Nissan ex-Chairman Carlos Ghosn wins release from jail

TOKYO — The Tokyo District Court approved the release of former Nissan Chairman Carlos Ghosn on bail of 1 billion yen ($8.9 million) on Tuesday, although the end of his four months of detention in Japan was delayed when prosecutors appealed that decision. Prosecutors filed their objection to Ghosn's release within hours of the announcement he was going to be granted bail. But their appeal was rejected by the court, paving the way for his release. A lawyer for Ghosn said he would not be able to leave the Tokyo Detention Center until Wednesday at the earliest, because bail procedures can't be done at night. The acceptance of Ghosn's request for bail, his third, came a day after the lawyer, Junichiro Hironaka, said he was confident the auto executive would gain his release. Hironaka, who recently joined Ghosn's defense team, is famous for winning acquittals in Japan, a nation where the conviction rate is 99 percent. Hironaka said Monday that he had offered new ways to monitor Ghosn after his release, such as camera surveillance. Hironaka also questioned the grounds for Ghosn's arrest, calling the case "very peculiar," and suggesting it could have been dealt with as an internal company matter. He welcomed the decision, telling reporters: "It was good we proposed concrete ways showing how he would not tamper with evidence or try to flee." The 1 billion yen bail set by the court was relatively high but not the highest ever in Japan. Among the conditions for Ghosn's release were restrictions on where he can live, a ban on foreign travel and other promises not to tamper with evidence or try to flee, the court said. The former head of the Renault-Nissan-Mitsubishi Motors alliance has been detained since he was arrested on Nov. 19. He says he is innocent of charges of falsifying financial information and of breach of trust. In Japan, suspects are routinely detained for months, often until their trials start. That's especially true of those who insist on their innocence. Prosecutors say suspects may tamper with evidence and shouldn't be released. Two previous requests submitted by his legal team were denied. His previous defense lawyer, Motonari Ohtsuru, had said Ghosn's release might not come for months. Hironaka is among many critics of the Japanese justice system who say such lengthy detentions of suspects are unfair.

Like the Volkswagen diesel emission scandal, news about Mitsubishi's lies over fuel-economy ratings for its Japanese market vehicles is going from bad to worse. First, it was just a few kei cars. Then it was vehicles made as far back as 1991. Now Mitsubishi has admitted deceptive mileage test data could affect every vehicle it has sold in Japan, but not vehicles sold elsewhere. We suspect that this will not cause the EPA to relax its request for more information from the Japanese automaker to see if any vehicles sold in the US are affected. Mitsubishi Motors North America has said its US numbers are legit. In a letter to the Japanese government, Mitsubishi said that even though its managers knew getting good fuel economy ratings was a difficult task, they didn't ask too many questions of the engineers actually doing the tests. That allowed those employees to fake some of the numbers. Exactly what the repercussions will be in Japan is not known, CBS News says, both in terms of fines or penalties and how to compensate people who bought these vehicles. Reports are also just coming in that the fuel scandal might lead to Nissan taking control of Mitsubishi. More on this as it develops. Lebanon gets Interpol fugitive notice for Carlos Ghosn as escape details emerge

BEIRUT — Lebanon's justice minister said Thursday that Lebanon has received an international wanted notice from Interpol for NissanÂ’s ex-chair Carlos Ghosn, four days after he fled Japan to Lebanon before a trial on financial misconduct charges. Albert Serhan told The Associated Press in an interview that the Red Notice for the former automotive titan was received earlier Thursday by the prosecution. Ghosn skipped bail before his much-anticipated trial, which was to start in April. He arrived in Lebanon, where he was raised after moving from Brazil as a young boy, on Monday via Turkey and hasn't been seen in public since. Authorities have said that he entered legally on a French passport. A plane carrying Ghosn arrived at 5:30 a.m. (0230 GMT) Monday at IstanbulÂ’s Ataturk Airport, Hurriyet reported, adding that prosecutors ordered the arrests after widening their investigation. Flight tracking data from that time suggests that Ghosn used two different planes to fly into Istanbul and then on to Lebanon. Japanese authorities allowed Ghosn to carry a spare French passport in a locked case while out on bail, public broadcaster NHK said on Thursday, shedding some light on how he managed his escape to Lebanon. While some Lebanese media have floated a Houdini-like account of Ghosn being packed in a wooden container for musical instruments after a private concert in his home, his wife called the account “fiction” when contacted by Reuters. She declined to provide details of the exit of one of the most recognized titans of industry. The accounts of the two sources suggest a carefully planned escape known only to a few. They said a private security firm oversaw the plan, which involved shuttling Ghosn out via a private jet to Istanbul before pushing onward to Beirut, with even the pilot unaware of GhosnÂ’s presence on board. InterpolÂ’s so-called Red Notices are requests to law enforcement agencies worldwide that they locate and provisionally arrest a wanted fugitive. Serhan, the minister, said the Lebanese prosecution “will carry out its duties,” suggesting for the first time that Ghosn may be brought in for questioning. But he said that Lebanon and Japan do not have an extradition treaty, ruling out the possibility that Beirut would hand Ghosn over to Japan One sources who spoke with Reuters said Ghosn was greeted warmly by President Michel Aoun on Monday after flying into Beirut via Istanbul and was now in a buoyant and combative mood and felt secure.
