Carlos Ghosn was on verge of release — so prosecutors file new allegation

TOKYO — Japanese prosecutors added a new allegation of breach of trust against Nissan's former chairman Carlos Ghosn on Friday, dashing his hopes for posting bail quickly. Ghosn and another former Nissan executive, Greg Kelly, were arrested Nov. 19 and charged with underreporting Ghosn's income by about 5 billion yen ($44 million) in 2011-2015. They also face the prospect of more charges of underreporting Ghosn's income for other years by nearly 10 billion ($80 million) in total. The breach of trust allegations were filed a day after a court rejected prosecutors' request for a longer detention of both men. The new allegation only applies to Ghosn, and Kelly could still be bailed out. A request for bail by Kelly's lawyer is pending court approval, according to the Tokyo District Court, but his release will have to wait until next week since the request was still in process after office hours Friday. Prosecutors in a statement Friday alleged that Ghosn in 2008 transferred a private investment loss worth more than 1.8 billion yen ($16 million) to Nissan by manipulating an unspecified "swap" contract. Ghosn also profited by having the company transfer a total of $14.7 million to another company to benefit himself and that company's owner, who helped in the contract manipulation, prosecutors said. Shin Kukimoto, deputy chief prosecutor at the Tokyo District Prosecutors Office, refuse to say if the two transactions were related or how Ghosn illegally profited. He also declined to identify the collaborator or whether the transactions were made overseas. Ghosn and Kelly are only charged with underreporting Ghosn's pay over five years, in violation of the Financial Instruments and Exchange Act. They have not been formally charged with an additional allegation of underreporting another 4 billion yen ($36 million) for 2016-2018, for which their first 10-day detention was to expire Thursday. Prosecutors have been criticized for separating the allegations as a tactic to detain Ghosn and Kelly longer. They say Ghosn and Kelly are flight risks. The maximum penalty for violating the financial act is up to 10 years in prison, a 10 million yen ($89,000) fine, or both. Breach of trust also carries a similar maximum penalty. The conviction rate in Japan is more than 99 percent for any crime. Ghosn was sent by Renault in 1999 to turn around Nissan, then on the verge of bankruptcy, and he led its rise to become the world's second-largest automaker.

Mitsubishi Motors Chairman Masuko resigns due to health reasons

Osamu Masuko (Getty Images)   TOKYO — Mitsubishi Motors said on Friday Osamu Masuko resigned as chairman due to health reasons and has handed over the role to CEO Takao Kato on a temporary basis. A veteran of the larger Mitsubishi conglomerate, Masuko joined the automaker in 2004 and became president in 2007. He oversaw the creation of the partnership between Mitsubishi and Nissan in 2016, which saw Nissan take a controlling stake in the company. The 71-year-old will stay on at Mitsubishi as a special adviser, the company said in a statement. It did not specify what Masuko was ailing from. Masuko was at the helm of Mitsubishi during a 2016 scandal in which the automaker was found to have overstated the fuel economy on its vehicles. An investigation uncovered slack governance and pressure on resourced-starved engineers as chronic issues at the company. CEO Takao Kato adds the role of chairman. (Getty Images)   The scandal was Mitsubishi's third in two decades, and it pummeled profits and tarnished the automaker' s brand. At the height of the scandal, Nissan lent its smaller rival a lifeline by offering the company $2.2 billion for a 34% controlling stake. The deal was agreed between Masuko and then Nissan CEO Carlos Ghosn, and brought Mitsubishi in as a junior partner in the Nissan-Renault automaking alliance. Masuko later denounced his ties with Ghosn following Ghosn's 2018 arrest in Japan over financial misconduct, charges that Ghosn has denied. All three members of the alliance are currently mired in financial problems after years of aggressive expansion policies under Ghosn's leadership resulted in falling vehicle sales. A further drop in global car demand due to the coronavirus pandemic has exacerbated these problems, and Mitsubishi, Nissan and Renault are each bracing for steep annual operating losses this year. Mitsubishi planning to bring back Lancer as hybrid crossover

It looks like the Mitsubishi Lancer is about to undertake a daring transformation from a ten-year-old sedan to a crossover. The Eclipse has already shed its coupe roots and become the Eclipse Cross, and now it's the Lancer's turn to become a high-rider. The carmaker already teased its future plans with the e-Evolution concept last year (pictured above), again combining a previously successful Mitsubishi nameplate with new crossover intentions. Now, talking to AutoExpress, Mitsubishi's chief operating officer and chief designer both hint of the Lancer taking the shape of the e-Evolution. For Mitsubishi, the Lancer's segment still looks very viable in the next decade, but it doesn't necessarily want to fight the Ford Focus and the VW Golf with a conventional hatchback, let alone a three-box saloon. "We believe we have a solution that could fit the segment", said COO Trevor Mann. "[The segment's] numbers are still expanding in China, so there's appeal. And I think because the segment is so large globally, we've got to take a look at it." The chief designer, Tsunehiro Kunimoto said, "Just because it's C-segment, it doesn't mean it has to be a very conventional hatchback. Maybe we can create a new type of hatchback vehicle. We're thinking quite radically." It is also likely that the Lancer's eventual replacement will use hybrid technology and a Renault-Nissan Alliance platform — and an all-wheel-drive option would still be a nod to the Lancer Evo's heritage, at least partially justifying any use of the Evolution brand. Trevor Mann says the product timeline is largely set until 2025, and the existing crossovers in the portfolio, the Outlander and the Outlander Sport (known elsewhere as the ASX) will get replacements. The company is now directing its attention to the Lancer and the Montero, both of which have last had a major update over ten years ago. The Lancer was phased out in the U.S. last fall after a very long run. Related Video:
