Carlos Ghosn, a year after arrest, still seeks trial date and access to evidence

TOKYO — A year after his arrest, Nissan ex-Chairman Carlos Ghosn remains stuck in Tokyo under stringent bail conditions and without a trial date as he seeks access to a trove of Nissan emails and other evidence to fight charges of financial misconduct. His lawyers have asked a court to grant access to 6,000 pieces of evidence collected from Nissan such as electronic communications, which they say is crucial for a fair trial, showed an Oct. 4 court filing seen by Reuters. The once-feted executive has spent 129 days in detention since his arrest shortly after his private jet touched down at a Tokyo airport on Nov. 19, 2018. He faces four charges — which he denies — including hiding income and enriching himself through payments to dealerships in the Middle East. Nissan sacked Ghosn, saying its internal investigations revealed misconduct ranging from understating his salary while he was its chief executive, and transferring $5 million of Nissan funds to an account in which he had an interest. An earlier court ruling allowed prosecutors to hand back evidence to Nissan during pretrial wrangling over witnesses and evidence similar to the U. S. discovery process. If prosecutors are "given the freedom to unilaterally delete the collected evidence and return it to relevant parties, this is equivalent to granting the investigative agencies the right to destroy evidence," showed the filing to the Tokyo District Court. The lawyers also asked the court to rescind the earlier ruling, saying some evidence could be erased by Nissan to protect confidential business information. They argued the "ruling deprives Mr. Ghosn of his right to receive a fair public trial by an impartial court," as it enabled prosecutors to view and use the evidence and withhold it from the defense. Prosecutors are not required to hand over all evidence they or the police gather during investigations unless ordered by the court, unlike in the U.S. discovery process where prosecutors and defense lawyers disclose the evidence they intend to present in court. A spokeswoman for the Tokyo prosecutors' office said the office could not comment on individual cases. A Nissan spokeswoman declined to comment. Ghosn's lawyers have also asked the court to dismiss all charges against him, accusing prosecutors of colluding with government officials and Nissan executives to oust him to block any takeover of the automaker by French alliance partner Renault SA, of which Ghosn was also chairman.

Chevy Volt sales drop in June, Nissan Leaf inches upwards

Different month, same story. That's the gist of the monthly US sales numbers from the Chevy Volt and the Nissan Leaf. These were the first two mass-market plug-in vehicles to go on sale in the US and we've been comparing their sales numbers for what seems like ages now. So far, the 2014 tale of the tape shows the all-electric once again trumping the plug-in hybrid. The last time the Volt outsold the Leaf was in October 2013. Chevrolet sold 1,777 Volts in June. That was good enough to be the Volt's best sales month of the year, but it's down 34 percent from the 2,698 units sold in June 2013. In fact, it's on par with the 1,760 Volts sold in June 2012. Given the steady sales, General Motors might need to push up the release of the next-gen Volt to gin up excitement, especially if it also offers some of the things that current Volt drivers say they want improved: more range, a lower price and a fifth seat. GM also said it sold 85 Spark EVs in June, an increase of 215 percent over June 2013 Nissan sold 2,347 Leafs last month. The good news continues for Nissan, which says it sold 2,347 Leafs last month. That's an increase of 5.5 percent over 2013 numbers and makes 2014 the best June ever for Leaf sales. Let's credit Texas. Toby Perry, Nissan's director of EV sales and marketing, said in a statement that, "Since the Texas state incentive went into effect in May, we've seen a big jump in Leaf sales in the Austin, Dallas and Houston markets. Our dealers are telling us that they saw more traffic in their stores, and they had their best Leaf sales performance in the last weekend in June." Even with that increase, Atlanta remains the top Leaf market. Nissan has sold 12,736 Leafs in the US so far this year; Chevy 8,615 Volts. Nissan's Taxi of Tomorrow shut down by NYC courts [UPDATE]

Justice Schlomo Hagler may have just put a big dent in Nissan's plans to rule New York City's taxi fleets and outgoing Mayor Mike Bloomberg's vision of a unified fleet of yellow cabs.
As an October 28 deadline approached that would see all current, non-hybrid taxis replaced over by the Nissan NV200 over a three-to-five-year span, the legal battle that's enveloped the Taxi of Tomorrow program from the start has intensified. In a lawsuit, the Greater New York Taxi Association claims New York's Taxi and Limousine Commission overstepped its powers in mandating that taxi fleets are refitted with the NV200, according to the New York Daily News. This isn't the first time the courts have sided with the cabbies in the ToT debate.
Justice Hagler agreed with the cabbies, striking down the Taxi of Tomorrow purchasing requirements, and saying, "Simply stated, the power to contract and compel medallion owners to purchase the Nissan NV200 from Nissan for ten years does not exist in the City Charter," according to The Wall Street Journal.
