Carlos Ghosn was on verge of release — so prosecutors file new allegation

TOKYO — Japanese prosecutors added a new allegation of breach of trust against Nissan's former chairman Carlos Ghosn on Friday, dashing his hopes for posting bail quickly. Ghosn and another former Nissan executive, Greg Kelly, were arrested Nov. 19 and charged with underreporting Ghosn's income by about 5 billion yen ($44 million) in 2011-2015. They also face the prospect of more charges of underreporting Ghosn's income for other years by nearly 10 billion ($80 million) in total. The breach of trust allegations were filed a day after a court rejected prosecutors' request for a longer detention of both men. The new allegation only applies to Ghosn, and Kelly could still be bailed out. A request for bail by Kelly's lawyer is pending court approval, according to the Tokyo District Court, but his release will have to wait until next week since the request was still in process after office hours Friday. Prosecutors in a statement Friday alleged that Ghosn in 2008 transferred a private investment loss worth more than 1.8 billion yen ($16 million) to Nissan by manipulating an unspecified "swap" contract. Ghosn also profited by having the company transfer a total of $14.7 million to another company to benefit himself and that company's owner, who helped in the contract manipulation, prosecutors said. Shin Kukimoto, deputy chief prosecutor at the Tokyo District Prosecutors Office, refuse to say if the two transactions were related or how Ghosn illegally profited. He also declined to identify the collaborator or whether the transactions were made overseas. Ghosn and Kelly are only charged with underreporting Ghosn's pay over five years, in violation of the Financial Instruments and Exchange Act. They have not been formally charged with an additional allegation of underreporting another 4 billion yen ($36 million) for 2016-2018, for which their first 10-day detention was to expire Thursday. Prosecutors have been criticized for separating the allegations as a tactic to detain Ghosn and Kelly longer. They say Ghosn and Kelly are flight risks. The maximum penalty for violating the financial act is up to 10 years in prison, a 10 million yen ($89,000) fine, or both. Breach of trust also carries a similar maximum penalty. The conviction rate in Japan is more than 99 percent for any crime. Ghosn was sent by Renault in 1999 to turn around Nissan, then on the verge of bankruptcy, and he led its rise to become the world's second-largest automaker.

Mitsubishi admits to tampering with fuel economy data

Mitsubishi admitted this week to intentionally rigging fuel-economy testing in four of its models sold in Asia. The affected models are all so-called Kei class cars with sub-660cc engines manufactured at Mitsubishi's Mizushima plant in Okayama, Japan. About 157,000 of those cars are Mitsubishi eK wagons and eK Space models, and 468,000 are re-badged Nissan Dayz and Dayz Roox cars, which Mitsubishi produces for Nissan. The matter came to light after Nissan found inconsistencies in reported mileage data, which then led to Mitsubishi launching an internal investigation. The fraud was discovered to be related to falsified tire pressure data, which has an effect on mileage results – an important matter considering these kinds of vehicles are marketed by fuel economy. Mitsubishi said it has stopped manufacturing and marketing the affected vehicles. The news caused Mitsubishi's stock to plummet over 15 percent, slicing $1.2 billion off the company's value. When the eK models hit the market three years ago, they were decorated with a Good Design Award by the Japanese Ministry of Economy – a merit that is now surely tarnished. While Mitsubishi has been suffering in the US recently, with news of the Normal, Illinois plant closing, its small Mirage model has sold well. nuTonomy beats Uber to launch first self-driving taxi

In the cutthroat world of technology, if you're not first, you're last. With this in mind, it shouldn't come as a surprise to see tech companies and automakers clawing to be first in line to release self-driving cars. Uber recently partnered with Volvo in a $300-million project that should result in a self-driving fleet as early as next month. But amazingly, a 3-year-old company called nuTonomy has beat Uber to the punch by launching the world's first self-driving taxi in Singapore. Cambridge, MA,-based nuTonomy has been privately testing self-driving vehicles in Singapore since April and is now allowing select residents in the city's one-north business district to be driven around in its self-driving taxis for free. Customers will be able to summon one of nuTonomy's self-driving taxis through the company's app and will be picked up in a Renault Zoe or Mitsubishi i-MiEV electric car modified for autonomous driving. While the taxi will drive itself, an engineer from nuTonomy will ride in the vehicle to ensure that the car is operating properly and will take over if needed. There's no word on how many self-driving taxis nuTonomy put on the road, but the trials take the company one step closer to launching its fully autonomous fleet by 2018. The Wall Street Journal's Jake Watts managed to get a ride in one of nuTonomy's self-driving taxis and, while it went well, he claims human cabdrivers may not go extinct any time soon. According to Watts, the self-driving Mitsubishi lacked Tesla's polish and was overly cautious. The car did a fine job of avoiding jaywalkers, parked cars, and pedestrians on the short drive, but hesitated often, which could gives riders motion sickness, Watts said. nuTonomy CEO Karl Iagnemma will be speaking at Autoblog's UPSHIFT 2016 conference on transportation technology on October 6 in Detroit.
