NHTSA slaps BMW with $40M fine for slow Mini recall

BMW is on the hook for a $40-million fine after the National Highway Traffic Safety Administration slapped the automaker over not recalling Minis that failed to meet minimum side-impact crash standards. The civil penalty from NHTSA concerns 2014 and 2015 Mini Cooper hatchback models that "failed a crash test designed to determine whether the vehicle met crash-protection minimums," the government agency said in a press release issued this week. An October 2014 test revealed the first problem, and the Mini was subsequently retested in July, only to fail again and finally prompt a recall of more than 30,000 cars. But according to NHTSA's investigation that was opened in October, BMW waited too long to issue a recall after it knew the cars did not meet standards and bring them into compliance with more energy-absorbing materials installed by Mini dealers. This is the second time NHTSA slapped BMW with a major penalty, following a $3-million fine back in 2012 failing to report recalls of its cars and motorcycles. "For the second time in three years, BMW has been penalized for failing to meet that obligation," NHTSA Administrator Mark Rosekind said in the release. "The company must take this opportunity to reform its procedures and its culture to put safety where it belongs: at the top of its priority list." In a separate release issued this week, BMW Group said it, "is committed to further improving its recall processes to better serve its customers," and that the company, "respects the role of NHTSA and looks forward to working with them to develop solutions for the future." Under terms of a Consent Order issued to BMW, the company acknowledges that it violated requirements to issue a timely recall of vehicles that did not comply with minimum crash protection standards, to notify owners of recalls in a timely fashion, and to provide accurate information about its recalls to NHTSA. NHTSA imposed a $3 million civil penalty to BMW in 2012 for similar violations.

On Location in California with BMW and Mini

A mid-winter escape from frigid Michigan to drive a trio of new BMW and Mini products? It'd be a busy couple of days, but you can't argue with Southern California in February. The temperatures in LA, where we drove the Mini Cooper S Convertible, hovered in the mid-80s, and it was solidly in the 70s further north, at Monterey, where we drove the M2 and X4 M40i. The highlight of the trip was Mazda Raceway Laguna Seca, which is a rewarding track to drive in a street car. The M2 was a blast there. The canyon roads above Malibu in the Mini were a close second, but even the lazy drive down the PCH to Big Sur was a blast. More important is the California state of mind we were in when driving all three of these cars. I've spent a lot of time in this state, and it has a complicated relationship with the car – and there's also a huge difference in attitude between the greater Bay Area and Southern California. Ample sun and twisty roads clash with image-consciousness, eco-consciousness, and brutal urban gridlock, and each BMW dealt with that paradox admirably, in its own way. Mini Seven Special Edition looks back to the days of Austin

Mini is back at the game of special editions with the Seven, the first of its kind for the third-generation Hardtop. Named after the original Austin Seven – one of the two original Mini models, alongside the Morris Mini Minor – the new style pack is available on both the two- and four-door and the Cooper and Cooper S models. But where past Mini special editions have been largely homogenous, the new Seven has a surprising array of options, especially as it relates to colors and upholsteries. Owners can choose from four different paint schemes – Lapisluxury Blue (shown above), Pepper White, Midnight Black, and British Racing Green. The options continue in the cabin, where owners can select the Seven-specific Diamond Malt Brown fabric/leather upholstery, or they can go with straight leather in Cross Punch Carbon Black, Lounge Satellite Grey, or MINI Yours Lounge Carbon Black. There are four dash trim options, too, with standard Piano Black, and optional Dark Cottonwood, Fibre Alloy, and Off-White. Below the trim strip, owners can have either a Malt Brown color line or Carbon Black. A set of 17-inch, two-tone alloys are standard, and regardless of which exterior paint you opt for, you're stuck with a Melting Silver roof. The decreasing-width stripes match the roof and have what Mini claims are Malt Brown rules, but we're seeing red trimmings in these photos. Heated front seats, a panoramic sunroof, Comfort Access, a Harmon/Kardon stereo, park-distance control, power-folding, auto-dimming mirrors, and a 6.5-inch Mini Connected system are all standard features as part of the Seven package, while additional options will be available, like on any other Cooper or Cooper S. Mini's press release, for example, specifically calls out the larger 8.8-inch Mini Connected XL and adaptive dampers as available options.
