Ghosn flight prompts renewed focus on Japan's strict justice system

TOKYO — Carlos Ghosn's daring flight from Japan, where he was awaiting trial on charges of financial wrongdoing, has revived global criticism of the nation's "hostage justice," but in Japan is prompting talk of reversing more lenient curbs on defendants. The ousted boss of Japan's Nissan and France's Renault fled to Lebanon, saying on Tuesday that he had "escaped injustice" and would "no longer be held hostage by a rigged Japanese justice system." Ghosn was first arrested in November 2018 when his private jet landed in Tokyo and kept in jail for more than 100 days as prosecutors added more charges, all of which he has denied. He was released on $9 million bail in March — only to be arrested and bailed again the following month. He was facing four charges, including underreporting his Nissan salary and transferring personal financial losses to his employer's books while he ran Japan's No. 2 automaker. His apparent escape from Japan's legal system — Tokyo and Lebanon don't have an extradition treaty — will likely halt or even reverse a trend of recent years toward granting bail in more cases, said Colin Jones, a law professor at Doshisha Law School in Kyoto. “I would expect it to be more difficult for foreign defendants to get bail,” Jones said. In Japan, suspects who deny the charges against them are often detained for long periods and subject to intense questioning without a lawyer present, a system critics call "hostage justice." Japanese civil rights groups and the main bar lawyers association have long criticized a system that convicts 99.9% of criminal defendants. They say it gives too much power to prosecutors, who can detain suspects for long periods before indictment, and relies too much on confessions, some later found to have been forced and false. Ghosn's escape is clearly a shock to Japan's legal establishment. "This case raises the extremely serious issue of whether it's all right to continue the trend toward bail leniency," said former prosecutor Yasuyuki Takai. "The legal profession and lawmakers need to quickly consider new legal measures or a system to prevent such escapes," Takai, who was formerly with the special investigation unit of the prosecutor's office, told public broadcaster NHK.

French investigators will question Carlos Ghosn in Lebanon

BEIRUT — A team of French investigators will come to Beirut next month to participate in interrogating former Renault-Nissan boss Carlos Ghosn, a Lebanese justice ministry official said Saturday. The official gave no specific date or details of what information the investigators would seek from Ghosn. Former auto executive Ghosn, who is a Lebanese, Brazilian and French national, fled Japan in a dramatic escape that drew headlines last year, arriving in Lebanon on Dec. 30, 2019. In addition to his trial in Japan, the 66-year-old businessman is facing a number of legal challenges in France, including tax evasion and alleged money laundering, fraud and misuse of company assets while at the helm of the Renault-Nissan alliance. The Lebanese official, speaking on condition of anonymity in line with regulations, said the French investigators would be working alongside their Lebanese counterparts. Information about investigations is secret under French law, and French judicial officials did not respond to requests for comment Saturday on the report. After leading the Japanese automaker Nissan for two decades, Ghosn was arrested in Japan in November 2018 on charges of breach of trust, misusing company assets for personal gains and violating securities laws by not fully disclosing his compensation. He denied wrongdoing and fled Japan while out on bail awaiting trial. He is unlikely to be extradited from Lebanon, where he has been since last year. At least two Ghosn-related investigations were opened in France. One focused on suspicious transactions between Renault and a distributor in Oman, as well as suspected payments for private trips and events paid by Renault-NissanÂ’s Netherlands-based holding company RNBV. Another investigation focused on suspected misuse of company funds for a party for Ghosn at Versailles. The French inquiry aims to determine who is at fault for a string of alleged financial violations between 2009 and 2020. That includes “suspicious financial flows” between Renault and the SBA car dealership in Oman. This aspect of the inquiry is targeting several million euros of travel and other costs paid by the Netherlands-based Renault-Nissan holding RNBV but suspected to have been for GhosnÂ’s personal use. GhosnÂ’s French lawyers have said the payments to SBA were “justified bonuses” for having boosted car sales in the Persian Gulf and denied allegations that the funds benefited Ghosn or his family personally.

Mitsubishi has been selling the plug-in hybrid version of its Outlander crossover for a while now, just not here in the U.S. It has seen popularity overseas, though, and is Europe's best-selling plug-in hybrid. It surpassed the 100,000 sales mark back in early 2016, thanks to Europe and Japan. Now, Mitsubishi is looking to electrify our shores, and will bring the all-new Outlander PHEV to the U.S. by the end of the year. The Outlander PHEV is powered by a 2.0-liter engine and two 60-kW electric motors, one situated at each axle, for a total estimated output of 195 horsepower. That makes it all-wheel-drive as well, using Mitsubishi's Super All-Wheel Control (S-AWC) system borrowed from the Lancer Evolution, and it has already proven itself in off-road competition. A 300-volt, 12-kWh lithium-ion battery pack is located in the subfloor between the front and rear axles. It can be charged via plug (including DC fast-charging capability), or via the car's regenerative braking system (adjustable using paddle shifters). The vehicle features three different, automatically selected drive modes. EV Drive Mode makes use of the electric motors for all-electric driving. Parallel Hybrid Mode uses the gas engine to drive the front wheels, and provides added power from the electric motors as necessary (mainly at high speeds, where this mode is the most efficient). Series Hybrid Mode uses the gasoline engine as a generator to charge the battery and provide power to the electric motors, which are doing the propulsion work. There are also three driver-selected modes. Eco Mode reduces fuel and electricity consumption. Battery Save Mode conserves charge, operating in hybrid mode. Battery Charge Mode keeps the engine running to generate electricity and recharge the battery pack to make sure you'll have power for driving uphill or towing, for instance. EV driving range and fuel economy figures will be released soon, but Mitsubishi says it expects to exceed the premium competition (which offer about 14 miles of EV range). The Outlander PHEV is also big on technology. It offers a suite of safety systems, including blind spot and lane departure warnings, multi-view camera, adaptive cruise control, auto high beams, and forward collision mitigation. The vehicle offers a smartphone app that allows the owner to remotely control the charging schedule, climate control, lighting, vehicle settings, and monitor vehicle status.
