision by Japanese prosecutors to issue an arrest warrant for Carlos Ghosn's wife shortly before the fugitive car boss was due to speak publicly about his case was "pathetic," a spokeswoman for Ghosn told Reuters on Tuesday. The ousted Nissan Motor and Renault chairman fled to Lebanon, his childhood home, in late December from Japan, where he faced trial for alleged financial misconduct. Ghosn is expected to speak on Wednesday at a news conference in Beirut and detail some of the claims he has made against Nissan since his arrest in November 2018. He has alleged there was a Japanese government-backed coup to oust him. It's his first such appearance since his arrest in November 2018. "Last time Carlos Ghosn announced a press conference and got re-arrested. This time, the day before he is announced to speak out freely for the first time, they issued an arrest warrant for his wife Carole Ghosn," the spokeswoman said. Japanese prosecutors issued the warrant for Ghosn's wife Carole for perjury, Japanese media reported. The spokeswoman said Carole Ghosn voluntarily went back to Japan nine months ago to answer prosecutors' questions and was free to go without any charges. "The issuance of this warrant is pathetic," she said. Japan is looking for a way to extradite Ghosn, but Lebanon and Japan have no extradition agreement and Lebanon does not normally extradite its own citizens. The perjury arrest warrant accuses Carole Ghosn of falsely claiming not to know, or to have met, people connected to a company that received payments from Nissan Motor, part of which it subsequently transferred to a firm owned by Ghosn. Separately, a senior Ministry of Justice official said staff were poring over Lebanese laws to find a way to return Ghosn and that Japan "will do whatever it can" to have him face trial.   Naming names at Nissan Ghosn is expected to detail some of the claims he has made against Nissan since his arrest. Citing an interview with Ghosn, Fox Business reported that he said he has "actual evidence" and documents to show there was a Japanese government-backed coup to "take him out." He plans to identify those he believes responsible, the broadcaster said.

Carlos Ghosn's son predicts surprises at ex-Nissan chief's day in court

PARIS — The son of former Nissan chairman Carlos Ghosn said in an interview published Sunday that people will be surprised when his father, detained since Nov. 19 for allegedly falsifying financial reports, recounts his version of events to a Tokyo court on Tuesday. Anthony Ghosn, 24, told France's Journal du Dimanche that his father — who will remain detained until at least Jan. 11 — will get 10 minutes to talk at the hearing, being held at his own request. "For the first time, he can talk about his version of the allegations against him," Anthony Ghosn said in the interview with the weekly paper Journal du Dimanche. "I think everyone will be rather surprised hearing his version of the story. Until now, we've only heard the accusers." The son has no direct contact with his father, and gets information via lawyers. He said his father, who for decades was a revered figure in the global auto industry, has lost about 10 kilograms (22 pounds) eating three bowls of rice daily, but he reads books and "he resists." Ghosn refuses to cave in, said his son, contending that he would be freed from detention if he admitted guilt to the prosecutor. "But for seven weeks, his decision has been quite clear ... He won't give in," Anthony Ghosn said, adding that he would be wearing prison clothes and handcuffs in court. Countering media portrayals, he insisted his father, a Brazilian-born Frenchman of Lebanese ancestry, is "not obsessed by money." "He always told us that money is but a means to help those you love, but not an end unto itself." Ghosn is charged with underreporting his pay by about 5 billion yen ($44 million) in 2011-2015, and faces a breach of trust allegation. He led Nissan Motor Co. for two decades and helped save the Japanese automaker from near bankruptcy. He remains head of France's Renault car company, which owns 43 percent of Nissan. Another Nissan executive, Greg Kelly, was arrested on suspicion of collaborating with Ghosn on the underreporting of income and was freed Dec. 25 on 70 million yen ($635,600) bail after more than a month in detention.Related Video:
