U.S. appeals court preserves $210M Hyundai-Kia fuel economy class settlement

A U.S. appeals court restored a $210 million nationwide class-action settlement for hundreds of thousands of owners of Hyundai Motor Co and Kia Motors Corp vehicles whose fuel economy estimates were inflated. By an 8-3 vote on Thursday, in a case closely watched by class-action lawyers, the 9th U.S. Circuit Court of Appeals in Pasadena, California, said vehicle owners had enough in common to let them settle as a group. It also rejected arguments by owners opposed to the settlement that the claims process was too burdensome, and that lawyers for the class had colluded with the automakers to extract a "sweetheart deal" that undervalued their claims. The case began after the U.S. Environmental Protection Agency found flaws in Hyundai's and Kia's testing procedures, prompting the automakers to lower fuel efficiency estimates for about 900,000 vehicles from the 2011, 2012 and 2013 model years. Lawyers for objecting drivers had no immediate comment. Hyundai said it was grateful for the decision. Kia and its lawyers did not immediately respond to requests for comment. The decision by Circuit Judge Jacqueline Nguyen upheld a settlement approved in June 2015 by U.S. District Judge George Wu in Los Angeles. Wu "made careful findings, which the objectors here largely do not challenge, and which more than support the judgment," Nguyen wrote. The decision reversed a divided three-judge 9th Circuit panel's January 2018 rejection of the settlement and decertification of the class action. That panel said Wu failed to assess whether differences in state laws prevented certification of a nationwide class. It also said used car owners should have been excluded because it was unclear whether they had relied on the South Korean automakers' fuel economy claims. Lawyers had said it would become much harder to obtain nationwide settlements if the panel ruling stood. Nguyen had dissented from the panel ruling. Circuit Judge Sandra Ikuta, who wrote it, dissented on Thursday. Ikuta accused the majority of failing to determine what law should apply to the nationwide class or how the settlement, and thus attorneys' fees, should be valued. "The majority's failure to correct these errors may be beneficial for the class action bar, but it detracts from compliance with Supreme Court precedent," Ikuta wrote. The 9th Circuit covers nine western U.S. states, Guam and the Northern Mariana Islands.

Kia Telluride vs Buick Enclave Luggage Test | What actually fits behind that third row?

So, you want to buy a three-row crossover. Before plunking down $40,000 on a new sport utility vehicle, might we dissuade you with the prospect of minivan ownership? The Pacifica Hybrid, perhaps ... no? Fine. Good thing crossovers (especially the Telluride and comparable Palisade) are so nice to drive these days. We’ll assume you want the big three-row crossover, as you intend to seat folks in all three rows. Unfortunately, raising that third row reduces the luggage area from cavernous to crawl space. ItÂ’s rather devastating from a pure numbers perspective to the two models we have today. The 2019 Buick Enclave goes from a monstrous 58 cubic-feet with the second-row in place down to 23.6 cubic-feet (which along with the nearly identical 2020 Chevrolet Traverse is still best-in-class). Meanwhile, the 2020 Kia Telluride takes a similar hit, going from 46 cubic-feet down to 21 cubic-feet. Just looking at the numbers, it would seem that the EnclaveÂ’s big advantage all but disappears with the third row up, boasting just 2.6 cubic-feet of storage more than the Telluride. But as West Coast Editor James Riswick has discovered in the numerous luggage tests he's conducted, the numbers don't always tell the whole story. Let's see how the Enclave and Telluride compare when you actually put things inside.  Boom. The Enclave swallows all of the test luggage we have for it without any fuss. The distance between the back of the seats to the hatch opening is enough to fit our full-size suitcase horizontally, making it easy to stack every other bag around it. It even fits below the seatbacks, so the driver will have an uninhibited view out the rear of the vehicle.  At our Michigan HQ, our test luggage consists of the following pieces: 28-inch upright suitcase, 24-inch upright suitcase, 19-inch upright suitcase, two small tote bags and one backpack. ItÂ’s likely enough luggage for a quick weekend getaway with the family, given there are no strollers involved. As we attempted to pack it all into the Telluride, weÂ’re glad we didnÂ’t have anything else. The loss of 2.6 cubic-feet of space was indeed felt much harder than what it looks like on paper. We knew we were in trouble when the 28-inch suitcase didnÂ’t fit along the floor as it did so neatly in the Enclave. We were forced to stack it up next to the rear seats, which left it sitting rather tall back there. As a result, the other suitcases didnÂ’t have a neat or convenient place to go.

Cut the Cute: The 2017 Kia Rio grows up

The last time the Kia Rio got a ground-up redesign was for the 2012 model year. That gave the Rio a crisp, modern look, but was also extremely cute-sy. For the 2017 model year, Kia tweaked the Rio with a leaner, meaner look. Relatively speaking, anyway. The South Korean automaker previously released design renderings of the Rio, and now come official photos of the car. Kia claims that much of the styling changes were made to emphasize width inside and out. The headlights are slimmer and more aggressive than the wide-eyed lamps of the previous model, and much of the gently curving sheetmetal has been removed in favor of more flat planes. Not only that, but the new Rio is slightly longer, wider, and shorter than its predecessor. Inside, Kia has spruced things up with what looks like a nicer mix of materials. The most unusual part of the interior is the infotainment system, which Kia describes as "floating." The infotainment system extends up and off the dashboard, a bit like the screen on the Honda Civic. The good news is that Kia kept physical buttons part of the interface. The bad news is that the design looks a bit odd, as some of the buttons extend up with the screen and make it look a little like Kia used a stereo that didn't quite fit in the dash. Kia didn't reveal any other specs on the car, but those details will likely come during the Paris Motor Show. This updated Rio is an important model for Kia, as last year it sold 473,000 units worldwide. While it isn't Kia's biggest seller in the US, it did have a slight increase in sales this year.
