Carlos Ghosn's new lawyer, 'the Razor,' starts slashing

TOKYO — Carlos Ghosn's new lawyer took aim at Nissan, prosecutors and courts on Wednesday, dismissing the charges against the ousted chairman as an internal company matter and saying Japan was out of step with international norms by keeping his client in jail. "This should have been dealt with as an internal matter," Junichiro Hironaka, nicknamed the Razor, said at his first press briefing. Ghosn, who was arrested in November over alleged financial misconduct and remains in detention in a Tokyo jail, picked a new team last week with long-time defense attorney Hironaka as a key member to replace Motonari Otsuru, a lawyer who once ran the prosecutor's office investigating him. Hironaka's combative style contrasts with the low-key approach adopted by media-shy Otsuru. Ghosn's switch to an aggressive legal strategy came after his attempts to win bail failed and just before lawyers were due to sit down with prosecutors and judges for the first time to hash out a schedule for pre-trial discovery meetings, where prosecutors will reveal evidence and submit a list of witnesses. Hironaka said he didn't know why Ghosn picked him, but added that Ghosn probably wanted an experienced criminal lawyer as the case moved toward trial. The 73-year-old defense attorney is reputed for winning high profile cases, including the acquittal of a senior lawmaker, Ichiro Ozawa, on financial misconduct charges. He also helped free a senior bureaucrat Atsuko Muraki who was jailed for four months on corruption charges fabricated by prosecutors. Yet, even with greater legal firepower the former Nissan Motor Co boss faces a criminal justice system where only three out of every 100 defendants pleading not guilty are acquitted. Neither does Japan have a plea-deal mechanism that would allow Ghosn to agree to lesser charges for a lighter sentence. "The change in lawyers means a change in style, but the legal strategy will still be the same. I don't think it increases Ghosn's chance of an acquittal," said Masashi Akita, a defense lawyer at Shin-Yu Law Office in Osaka, ahead of Wednesday's comments by Hironaka. Ghosn has lost his perch atop an automotive alliance trio of French carmaker Renault SA and Japanese automakers Nissan and Mitsubishi Motors Corp. Attempts to win bail, including an offer to wear a GPS ankle bracelet and hire security guards to stop him trying to tamper with evidence, failed.

The seating position is high with loads of visibility. The generous headroom also keeps you from feeling like you're sitting on top of the car. The front seats don't have much shape to them, but the cushions are thick and soft enough that they're plenty comfortable. I was also surprised at how easy it was to get in and out of the Eclipse Cross. The door opening is quite large, thanks to a high roof and reasonably low floor, plus the relatively high seat. I could sit behind myself with a few inches to spare in front of my knees. I can't even say that about many comparably-sized cars let alone the current crop of cramped crossovers. The back seats are flat and firmer than I would like, but they do recline and can slide fore and aft to make more room for cargo or passengers. All of this fits into a package that's about 5 inches shorter than a Honda Civic hatchback, one of the most spacious small cars on the market. Cargo space is close to the Civic, too. With the seats up, it's slightly behind the Honda at 22.6 cubic feet (22.1 for our SEL with the subwoofer and moonroof) versus 25.7. But with the 60/40 split seats folded, the Eclipse Cross jumps ahead with 48.9 cubic feet versus the Civic's 46.2. The rest of the interior is less impressive. The plastics, while varied in texture and finish, are cheap and hard. The infotainment offers two ways to interact with it, either with the touchscreen or a touch pad, but neither is great. The touchscreen is far away, and the touch buttons on either side are annoying, and the touch pad is only slightly better than the terrible Lexus touch pad interface.

Formula One drivers have a pretty short shelf life, so when they're done racing in grands prix, retired pilots can have a whole second career ahead of them. Jody Scheckter, for example, runs an organic farm. Niki Lauda started an airline. Most move on to other racing series, provide television commentary during race broadcasts, or start their own racing teams. But not Nigel Mansell: he's got a Mitsubishi dealership. Situated on Jersey – not New Jersey, but the British channel island – Mansell Mitsubishi is run by Nigel and his son Leo. It grew out of the service station the Mansells opened fourteen years ago, and out of the Mansell Collection, a used car dealership based in an old Art Deco movie theater, but recently expanded into selling new cars recently with the acquisition of a franchise. The Japanese brand may seem a bit of an odd choice, especially now that it's getting away from performance models and putting more emphasis on plug-in electrics. After all, Nigel won his 1992 Formula One World Championship in a Renault-powered Williams, before that raced for the likes of Ferrari and Lotus, and won the CART title on his debut season in a Lola-Ford. But the Mansells are adamant that they wanted a volume brand, not to deal with the high-priced exotics with which the name might be more readily associated. After all, there are only 100,000 or so people residing on the isle of Jersey, which wouldn't make for a very big customer base for high-end machinery. He and Leo (with whom he raced at Le Mans a few years back) even participated in a two-day training session for new franchisees, where few initially recognized the former champ. And they've got plans to expand as well. But the biggest draw may very well be the star factor, and the Mansells haven't shied away from playing it up, displaying memorabilia from Nigel's racing career around the showroom. After all, the prospect of being taken on a test drive by a former F1 champion may be enough to bring new customers into the showroom who might not have otherwise.
