$40M award for boy's death in Jeep fire upheld by Georgia high court

The Georgia Supreme Court on Thursday unanimously upheld a $40 million award to the family of a 4-year-old boy killed in 2012 when the 1999 Jeep Grand Cherokee in which he was riding was rear-ended and burst into flames. A lower court in 2015 reduced a jury verdict from nearly $150 million to $40 million. Fiat Chrysler spokesman Michael Palese said the company was "disappointed in this decision. We are considering our legal options." The Jeep's fuel tank was placed near the back of the vehicle, which plaintiffs said made it vulnerable to rear-end collisions. The Supreme Court ruling said "evidence showed that Chrysler had long known that mounting a gas tank behind the rear axle was dangerous. Evidence also showed that Chrysler's placement of the gas tank behind the rear axle was contrary to industry trends, which favored placing tanks in front of the rear axle." Fiat Chrysler lawyers said during the trial that the fire did not cause Walden's death and blamed the driver of the pickup truck that hit the vehicle. The company said Thursday it "continues to extend sympathies to the family of Remi Walden for their loss." On appeal, the company contended it was prejudicial to raise Fiat Chrysler Chief Executive Sergio Marchionne's compensation, which totaled more than $68 million, according to a company executive who testified at trial. The automaker had denied there was a safety issue and has said the vehicles were no more dangerous than comparable SUVs built at the time. The National Highway Traffic Safety Administration (NHTSA) linked more than 50 deaths to the Jeep fuel-tank issue. Under government pressure, Fiat Chrysler recalled 1.56 million 2002-07 Jeep Liberty and 1993-2004 Jeep Grand Cherokee SUVs in June 2013 to address fire risks and agreed to install trailer hitches to protect the gas tanks. The recall and a "customer satisfaction campaign" that covered the Jeep in the fatal Georgia crash occurred after Marchionne held private talks with senior U.S. Transportation Department officials in 2013. The Georgia Supreme Court opinion said the award was proper in part because Marchionne was "alleged to have specifically interjected himself in a federal safety investigation to the detriment" of the Walden family. In 2015, NHTSA announced Fiat Chrysler would pay a then-record $105 million civil penalty over lapses in safety recalls involving millions of vehicles, including older Jeep SUVs for fire risks. Are we about to see a real SUV revival?

Now that the marketplace has been oversaturated with cute-utes, crossovers, and CUV coupes, are we about to see a resurgence of real, honest-to-God SUVs? Ummm... maybe. The stars seem to be aligning in that direction, at least that's the sense I'm getting. We know an all-new Jeep Wrangler is only a few auto shows away; and that Jeep is about to introduce a new Grand Cherokee Trailhawk for 2017, in the same rugged spirit of the successful Cherokee and Renegade Trailhawks. Ford has hinted at a neo-Bronco, after showing the concept above in 2014 to wet the mouths of all those Duck Dynasty-types out there. And, and... wait for it... I recently learned that Subaru sent a questionnaire out to some Forester owners asking if they might be interested in an off-road package if it were offered. The items listed were pretty hardcore, serious stuff, such as: integrated tow/recovery hooks, additional ground clearance, more rugged wheels, skid plates, altimeter, front-view off-road camera, improved approach and departure angles, advanced differentials, Inclinometer, full-size spare tire, upgraded off-road suspension components, more aggressive tires, off-road driving mode (engine, transmission, throttle, and steering settings), more rugged styling, low-range gearing, and a more advanced traction management system. Folks that's not my wish list (well, actually it is), but those are words from Subaru, asking if that's what customers would like to see. Need proof? Go to the SubaruForester.org website. So... no promises or guarantees here, and feel free to call me a rumormonger if you like; but the next few years could prove very interesting for those who actually do go off road. 2019 Jeep Cherokee Trailhawk Drivers' Notes Review | Capable, yet costly

The 2019 Jeep Cherokee Trailhawk is the refreshed version of a model that debuted back in 2014. It was a controversial model. Opinions were mixed on the styling — especially the front fascia — and some considered it an insult to the Cherokee name. Still, we liked that version so much we spent a full year with one. It proved to be a solid and reliable crossover that racked up more than 27,000 miles in just 12 months. This refreshed model occupies a strange place in Jeep's lineup. The Cherokee is positioned between both the Compass and Grand Cherokee, though it offers less interior space than either one of those. Pricing on the Cherokee falls right on top of those two models, too, meaning shoppers have to look hard to see what the best fit may be for them. The refreshed styling is certainly less polarizing, though it now means the Cherokee is less distinctive. This Trailhawk model is the midsize Cherokee's most rugged variant. It features a beefed-up suspension, more aggressive rubber, new front and rear bumpers, and an enhanced four-wheel drive system. Despite its car-based platform, the Cherokee Trailhawk is still plenty capable, but there is a price to pay for all that capability. Editor-in-chief Greg Migliore: I would not buy this Cherokee. With a sticker of more than 41 grand, it's too expensive. You can get pretty capable Wranglers and pretty nice Grand Cherokees for this price point. But, if you really love the Cherokee, this decked-out Trailhawk Elite is kinda awesome. You get all of the Trailhawk aesthetics and off-road prowess — you just have to pay for it. The Cherokee is in an interesting spot for Jeep. Even with the 2019 refresh, it's still fairly old, with most of the major elements dating to the 2014 relaunch of the Cherokee model. The Compass is arguably a better deal. It's newer in its lifecycle, starts at a lower price point and offers more cargo volume than the Cherokee. That being said, after rolling around town in the Cherokee for a couple nights, I'd probably buy one before I'd buy a Compass. It feels more substantial and more like a Jeep. I like the design. With the smoked grille and exterior trim, meaty wheels and flared fenders, this one looks especially sharp. Besides, the Compass' cargo volume advantage is less than 2 cubic feet.
