Carlos Ghosn sues Nissan-Mitsubishi in the Netherlands

AMSTERDAM — Carlos Ghosn has launched a court case in the Netherlands against Japanese carmakers Nissan Motor and Mitsubishi Motors, who ousted him as chairman of their alliance last year on charges of embezzlement, Dutch newspaper NRC reported on Saturday. Ghosn is seeking 15 million euros ($16.8 million) in damages from the carmakers, as grave mistakes were made when he was sacked, NRC reported, citing his lawyer. "In the Netherlands, if you want to fire an executive you have to first tell him what he's being accused of, and you have to provide him with the evidence for the accusations. Neither of those things has happened," lawyer Laurens de Graaf told NRC. Ghosn fell from grace late last year when he was arrested in Japan and sacked by Nissan on charges of financial misconduct, which he denies. He has also been fired as the CEO and chairman of French carmaker Renault. Ghosn was freed in April from jail in Japan on a $4.5 million bail. Among other charges of fraud and misconduct, Nissan and Mitsubishi have said Ghosn improperly received $9 million in compensation from their joint venture. Suspect expenses Ghosn made when he chaired Renault and Nissan amounted to about 11 million euros, Renault's board said in June. Ghosn holds French, Lebanese and Brazilian citizenship, but opted for the fiscally more friendly Netherlands as his tax domicile in 2012. The holding company for the Nissan-Mitsubishi alliance is also incorporated in the Netherlands. The district court in Amsterdam is reviewing the case but has not set a trial date yet, NRC said. Carlos Ghosn freed from jail after four months

TOKYO — Wearing a mask, cap and what looked like a construction worker's outfit, the former chairman of Nissan Motor Co., Carlos Ghosn, left a Tokyo detention center Wednesday after posting 1 billion yen ($8.9 million) bail. Although his face was obscured as he left the facility, Ghosn's identity was apparent as he smiled after arriving at a building in downtown Tokyo, having removed his jacket, mask and hat. There was a scramble by media to follow Ghosn after he boarded a small Suzuki van, topped with a ladder, and traveled from the Tokyo Detention Center toward downtown. Motorcycles trailed the van in formation as it passed through city streets to one of the defense lawyer's offices. Ghosn later left in another car, which was mobbed by media. Ghosn, the former head of the Renault-Nissan-Mitsubishi Motors alliance was arrested on Nov. 19. He is charged with falsifying financial reports and with breach of trust. The Tokyo District Court confirmed the 1 billion yen ($8.9 million) bail was posted earlier in the day, after a judge rejected an appeal from prosecutors requesting his continued detention. That cleared the way for Ghosn to leave the facility after spending nearly four months since his arrest. Before his release, Ghosn, who turns 65 on Saturday, issued a statement reasserting his innocence. "I am innocent and totally committed to vigorously defending myself in a fair trial against these meritless and unsubstantiated accusations," he said. A date for his trial has not yet been set. Suspects in Japan often are detained for months, especially those who insist on their innocence, like Ghosn. Some legal experts, including Junichiro Hironaka, one of his lawyers, have criticized the system as "hostage justice," saying the long detentions tend to encourage false confessions. Ghosn's lawyer in France, Jean-Yves Le Borgne, said the lawyers in Japan will be leading the defense but he was in touch with them. "He is catching his breath and settling in," Le Borgne said of Ghosn. French Finance Minister Bruno Le Maire said a presumption of innocence for Ghosn was crucial, while noting the importance to France of the alliance between Nissan and French automaker Renault SA. "It is a good thing that Carlos Ghosn can defend himself freely and serenely, and his release will permit Carlos Ghosn to defend himself freely and serenely," he said. The French government owns about 15 percent of Renault SA, making it an influential voice in the future of the alliance.

A company called Oakridge Global Energy Solutions is providing batteries to Minnesota's Freedom Trucking. Oakridge claims the electric freight trucks can haul nearly 40 tons of cargo almost 400 miles on a single charge. "The custom battery design for Freedom Trucking is an absolute game changer," says Oakridge CEO Steve Barber. The Melbourne, Florida-based startup also says it is providing lithium-ion batteries for Harley-Davidson, Indian, and Victory motorcycles. (Notably, Oakridge was accused last year of failing to pay its employees. Also, of note, Oakridge trades as OGES on OTCQX, the same over-the-counter market as Elio Motors.) A new UK poll suggests that nearly a third of drivers would choose a plug-in vehicle for their company car. 23 percent of respondents said they'd choose a plug-in hybrid for their fleet car, while 8.2 percent would choose a battery electric vehicle. Another 7.1 would choose a conventional hybrid, and 47.2 percent still prefer diesel, while only 12.4 percent would choose gasoline (it is, after all, the UK). In all, the poll (with an admittedly small sampling of 282 respondents) shows that alternatively powered vehicles will make up 40.4 percent of future fleet orders will. A reduction in plug-in car subsidies has boosted Mitsubishi's UK sales in February. As the Plug-In Car Grant was set to reduce from GBP5,000 to GBP2,500 ( from about $7,117 to $3,559) on March 1, Mitsubishi saw a run on its Outlander PHEV by customers looking to take advantage of the larger subsidy. Outlander PHEV sales were up 41 percent compared to a year before. The launch of the L200 Series 5 also helped Mitsubishi's performance in February, as pickup truck sales were up 34 percent. The rise was driven by a 41 per cent increase in sales of the Outlander PHEV, ahead of the reduction in the Plug-in Car Grant from GBP5,000 to GBP2,500 beginning March 1. The UK's favourite plug-in continues lead the hybrid and electric car sector in 2016.
