Carlos Ghosn appears in court: 'I am wrongly accused'

TOKYO — Former Nissan Chairman Carlos Ghosn told a Tokyo court on Tuesday that he was innocent, defending his honor in his first public appearance since he was arrested on Nov. 19 and charged with false financial reporting. "Your honor, I am innocent of the accusations against me," Ghosn told the judge, speaking firmly and calmly as he read from a statement. "I am wrongfully accused." Prosecutors have charged Ghosn, who led a dramatic turnaround at the Japanese automaker over the past two decades, with falsifying financial reports in underreporting his income by about 5 billion yen ($44 million) over five years through 2015. They also say he is suspected of having Nissan temporarily take on his investment losses from the financial crisis. Seen for the first time since his November arrest, Ghosn was wearing a dark suit without a tie, and plastic slippers, and looked thinner and with gray hair. He rebutted the allegations against him point-by-point and said he had the option to leave Nissan but had decided to stay on. "A captain doesn't jump ship during a storm," he told the court in a strong voice. The veteran auto executive, a familiar face at the World Economic Forum and other elite gatherings, was handcuffed and led into the courtroom with a rope around his waist as the hearing began. Officers uncuffed him and seated him on a bench. Presiding judge Yuichi Tada then read out the charges and said Ghosn, a Brazilian-born Frenchman of Lebanese ancestry, was considered a flight risk — he was arrested on his arrival in Tokyo by private jet — and might try to hide evidence. In Japan, suspects are routinely held without bail, often due to fears about evidence tampering. During Tuesday's hearing, Go Kondo, one of Ghosn's lawyers, argued he was not a flight risk. "He's widely known so it's difficult for him to escape. There is no risk that the suspect will destroy evidence," he said. Facing the courtroom, Ghosn spoke proudly of the automaker's — and his own — achievements, such as reviving iconic models like the GT-R and the Z, expanding operations in China, Russia, Brazil and India and pioneering electric cars and autonomous driving. "I have a genuine love and appreciation for Nissan," he said. Ghosn has been held in spartan conditions at a Tokyo detention facility since he was taken into custody. In keeping with Japanese regulations, he has been allowed visits only from his lawyers and consular officials.

Small 3-row crossover SUVs specifications compared on paper

There's no shortage of three-row vehicles on the market for carrying seven or more people and their stuff wherever they all need to go. Just about every car company has at least one large crossover or traditional SUV with three rows of seats, and there are still plenty of minivans to pick from. But most of these vehicles are large, pricey, and frequently thirsty. Fortunately, there are still a handful of smaller crossovers that deliver 7-passenger capability in a smaller, cheaper package. We've gathered four of the small three-row set here to compare them based on space, power, fuel economy, pricing, and more. They include the very old Dodge Journey, the slightly less old Mitsubishi Outlander and Kia Sorento, and the relatively new Volkswagen Tiguan. Engines, transmissions and performance Interestingly, three of the four crossovers here utilize similar engines for their four-cylinder offerings. The Dodge, Kia and Mitsubishi all feature naturally aspirated 2.4-liter four-cylinder engines. Only the Volkswagen Tiguan chooses turbocharging and a smaller 2.0-liter displacement. But because of its turbocharger, the Tiguan's four-cylinder is easily the most potent, making a healthy 221 pound-feet of torque, which is more than 40 more than the Sorento, the crossover with the next most torque. The VW is also second-most powerful, just one horse behind the Sorento. The Outlander is the least powerful in the four-cylinder class. The Journey is only barely better, but it will probably feel as slow or worse thanks to its ancient 4-speed automatic. The four-cylinder Sorento and Outlander each have 6-speed automatic transmissions, and the VW has an 8-speed. The Sorento with a V6 has an 8-speed, too. View 17 Photos Moving up to the V6 class, the Outlander is once again at the bottom. It actually makes less torque than the turbo VW Tiguan. The Journey and Sorento are almost perfectly matched. The Journey makes a bit more torque; the Sorento makes a bit more power. The Journey also gets upgraded to a 6-speed automatic. Another powertrain consideration to bare in mind is whether all-wheel-drive is necessary.

Nissan itself will be indicted alongside Ghosn, report says

Prosecutors in Tokyo are expected to file charges against Nissan itself alongside an expected indictment against former Chairman Carlos Ghosn as part of the ongoing financial misconduct case. That's according to a report from Japan's Nikkei business daily, which does not identify its sources. Charges are also likely against Greg Kelly, a member of Nissan's board of directors who was taken into custody with Ghosn Nov. 19 after Japanese authorities questioned the former chairman aboard a corporate jet at the Tokyo Haneda airport. Monday is the deadline when prosecutors must either indict the two executives, release them or arrest them on new allegations. Both men are accused of under-reporting salaries in five annual reports that stretch through the fiscal year that ended in March 2015. The Nikkei says they'll also be arrested on new allegations of misstating financial information for the subsequent three business years. Nissan would be charged for not preventing the alleged crime. Both men have reportedly denied the allegations. In response to the Nikkei report, a spokesman for Nissan told Automotive News the company had "identified serious misconduct related to the reporting of Mr. Ghosn's compensation" and was cooperating with investors. The turmoil over Ghosn prompted the automaker to scrap plans to unveil a long-awaited longer-range Leaf electric car at the L.A. Auto Show last week. Ghosn is accused of conspiring to understate his income by about half the 10 billion yen (about $88 million) over the period. Reports say the issue relates to deferred compensation that Nissan CEO Hiroto Saikawa reportedly signed off on but may not have understood. The company didn't report the deferred compensation in Japanese securities filings as it is required, since the money is considered a future liability against the company. Automotive News cites an unnamed source who says Nissan has identified some $80 million in unreported deferred compensation promised to Ghosn. Nissan's board voted Nov. 22 to oust him as chairman, and Mitsubishi followed suit days later. Ghosn remains the CEO and chairman of Renault, however. Under Ghosn's guidance, Nissan and Renault joined forces in 1999 when Nissan was teetering toward bankruptcy. Mitsubishi joined on in 2016, with all three members able to jointly develop products and control costs. He had reportedly been pushing for deeper ties, including a possible merger between Nissan and Renault at the urging of the French government.
