U.S. appeals court preserves $210M Hyundai-Kia fuel economy class settlement

A U.S. appeals court restored a $210 million nationwide class-action settlement for hundreds of thousands of owners of Hyundai Motor Co and Kia Motors Corp vehicles whose fuel economy estimates were inflated. By an 8-3 vote on Thursday, in a case closely watched by class-action lawyers, the 9th U.S. Circuit Court of Appeals in Pasadena, California, said vehicle owners had enough in common to let them settle as a group. It also rejected arguments by owners opposed to the settlement that the claims process was too burdensome, and that lawyers for the class had colluded with the automakers to extract a "sweetheart deal" that undervalued their claims. The case began after the U.S. Environmental Protection Agency found flaws in Hyundai's and Kia's testing procedures, prompting the automakers to lower fuel efficiency estimates for about 900,000 vehicles from the 2011, 2012 and 2013 model years. Lawyers for objecting drivers had no immediate comment. Hyundai said it was grateful for the decision. Kia and its lawyers did not immediately respond to requests for comment. The decision by Circuit Judge Jacqueline Nguyen upheld a settlement approved in June 2015 by U.S. District Judge George Wu in Los Angeles. Wu "made careful findings, which the objectors here largely do not challenge, and which more than support the judgment," Nguyen wrote. The decision reversed a divided three-judge 9th Circuit panel's January 2018 rejection of the settlement and decertification of the class action. That panel said Wu failed to assess whether differences in state laws prevented certification of a nationwide class. It also said used car owners should have been excluded because it was unclear whether they had relied on the South Korean automakers' fuel economy claims. Lawyers had said it would become much harder to obtain nationwide settlements if the panel ruling stood. Nguyen had dissented from the panel ruling. Circuit Judge Sandra Ikuta, who wrote it, dissented on Thursday. Ikuta accused the majority of failing to determine what law should apply to the nationwide class or how the settlement, and thus attorneys' fees, should be valued. "The majority's failure to correct these errors may be beneficial for the class action bar, but it detracts from compliance with Supreme Court precedent," Ikuta wrote. The 9th Circuit covers nine western U.S. states, Guam and the Northern Mariana Islands.

2016 Kia K900 introduces new 3.8-liter V6 base model

Kia has announced a series of updates to its K900 flagship sedan. Some of the enhancements applied to the 2016 model are more significant than others. The biggest news here is the arrival of a new V6 base model. Previously available Stateside only with the V8, the 2016 Kia K900 will now be offered with an all-new 3.8-liter V6 engine option, good for 311 horsepower. That base model still includes navigation, a leather interior, and a panoramic sunroof as standard equipment – just with a smaller engine to move it all. No changes were announced for the 5.0-liter V8, which is quoted at 420 hp. Revised pricing and realigned trim levels place the base Premium V6 model at $49,950, the Luxury V6 at $54,950, and the top-of-the-line Luxury V8 model at $62,850. This compared to $56,350 base MSRP that Kia charged for last year's eight-cylinder model. A $950 destination charge is included in all of those prices. Some stylistic changes have been made to the K900 as well, including new 18-inch wheels for the V6 model (19 for the V8), a new front grille, and updated rear-end styling that includes chrome trim, new exhaust pipes, taillights, and rear bumper. New equipment includes a hands-free trunk lid and optional autonomous braking system, along with a new 9.2-inch infotainment display and a system that can operate the ignition, door locks, and climate control from a remote smartphone app. The arrival of the new K900 (known as the K9 back in Korea) coincides with the emergence of a more substantially updated Cadenza (known domestically as the K7). Along with the refreshed Kia premium sedans, Hyundai is separating its luxury lineup into the new Genesis sub-brand. Between them, the Korean automaker aims to take a larger slice of the pie from the usual upscale suspects from Japan, Europe, and these United States. Will this entry-level model move the needle much further? Melissa McCarthy sent fleeing in the Kia Niro Super Bowl teaser

The Super Bowl is drawing near and with it comes a cavalcade of over-the-top and outrageously expensive mid-game ads. The cult of the commercial has grown so large that 60-second ads are getting 15-second teasers. For Kia's eighth year at the Super Bowl, the Korean automaker will be promoting its new hybrid, the Niro. The company released a new trailer hyping its third-quarter ad slot. The teaser doesn't actually feature the Niro. Instead flag-waving actor Melissa McCarthy is shown screaming and fleeing across a field from some unknown assailant, presumably the Niro's rival, a Toyota Prius, done up like the War Rig from Mad Max Fury Road. Kia promises the game day commercial will trace "a heroic and harrowing journey stretching from the polar ice caps to an arid desert" all while showing why the Niro is a new type of crossover.
