Japan prosecutors seek 2 years in prison for ex-Nissan exec Greg Kelly

TOKYO — Japanese prosecutors demanded two years in prison for former Nissan executive Greg Kelly and accused him of joining a “conspiracy” to pay his former boss Carlos Ghosn illicitly in closing arguments Wednesday in a yearlong trial. “That unpaid compensation existed is clear,” prosecutor Yukio Kawasaki told the Tokyo District Court, reading briskly from a thick document. Kelly, a 30-year veteran at the Japanese automaker, was living in the U.S. when he was arrested in November 2018 upon returning to Japan to attend a meeting. The first American to be appointed to NissanÂ’s board, Kelly says he is innocent. He sat calmly in the courtroom, wearing his usual red tie and dark suit, alongside defense lawyers. Everyone in the courthouse was wearing a mask because of the pandemic. Kelly told The Associated Press in an interview last month he did not know all the details of GhosnÂ’s pay. He was determined to retain Ghosn, Nissan's former chairman, because of his extraordinary management skills and wanted to pay him in a legal way, he said. Ghosn was arrested at the same time as Kelly and also maintains he is innocent. He skipped bail in late 2019 and fled to Lebanon, the country of his ancestry. It has no extradition treaty with Japan. The charges center around a pay cut of about 1 billion yen ($10 million) a year that Ghosn voluntarily started taking from 2010, halving his pay after disclosure of high executive pay became mandatory in Japan. Nissan Motor officials considered various ways to make up for the money Ghosn gave up, such as paying him consulting fees after retirement. They also mulled other methods such as payments through subsidiaries and stock options. Nothing had been paid at the time of the arrests. The contention is over whether that money should have been reported as compensation as a de facto promised sum under a binding contract, or didnÂ’t need to be disclosed until it was finalized. Ghosn has said a group at Nissan engineered his arrest because they feared that French automaker Renault, which owns 43% of Nissan, would gain more control over the company. Other Nissan officials made similar comments during KellyÂ’s trial. Renault sent Ghosn to Nissan in 1999 to lead its rescue from the brink of bankruptcy. He successfully steered the maker of the Leaf electric car and Infiniti luxury models for nearly two decades.

EPA, CARB want Mitsubishi to retest US fuel economy figures

The Environmental Protection Agency and California Air Resources Board are the latest government bodies to request details from Mitsubishi in connection with the company's fuel economy cheating, Automotive News reports. The company will also have to reevaluate the mileage for some models here. "The agency will be directing the company to conduct additional coast down testing for vehicles sold in the US," an EPA spokesperson told Reuters. Automakers' engineers collect data on the model's drag, rolling resistance, and drivetrain friction. The information then goes into a dynamometer for the mandated fuel economy test. The EPA set stricter guidelines for the test in 2015 starting with 2017 model year vehicles, which might help avoid similar scandals here in the future. Japan has also used a coast down test since 1991, but Mitsubishi recently admitted that it hadn't been following the evaluation's mandated protocols there. Instead, the automaker came up with its own "high-speed coasting test." By selecting favorable values from the results, the company was able to artificially inflate the fuel economy of at least four Japanese minicars. In addition to inquiries from CARB and the EPA, the National Highway Traffic Safety Administration has also requested similar details from Mitsubishi. However, there is no evidence yet of any fuel economy irregularities for vehicles in the US. These agencies are just checking things out in reaction to the massive scandal in Japan. Mitsubishi execs are trying to weather the storm, though. Chief Operating Officer Tetsuro Aikawa and CEO Osamu Masuko have denied rumors about resigning over the scandal, according to Automotive News Europe citing a Reuters report. "It's my responsibility and my mission to put the company on track to recovery," Aikawa said. Their decision came despite the automaker's stock losing half of its value since the fiasco started, and vehicle orders in Japan have dropped significantly, too. Junkyard Gem: 2001 Mitsubishi Eclipse GT coupe

2001 was an eventful year for sport compacts, with "The Fast and the Furious" hitting the big screen and the "spider eye" Acura Integra entering its final model year. Mitsubishi Motors North America had released a new version of the Eclipse the year before, bigger and more luxurious than its predecessors; today's Junkyard Gem is one of those third-generation Eclipses, the fastest and most furious version available in 2001: a GT coupe with V6 engine and five-speed manual transmission, found in a Colorado Springs boneyard recently. Named for a 17th-century racehorse, the Eclipse (not to be confused with the present-day Eclipse Cross) began life in the 1990 model year as a Galant-based liftback coupe built in partnership with Chrysler at the new Diamond-Star Motors plant in Normal, Illinois (where Rivians are born today). Chrysler sold its own versions of the Eclipse for a while, with the Plymouth Laser produced through 1994 and the Eagle Talon surviving until the Eagle brand's demise in 1998. By the time this car was built, its closest relatives were the Galant, the Chrysler Sebring coupe and the Dodge Stratus coupe. The MSRP for the GT Coupe was $20,947, or about $35,789 in 2023 dollars. You could get a brand-new Integra GS-R for $22,300 ($38,101 today) in 2001, while the Dodge Neon ACR listed at just $13,845 ($23,655 now). This car was quite a bit more powerful than the 170-horsepower Integra GS-R, with this 3.0-liter 6G72 V6 and its 210 horses under the hood. The workhorse 6G72 went into far too many Mitsubishi, Chrysler and Hyundai vehicles to list here; highlights include the Chrysler TC by Maserati, the Chrysler LeBaron, the Mitsubishi Montero/Dodge Raider, the Mitsubishi Diamante and the Mitsubishi 3000GT/Dodge Stealth. This car has the five-speed manual transmission, as is proper. Buyers who insisted on the four-speed automatic had to shell out an extra grand, or $1,709 after inflation. This car appears to have been in decent cosmetic condition when it arrived at its final parking spot. These stickers were mandatory equipment on Eclipses during the 2000s. Likewise with multiple-bolt-pattern aftermarket wheels. This generation of Eclipse stayed in production through 2004, with its successor continuing to be sold through 2012.
