Carlos Ghosn was on verge of release — so prosecutors file new allegation

TOKYO — Japanese prosecutors added a new allegation of breach of trust against Nissan's former chairman Carlos Ghosn on Friday, dashing his hopes for posting bail quickly. Ghosn and another former Nissan executive, Greg Kelly, were arrested Nov. 19 and charged with underreporting Ghosn's income by about 5 billion yen ($44 million) in 2011-2015. They also face the prospect of more charges of underreporting Ghosn's income for other years by nearly 10 billion ($80 million) in total. The breach of trust allegations were filed a day after a court rejected prosecutors' request for a longer detention of both men. The new allegation only applies to Ghosn, and Kelly could still be bailed out. A request for bail by Kelly's lawyer is pending court approval, according to the Tokyo District Court, but his release will have to wait until next week since the request was still in process after office hours Friday. Prosecutors in a statement Friday alleged that Ghosn in 2008 transferred a private investment loss worth more than 1.8 billion yen ($16 million) to Nissan by manipulating an unspecified "swap" contract. Ghosn also profited by having the company transfer a total of $14.7 million to another company to benefit himself and that company's owner, who helped in the contract manipulation, prosecutors said. Shin Kukimoto, deputy chief prosecutor at the Tokyo District Prosecutors Office, refuse to say if the two transactions were related or how Ghosn illegally profited. He also declined to identify the collaborator or whether the transactions were made overseas. Ghosn and Kelly are only charged with underreporting Ghosn's pay over five years, in violation of the Financial Instruments and Exchange Act. They have not been formally charged with an additional allegation of underreporting another 4 billion yen ($36 million) for 2016-2018, for which their first 10-day detention was to expire Thursday. Prosecutors have been criticized for separating the allegations as a tactic to detain Ghosn and Kelly longer. They say Ghosn and Kelly are flight risks. The maximum penalty for violating the financial act is up to 10 years in prison, a 10 million yen ($89,000) fine, or both. Breach of trust also carries a similar maximum penalty. The conviction rate in Japan is more than 99 percent for any crime. Ghosn was sent by Renault in 1999 to turn around Nissan, then on the verge of bankruptcy, and he led its rise to become the world's second-largest automaker.

Before it leaves, it will auction its fleet of 14 beautifully-preserved classic models with no reserve. There are 14 classics that need a new home, and the collection includes something for everyone. Enthusiasts can bid on a 1974 Lancer 1400 that stands out as the first Mitsubishi ever registered in the United Kingdom. It was displayed at the 1974 edition of the British Motor Show, and it's bid to 15,000 pounds (around $20,800) as of writing. Another 47-year-old classic is a Colt Galant 2.0 imported to the United Kingdom in the spring of 1974 and used as a demonstrator to recruit dealers. It's currently sitting at 5,000 pounds, which represents about $7,000. For something quicker, there are several versions of the Lancer Evolution to choose from. One is a 2001 model signed by pilot Tommi Makinen. Another is a 2015 FQ-440 MR, a limited-edition model built in 40 examples to send off the nameplate. There is also a 2008 Evo, and a 2007 model built to Group N rally specifications. It competed in the British Rally Championship in 2007 and 2008. Alternatively, a Galant-based rally car is up for grabs, too. Coupes are relatively well represented, with a 1988 Starion whose engine was recently overhauled, and a 1992 3000GT. Performance is only one part of the Mitsubishi story, however; off-roading is another, and there are several SUVs to choose from. Mitsubishi is selling a 1987 short-wheelbase Shogun, which was sold as the Montero in the United States, a 2000 Shogun, and an L200 Desert Warrior pickup. Our favorite of the lot is a 1983 Jeep J27, which, as its name implies, was produced under license from Willys. It was given a full restoration in the 2000s. Mitsubishi is also selling a 7/10-scale replica of the Model A. Finally, it's letting go of numerous personalized plates, and it's parting with a 2015 Outlander finished in Glacier Blue and showing approximately 1,800 miles. Bidding started on April 1, 2021, and each auction is scheduled to end on April 30, 2021. The door-less, turbine-electric Mi-Tech concept was the uncontested star of the Mitsubishi display at the 2019 Tokyo Motor Show, but the Japanese firm also unveiled a close-to-production design study named Super Height K-Wagon that accurately previews its next family of kei cars. It transcends the historic city-only vocation by letting owners comfortably drive further. The Super Height K-Wagon's proportions are about what you'd expect from a kei car, but its front end falls in line with Mitsubishi's current design language by adopting the X-shaped motif seen on other models, like the Eclipse Cross. Even a humble kei car can't escape crossoverization; designers echoed Mitsubishi's SUVs by adding black plastic trim over the wheel arches and the rocker panels. Mitsubishi took advantage of the concept's relatively long wheelbase to carve out a spacious, family-friendly interior. The driver sits higher than in a normal city car, like the Mirage, and the rear passengers take their seats after opening a van-like sliding door. Clever use of space has always been a trademark of kei cars, and the Super Height K-Wagon is no exception. Technical specifications remain vague. Mitsubishi outlined a high-performance engine that shifts through a continuously variable transmission (CVT). To qualify for kei car status, its engine can't displace more than 660 cubic centimeters, and it can't make more than 63 horsepower. And, proving once again that small doesn't always mean basic, the Super Height K-Wagon is packed with electronic driving aids like a collision-mitigation system, and lane-keeping assist. Mitsubishi boss Takao Koto called the Super Height K-Wagon concept the second wave of next-generation kei cars, and confirmed the concept will enter production by the end of the current fiscal year, which ends on March 31, 2020.
