Nissan files civil suit against Ghosn, seeking $91 million in damages

TOKYO — Nissan filed a civil suit Wednesday seeking 10 billion yen ($91 million) in damages from the Japanese automaker's former Chairman Carlos Ghosn. Nissan filed the case in Yokohama District Court to recoup some of the monetary damages suffered, it said, “as a result of years of misconduct and fraudulent activity" by Ghosn. The claim was calculated by adding the costs from what Nissan called Ghosn's “corrupt practices,” such as rent for overseas property, use of corporate jets and payments to Ghosn's sister, as well as costs for the internal investigation into Ghosn's alleged wrongdoings. Representatives of Ghosn said in a statement they couldn't comment as they had yet to see the legal documents. “Nissan's maneuvers continue,” they said, while noting Nissan had claimed larger damages before. Ghosn, who led Nissan for two decades and saved it from near-bankruptcy, was arrested in Japan in November 2018, and charged with underreporting his future compensation and breach of trust in diverting Nissan money for personal gain. He was awaiting trial but skipped bail and showed up in Lebanon late last year. Japan has no extradition treaty with Lebanon, and he's unlikely to be arrested. A date had not been set for his trial, and Ghosn has said he was worried his ordeal would never end and he would not get a fair hearing. The bail conditions also barred him from seeing his wife. He has repeatedly lashed out at Japan's judicial system, where the conviction rate is higher than 99%. Japanese authorities recently issued an arrest warrant for Ghosn and three Americans, accused of helping his escape. Separately, they issued an arrest warrant for Ghosn's wife on suspicion of perjury. Ghosn has repeatedly said he is innocent, saying that the promised compensation had never been decided, and all the payments were for legitimate services. Wednesday's lawsuit by Nissan comes on top of the civil case Nissan filed against Ghosn in the British Virgin Islands in August last year. It alleged unauthorized payments, sought to regain a luxury yacht and pursued other damages, according to Nissan. Yokohama-based Nissan, which makes the Z sportscar, Leaf electric car and Infiniti luxury models, is also facing trial in Japan as a company in relation to Ghosn's scandal. It has indicated it will agree to any penalties. Nissan's reputation has been sorely tarnished over the Ghosn fiasco, and its sales have dropped. Nissan reports financial results Thursday.

The Mitsubishi Outlander third row has actually been far worse

It's rare for a compact SUV to have a third row, and there's a good reason for that: Few humans can actually fit in such a tiny space. And sure, there are obviously kids, but they usually require some sort of child seat that's not fitting back there, either.  In other words, the use case is as tiny as the seats themselves. No wonder, then, that there are only two three-row compact SUVs: the 2022 Volkswagen Tiguan and the 2022 Mitsubishi Outlander. While I have yet to witness the Tiguan, the above photo is the result of fitting a 6-foot-3 automotive editor into the Outlander's third row. It ain't pretty. And that's with the middle row pushed all the way forward. Also note that it's just not a matter of legroom — headroom is terrible, too.  Obviously, this is an extreme and ridiculous test. In the end, the need to accommodate the third row almost certainly allows the Outlander to have more cargo space than average (and the mechanically related Nissan Rogue) even if it's presence is also likely the reason it doesn't have as much room as the CR-V, RAV4 and Tucson (more on that coming soon in a luggage test). It's basically a bonus feature, and if you can in fact use it, great! It's also exponentially better than the original Outlander third row. Specifically, the second-generation model that had a shockingly flimsy design that would've been rickety for the 1980s let alone the late 2000s. It consisted of a mesh fabric pulled over a tube steel ring. It was more like a beach chair than something that belonged in a moving vehicle.  Here are two period videos of me demonstrating it in a 2010 Outlander. Masuko to step down as Mitsubishi Motors CEO, Kato to succeed him

TOKYO — Mitsubishi Motors Corp said on Friday that Osamu Masuko will step down as its chief executive on June 21 and be replaced by Takao Kato, who is president of its operations in Indonesia. Masuko will retain his role as chairman of the board, Mitsubishi Motors said in a statement, adding that Masuko and Kato will hold a press conference on May 20 to discuss the changes. Japan's sixth-largest automaker, in which Nissan Motor Co holds a controlling stake, said this month it expects profit to fall to 90.0 billion yen ($821 million) in the year to March as it navigates slowing demand for cars, global trade frictions and the need to develop new technologies. Mitsubishi's partners Nissan and France's Renault are meanwhile grappling with the fallout from the arrest of Carlos Ghosn, the group's former chairman, who is facing charges of financial misconduct in Japan.
