Dutch court orders Ghosn to repay Nissan-Mitsubishi $6 million in wages

AMSTERDAM — A court in Amsterdam on Thursday ordered fugitive former car executive Carlos Ghosn to repay Nissan and Mitsubishi almost 5 million euros ($6.1 million) in wages he received from their Dutch registered joint venture Nissan-Mitsubishi BV in 2018. Nissan and Mitsubishi, which ousted Ghosn as chairman of their companies and of their joint venture after his arrest for financial misconduct in 2018, claimed Ghosn had wrongly granted the wages to himself. Ghosn had brought the case himself, demanding 15 million euros in compensation for missed wages and severance payments as he claimed Nissan and Mitsubishi had violated Dutch labor laws when they dismissed him from the Amsterdam-based joint venture in 2019. But the district court in Amsterdam sided with the car companies, stating that Ghosn did not have a valid employment agreement with the joint venture, as it lacked the required consent of the boards of Nissan and Mitsubishi. The amount Ghosn needs to repay equals the net payments he received from the joint venture between April and November 2018, the court said. Ghosn, who has denied wrongdoing, was chairman of both Nissan and Mitsubishi and chief executive of Renault when he was arrested in Japan in 2018 on charges of underreporting his salary and using company funds for personal purposes. He fled to Lebanon in December 2019 hidden in carry-on luggage on a private jet that flew out of Kansai Airport, and has remained in that country since. Carlos Ghosn video: 'This is about conspiracy. This is about backstabbing'

TOKYO — Nissan's former Chairman Carlos Ghosn maintained his innocence in a video released by his legal team Tuesday and accused some executives at the Japanese automaker of a "conspiracy" that led to his arrest on financial misconduct allegations. "The first message is that I'm innocent," said Ghosn, wearing a white shirt and dark jacket and speaking calmly in the nearly 10-minute video shown at the Foreign Correspondents' Club in Tokyo. "This is a conspiracy," he said. "This is not about specific events, this is not about, again, greed, this is not about dictatorship. This is about a plot. This is about conspiracy. This is about backstabbing." His lawyer Junichiro Hironaka said the video was prepared in case Ghosn was not able to speak at a news conference planned for Thursday. Ghosn was arrested last week while out on bail and remains at the Tokyo Detention Center. Ghosn said the executives behind the conspiracy were motivated by what he called "selfish fears," including what they saw as a merger with French alliance partner Renault SA. They mistook his leadership for greed and dictatorship, when he was the biggest defender of Nissan's autonomy, Ghosn said. He also said he was worried about Nissan, wondering whether those executives were really watching out for the company. Hironaka said a section of the video in which Ghosn mentioned names was removed on his legal advice. Nissan Motor Co., while declining to comment on the criminal case, has said an internal investigation has found that Ghosn falsified financial documents to under-report compensation, and that he used Nissan money for personal gain. "Nissan's internal investigation has uncovered substantial evidence of blatantly unethical conduct," company spokesman Nicholas Maxfield said when asked for comment on Ghosn's video. "The company's focus remains on addressing weaknesses in governance that enabled this misconduct." Ghosn's fourth arrest was on a fresh breach of trust allegation based on suspicion that payments from a Nissan subsidiary to an Oman dealership were diverted to a company effectively run by Ghosn. On Monday, Nissan Motor Co. shareholders voted to oust Ghosn from its board and to approve the appointment of French alliance partner Renault SA's Chairman Jean-Dominique Senard as Ghosn's replacement. Renault owns 43 percent of Nissan.

Formula One drivers have a pretty short shelf life, so when they're done racing in grands prix, retired pilots can have a whole second career ahead of them. Jody Scheckter, for example, runs an organic farm. Niki Lauda started an airline. Most move on to other racing series, provide television commentary during race broadcasts, or start their own racing teams. But not Nigel Mansell: he's got a Mitsubishi dealership. Situated on Jersey – not New Jersey, but the British channel island – Mansell Mitsubishi is run by Nigel and his son Leo. It grew out of the service station the Mansells opened fourteen years ago, and out of the Mansell Collection, a used car dealership based in an old Art Deco movie theater, but recently expanded into selling new cars recently with the acquisition of a franchise. The Japanese brand may seem a bit of an odd choice, especially now that it's getting away from performance models and putting more emphasis on plug-in electrics. After all, Nigel won his 1992 Formula One World Championship in a Renault-powered Williams, before that raced for the likes of Ferrari and Lotus, and won the CART title on his debut season in a Lola-Ford. But the Mansells are adamant that they wanted a volume brand, not to deal with the high-priced exotics with which the name might be more readily associated. After all, there are only 100,000 or so people residing on the isle of Jersey, which wouldn't make for a very big customer base for high-end machinery. He and Leo (with whom he raced at Le Mans a few years back) even participated in a two-day training session for new franchisees, where few initially recognized the former champ. And they've got plans to expand as well. But the biggest draw may very well be the star factor, and the Mansells haven't shied away from playing it up, displaying memorabilia from Nigel's racing career around the showroom. After all, the prospect of being taken on a test drive by a former F1 champion may be enough to bring new customers into the showroom who might not have otherwise.
