Ghosn flight prompts renewed focus on Japan's strict justice system

TOKYO — Carlos Ghosn's daring flight from Japan, where he was awaiting trial on charges of financial wrongdoing, has revived global criticism of the nation's "hostage justice," but in Japan is prompting talk of reversing more lenient curbs on defendants. The ousted boss of Japan's Nissan and France's Renault fled to Lebanon, saying on Tuesday that he had "escaped injustice" and would "no longer be held hostage by a rigged Japanese justice system." Ghosn was first arrested in November 2018 when his private jet landed in Tokyo and kept in jail for more than 100 days as prosecutors added more charges, all of which he has denied. He was released on $9 million bail in March — only to be arrested and bailed again the following month. He was facing four charges, including underreporting his Nissan salary and transferring personal financial losses to his employer's books while he ran Japan's No. 2 automaker. His apparent escape from Japan's legal system — Tokyo and Lebanon don't have an extradition treaty — will likely halt or even reverse a trend of recent years toward granting bail in more cases, said Colin Jones, a law professor at Doshisha Law School in Kyoto. “I would expect it to be more difficult for foreign defendants to get bail,” Jones said. In Japan, suspects who deny the charges against them are often detained for long periods and subject to intense questioning without a lawyer present, a system critics call "hostage justice." Japanese civil rights groups and the main bar lawyers association have long criticized a system that convicts 99.9% of criminal defendants. They say it gives too much power to prosecutors, who can detain suspects for long periods before indictment, and relies too much on confessions, some later found to have been forced and false. Ghosn's escape is clearly a shock to Japan's legal establishment. "This case raises the extremely serious issue of whether it's all right to continue the trend toward bail leniency," said former prosecutor Yasuyuki Takai. "The legal profession and lawmakers need to quickly consider new legal measures or a system to prevent such escapes," Takai, who was formerly with the special investigation unit of the prosecutor's office, told public broadcaster NHK.

Nissan and BMW want the UK to stay in the EU

Nissan and BMW are saying that the Brexit shouldn't become reality. It's a mixture of hope and threat because their planned investments in the UK risk to be damaged by the referendum's result. While those brands are still saying that every decision from the UK's people will be respected, you can sense a fear that every plan is going to be messed up. The problem is simple according to Nissan CEO Carlos Ghosn: "For us, a position of stability is more positive than a collection of unknowns. It makes the most sense for jobs, trade and costs." For sure Nissan is not going to shut its plant in northeast England if the country exits the Union, but this could change plans for the future, as the so-called Brexit could cause an increase on costs and above all on competition. Nissan employs 8,000 people in the UK across its manufacturing, engineering, and design facilities, and a further 32,000 indirectly through dealerships and its supply chain. All these people produce almost half a million cars and 80 percent of those are exported, so just imagine how taxes could affect prices and sales. If the EU's borders get smaller, Nissan will face some problems with customs duties the foreign products struggle with, as other Japanese automakers have so far, while importing their cars into the Union. Nissan is not the only maker interested in the outcome of the referendum to be held June 23; BMW is of the same mood, hoping Brexit won't become reality. The Germans already warn Mini and Rolls-Royce employees that the exit of UK from the Union could cause problems with increasing costs and higher prices due to tariff barriers. BMW CEO Harald Krueger at the Geneva auto show said "a UK vote to exit the European Union would cloud the future of the automaker's UK brands, which include Mini, along with Rolls-Royce". What's happening in this case is not only an English issue. In fact, although every decision taken by the UK's people must be respected, the automakers are right when saying they hope it is not going to happen, as you hope no one changes the cards during the game. Nissan recalls 226k vehicles over airbag inflators

Nissan and Infiniti are the latest automakers to issue recalls involving faulty airbag inflators from Takata. The Japanese automakers have announced campaigns covering about 226,326 units from seven models built in the early 2000s because they contain the bad part in the passenger-side, front airbag. The affected vehicles include the 2002-2004 Nissan Sentra, 2002-2003 Pathfinder and 2002-2003 Maxima, and it also covers the 2002-2003 Infiniti QX4, 2002-2003 I35, 2003 FX45 and 2003 FX35.
Like the other vehicles with the faulty inflators, it's possible for the part to rupture during airbag deployment and spray metal shrapnel at occupants. Nissan and Infiniti have even included vehicles with replacement airbags in this campaign because those parts also could have been defective. Both companies were also part of the earlier regional campaign to fix cars in high-humidity climates where the problem has been found to be the worst.
As is the usual response, Nissan and Infiniti will notify owners of the affected vehicles and will make the repair at no charge. According to the filing with the National Highway Traffic Safety Administration, these fixes will commence around August 11.
