What to expect from the Japanese trial of Nissan and Greg Kelly

TOKYO — The criminal trial against Japanese automaker Nissan and its former executive Greg Kelly will open in Tokyo District Court on Tuesday. ItÂ’s the latest chapter in the unfolding scandal of Carlos Ghosn, a superstar at Nissan until he and Kelly were arrested in late 2018. Five questions and answers about the trial: Q: WHAT ARE THE ALLEGATIONS? A: The charges center around KellyÂ’s role in alleged under-reporting of GhosnÂ’s future compensation by about 9 billion yen ($85 million), a violation of financial laws. Kelly says he is innocent. Nissan, which is also similarly charged, has already acknowledged guilt, made corrections to the compensation documents submitted to the authorities, and has started paying a 2.4 billion yen ($22.6 million) fine. Q: WHAT HAPPENS TO GHOSN? A: Probably nothing. He skipped bail late last year and is now in Lebanon, which has no extradition treaty with Japan. Two Americans, Michael Taylor and his son Peter Taylor are being held in Massachusetts without bail, suspected of having helped Ghosn escape by hiding in a box on a private jet. A U.S. judge recently approved their extradition to Japan. The case is now before the U.S. State Department. Q: HOW DO CRIMINAL TRIALS PROCEED IN JAPAN? A: The trial, before a panel of three judges, is expected to take about a year. There is no jury. Juries are selected only for extremely serious cases in Japan, such as murder. In principle, there are no plea bargains although backroom deals are made all the time. Closed pre-trial sessions are held ahead of the trialÂ’s opening, often for months before the real trial begins. Japan's legal system has come under fire from both within and outside the country as “hostage justice” because suspects often are held for months and interrogated without a lawyer present, often leading to false confessions, according to critics. Q: WHAT ARE KELLYÂ’S CHANCES? A: More than 99% of criminal trials in Japan result in a conviction. Japanese Justice Minister Masako Mori, in an online presentation in English hosted by the Japanese Embassy in the U.S., argued the conviction rate is so high because Japan prosecutes only about a third of the cases that come up, choosing only those that “result in guilty verdicts.” She insisted there is a “presumption of innocence.” She declined comment on KellyÂ’s case.

Mitsubishi celebrates 100-year-old car with PHEV re-creation

Back in 1917, Mitsubishi Shipbuilding Co. made its foray into the automotive world with the Model A. It had a production run of just 22 units, but it was enough to make Mitsubishi Motors possible as a car company. Now, 100 years later, Mitsubishi Motors North America (MMNA) is revisiting its roots, but with a contemporary touch, by re-creating the car with the help of West Coast Customs. The California-based shop will build a Mitsu Model A with its original, century-old looks, but with a modern, advanced plug-in hybrid powertrain and a host of current technology. The custom Model A will celebrate a century of Mitsubishi by building the Model A on the Outlander PHEV platform. Despite its 21st-century capabilities, the centennial celebration vehicle "will feature all the distinctive aspects of the 1917 vehicle," according to MMNA Senior Director of Marketing Francine Harsini. The original Model A was powered by a 2.8-liter four-cylinder engine making 35 horsepower. The Outlander PHEV, upon which the new Model A will be based, uses a 2.0-liter gasoline engine and two electric motors providing power to all four wheels. West Coast Customs will build the plug-in Mitsubishi Model A at its facility in Burbank, Calif., with plans to finish it this summer. An episode of the Inside West Coast Customs show on the Velocity channel will feature the build of the centennial Model A. Mitsubishi admits to tampering with fuel economy data

Mitsubishi admitted this week to intentionally rigging fuel-economy testing in four of its models sold in Asia. The affected models are all so-called Kei class cars with sub-660cc engines manufactured at Mitsubishi's Mizushima plant in Okayama, Japan. About 157,000 of those cars are Mitsubishi eK wagons and eK Space models, and 468,000 are re-badged Nissan Dayz and Dayz Roox cars, which Mitsubishi produces for Nissan. The matter came to light after Nissan found inconsistencies in reported mileage data, which then led to Mitsubishi launching an internal investigation. The fraud was discovered to be related to falsified tire pressure data, which has an effect on mileage results – an important matter considering these kinds of vehicles are marketed by fuel economy. Mitsubishi said it has stopped manufacturing and marketing the affected vehicles. The news caused Mitsubishi's stock to plummet over 15 percent, slicing $1.2 billion off the company's value. When the eK models hit the market three years ago, they were decorated with a Good Design Award by the Japanese Ministry of Economy – a merit that is now surely tarnished. While Mitsubishi has been suffering in the US recently, with news of the Normal, Illinois plant closing, its small Mirage model has sold well.
