Carlos Ghosn was on verge of release — so prosecutors file new allegation

TOKYO — Japanese prosecutors added a new allegation of breach of trust against Nissan's former chairman Carlos Ghosn on Friday, dashing his hopes for posting bail quickly. Ghosn and another former Nissan executive, Greg Kelly, were arrested Nov. 19 and charged with underreporting Ghosn's income by about 5 billion yen ($44 million) in 2011-2015. They also face the prospect of more charges of underreporting Ghosn's income for other years by nearly 10 billion ($80 million) in total. The breach of trust allegations were filed a day after a court rejected prosecutors' request for a longer detention of both men. The new allegation only applies to Ghosn, and Kelly could still be bailed out. A request for bail by Kelly's lawyer is pending court approval, according to the Tokyo District Court, but his release will have to wait until next week since the request was still in process after office hours Friday. Prosecutors in a statement Friday alleged that Ghosn in 2008 transferred a private investment loss worth more than 1.8 billion yen ($16 million) to Nissan by manipulating an unspecified "swap" contract. Ghosn also profited by having the company transfer a total of $14.7 million to another company to benefit himself and that company's owner, who helped in the contract manipulation, prosecutors said. Shin Kukimoto, deputy chief prosecutor at the Tokyo District Prosecutors Office, refuse to say if the two transactions were related or how Ghosn illegally profited. He also declined to identify the collaborator or whether the transactions were made overseas. Ghosn and Kelly are only charged with underreporting Ghosn's pay over five years, in violation of the Financial Instruments and Exchange Act. They have not been formally charged with an additional allegation of underreporting another 4 billion yen ($36 million) for 2016-2018, for which their first 10-day detention was to expire Thursday. Prosecutors have been criticized for separating the allegations as a tactic to detain Ghosn and Kelly longer. They say Ghosn and Kelly are flight risks. The maximum penalty for violating the financial act is up to 10 years in prison, a 10 million yen ($89,000) fine, or both. Breach of trust also carries a similar maximum penalty. The conviction rate in Japan is more than 99 percent for any crime. Ghosn was sent by Renault in 1999 to turn around Nissan, then on the verge of bankruptcy, and he led its rise to become the world's second-largest automaker.

2020 Mitsubishi Outlander Sport gets another refresh at Geneva

A mysterious electric SUV isn't the only vehicle Mitsubishi is bringing to the Geneva Motor Show. The company is also showing a refreshed 2020 Mitsubishi Outlander Sport (or ASX as it's known in some markets). And yes, despite the fact the Outlander Sport hasn't been completely redesigned since its introduction in the 2011 model year, Mitsubishi is only giving it a mild update. Up front, the entire fascia is changed with all-new headlights, grille and front bumper. It's all more angular, and appears to be a blend of the Eclipse Cross and that electric SUV concept teased recently. It's easily the most successful part of the refresh. The sides are unchanged save for some chrome fake fender vents. The back features new LED taillights and a rear bumper with a faux skid plate rather than a faux diffuser. The inside is almost unchanged except for the new infotainment screen. At 8 inches, it's an inch larger than the old model. It also has the ability to play videos from a USB flash memory stick when the car is parked. Powertrain options for the U.S. haven't been announced, but we expect it will use the same 148-horsepower 2.0-liter four-cylinder currently available, plus its associated drivetrains. The current model can be had with either front- or all-wheel drive, with just a CVT on all-wheel drive models, and an available manual on front-driver versions. One final interesting aspect about the Outlander Sport just getting a refresh again is that it's the best-selling Mitsubishi in America, and the third-best worldwide. It seems strange to give so little love to a relatively successful model. Then again, the crossover has probably mostly paid for itself by now and it keeps selling, so perhaps Mitsubishi is just trying to maximize returns while it works on the smaller next-generation version. Pristine, time-traveling 2006 Mitsubishi Evo sells for $138K

Remember that never-sold 2006 Mitsubishi Lancer Evolution we told you about last week? The one with 9 miles on the odometer, its seats wrapped in plastic and never titled? And that had already earned a bid of $100,100 on eBay? Well, that Evo has now sold for a hair under $138,000, Road and Track reports. That's $100,000 over its original sticker price of $37,094. The seller was South Coast Mitsubishi in Orange County, Calif., which one Reddit user claims has stockpiled multiple Evos and sold them off at a premium. This high-fetching Evolution is an IX MR model in Graphite Gray with black trim, a six-speed manual, all-wheel-drive transmission. It's optioned with the MR package that includes some aluminum and carbon-fiber bits and boost-gauge kit, plus the Zero Lift aero kit. Under the hood is a 2.0-liter, 16-valve inline four-cylinder, 286 horsepower engine with 289 pound-feet of torque. It can do 0-to-60 in 4.4 seconds. The car's production run ended with the 2015 model year. The car fielded a total of 80 bids, which started at $30,000.
