GM being sued over imploding Bosch fuel pumps in Duramax diesel trucks

Texas-based law firm Hilliard Martinez Gonzalez (HMG) this week filed a class-action lawsuit against General Motors over an alleged issue with Bosch CP4 fuel pumps. The suit claims Bosch designed the CP4 pump to work with European diesel fuel, which is thicker than U.S. diesel. When GM installed that pump in the 6.6-liter Duramax engine used from the 2011 to 2016 model years, the lawsuit claims the thinner U.S. fuel didn't provide enough lubrication, allowing air pockets to form in the fuel pump. That, in turn, allegedly let metal rub against metal inside the pump, causing the pump to eventually disintegrate and "send thousands of metal shards into the fuel injection system and every part of the engine." The Detroit News reported on the most recent lawsuit filed in Michigan's Eastern District Court, but the case is another piece of nationwide legal maneuvering going on since at least last September. Every U.S. truck maker used the Bosch CP4 fuel pump, and HMG originally went after all of them, as well as Bosch. On September 30, 2018, HMG filed a class-action suit in Texas on behalf of eight plaintiffs. The law firm wanted to prosecute the affair under RICO — the Racketeer Influenced and Corrupt Organizations Act — and named 10 defendants: FCA US LLC, FCA North America Holdings, LLC, F/K/A Chrysler Group, Fiat Chrysler Automobiles, N.V., Ford Motor Company, General Motors LLC, Robert Bosch GmbH, Robert Bosch LLC, VM North America, Inc., and VM Motori S.P.A.  The firm filed another suit in Florida on Nov. 2, 2018, against the same 10 defendants, again under the RICO statute, this time on behalf of more than 30 plaintiffs. We don't know how many other suits might have been filed, but the two suits mentioned apparently didn't have legs — the courts dismissed both quickly. So HMG shifted its strategy away from the RICO angle, and focused its efforts on GM, filing suit in California on Nov. 20, 2018. Instead of trying to catch 10 fish with a small net, HMG wants to score one fish with a big net. The results have borne more promise for the plaintiffs. In July this year, a judge in California denied GM's motion to dismiss, noting "the alleged defect is central to the vehicleÂ’s function." This latest suit filed on Aug. 6 in Detroit singles out GM again.  The Bosch CP4 is known to be problematic, however.

10 of 18 midsize SUVs earn 'good' IIHS side impact safety rating

It's not terribly surprising that midsize SUVs earned better safety ratings than small SUVs in the latest side-impact tests performed by the Insurance Institute for Highway Safety (IIHS). Just how much better they scored, on the other hand, certainly raises an eyebrow. Ten out of 18 midsize SUVs earned the highest rating of 'good' in the stringent new test, altered for vehicles starting with the 2020 model year with a heavier barrier (4,200 pounds) that moves at a higher speed (37 miles per hour) and is fitted with a hard honeycomb frontal structure. By way of contrast, just one out of of 20 small SUVs earned a 'good' score.  SUVs that receiving 'good' scores were the Ford Explorer, Infiniti QX60, Lincoln Aviator, Mazda CX-9, Nissan Pathfinder, Subaru Ascent, Toyota Highlander, Volkswagen Atlas, Volkswagen Atlas Cross Sport and Volkswagen ID.4. For EV fans, it's worth noting the ID.4 was the only electric vehicle included in the test. The Buick Enclave and Chevrolet Traverse scraped away with 'acceptable' ratings while the Honda Passport, Honda Pilot, Hyundai Palisade, Jeep Wrangler 4-door, Kia Telluride and Nissan Murano were deemed merely 'marginal' in the tough new test. Only two models — the Mazda CX-9 and Volkswagen ID.4 — earned a "Good" rating in every test category.  Interestingly, the Jeep Wrangler would have scored a 'good' rating if it were equipped with side airbags for the rear seating positions. It would likely be an engineering challenge to equip its removable top and/or doors with airbags, but the lack of that safety feature allowed the head of the rear passenger dummy to hit the vertical support of the top. Otherwise, the Wrangler scored good ratings across the board. The new Ford Bronco, which makes more allowances for side-impact safety, has not yet been tested.  The popular Hyundai Palisade and Kia Telluride SUVs stand out in the test with 'poor' ratings for driver pelvis injuries. The Nissan Murano, a vehicle last redesigned for the 2015 model year, was the only vehicle tested that received a 'poor' rating for its structure and safety cage. Aptly-named Hooligans motorcycle gang charged with stealing 150 Jeep Wranglers

Nine members of the Tijuana, Mexico-based Hooligans motorcycle gang are facing federal charges, accused of stealing 150 Jeep Wranglers in San Diego County, then moving them across the border, where they were sold or stripped for parts. "The joy ride is over for these Hooligans," said Deputy U.S. Attorney Mark Conover. "For many of us, our cars are our most valuable possessions," he said. "These arrests have put the brakes on an organization that has victimized neighborhoods in a different way, by stealing something very personal, something that has required a lot of sacrifice to purchase." Conover said the gang also stole dozens of motorcycles. The indictment alleges that the gang used old-fashioned shoe leather, a high-tech device, and a specific Chrysler dealership to pull off the thefts. San Diego County faced a rash of Wrangler thefts in 2014. Conover says most of the Jeeps were stolen in the middle of the night, and most were equipped with alarms, yet no alarm ever went off. Police were perplexed about that until they caught a break. On Sept. 26, 2014, a Jeep was stolen out of a driveway in Rancho Bernardo, where a security camera showed the thieves' method. Based on what they saw in the surveillance footage, officers sent Chrysler a list of 20 Jeeps that had been stolen and asked whether anyone had requested duplicate keys - and sure enough, a duplicate had been issued for all 20 - and all from the same dealership, in Cabo San Lucas, Mexico. The indictment alleges that the Hooligans would case a specific Jeep days ahead of stealing it, and would take down its vehicle identification number. Somehow they managed to obtain the secret key codes that would allow them to request a duplicate key for that particular Jeep. During the theft, the indictment says, the Hooligans would disable the alarms system, program the duplicate key using a handheld device, then simply drive away. The fact that Jeeps' engine bays can be easily accessed because of their external latches made the job even easier. (Authorities recommend Jeep owners purchase aftermarket locking latches.) Three of the gang members have been arrested. One was already in custody when two others were arrested this week, one of them at San Diego's massive San Ysidro border crossing. The six others facing charges are still at large and believed to be in Mexico. Seven are US citizens, while two are from Mexico. The collective value of the thefts is estimated at $4.5 million.
