Mahindra vs. FCA case rages on amid confusion from false reports

The Mahindra vs. FCA case is trucking on despite some reports from India that say otherwise. It was widely reported over the weekend that Mahindra had come out on the winning side of the U.S. International Trade Commission's investigation. However, that's not the case, and FCA says it expects a final decision to be made this month. Apparently, the reports used a brief filed by Mahindra that doesn't actually have any bearing on what the final decision in court is. The briefing was rather explicit in its language, but FCA released a similar brief following hearings. We'll list them both for you below. Mahindra: "FCA is contractually barred from pursuing this investigation if Mahindra's vehicles contain or use the approved grille design. The evidence shows that Mahindra's Roxor uses the approved grille design. Thus, the record supports a finding that Mahindra met its burden of proving by a preponderance of the evidence that FCA is contractually barred from pursuing this investigation." FCA: "Mahindra has failed to carry its burden in showing that all of FCA's claims fall under the narrow scope of the 2009 Agreement. The Investigation against Respondents should therefore proceed." These statements represent opinions of both companies, but not actual decisions made by the U.S. ITC. In case you were still wondering, this whole battle is about the Mahindra Roxor's front grille design. FCA says is looks too much like a Jeep, and is worried the Roxor will cut into Wrangler sales. The Mahindra Roxor isn't road-legal, which would make it difficult to steal actual Jeep sales from FCA, and there was also an agreement signed in 2009 between the two companies related to this issue. FCA agreed then not to bring about infringement claims against Mahindra as long as it used a grille design that differs from the classic Jeep trademark grille FCA approved of. One could argue Mahindra's grille is different than Jeep's design because it only has five slats instead of seven, but it sure does look a lot like an old Willys. It will be another month before official word is out on this case, and we'll be following to see whether Mahindra will be allowed to sell its fun, diesel off-roader in the U.S. Related video:

Jeep and Ram diesel owners get $3,075 in lawsuit settlement

Owners of certain Ram 1500 and Jeep Grand Cherokees equipped with diesel engines will get up to $3,075 in compensation for repairs under a settlement of a class-action lawsuit against Fiat Chrysler over illegal emissions-cheating software. The roughly $800 million settlement was first announced in January and approved by a federal judge in California last week, according to Consumer Reports. The affected vehicles are 2014 to 2016 Ram 1500 pickup trucks and Jeep Grand Cherokee SUVs equipped with 3.0-liter EcoDiesel V6 engines. FCA will update the emissions control software, provide an extended warranty covering up to 10 years or 120,000 miles, and provide cash compensation. Eligible owners will get as much as $3,075, while eligible lessees, former lease holders and former owners will get up to $990, and partial owners will get up to $2,460. FCA has established an EcoDiesel Settlement website where affected owners can find more information on how to submit and track a claim and sign up for updates. Customers with questions can also call 833-280-4748. Vehicle owners will have 21 months to submit a claim, with a deadline of Feb. 3, 2021, and two years to complete the repair and receive compensation for it. Former owners and lease holders must submit claims by Aug. 1, 2019. The EPA in early 2017 issued a notice of violation to FCA after Jeep and Ram installed eight emissions control devices on diesel vehicles. FCA's settlement includes $311 million in total civil penalties to U.S. and California regulators, up to $280 million to resolve claims from diesel owners, $105 million in extended warranties, $72.5 million in state civil penalties and $33.5 million in payments to California for excess emissions and to resolve consumer claims. Auto supplier Robert Bosch GmbH, which provided emissions control software, is paying $27.5 million to resolve claims, plus $103.5 million to settle claims with 47 states. The federal court also approved consent decrees between FCA, the EPA and the California Air Resources Board, plus agreements with all 50 stats and the U.S. Customs and Border Protection. In a statement, FCA said, "The settlements contain no findings of wrongdoing, nor admission of any wrongdoing, by FCA US" and added that the software fixes will have no affect on average fuel economy, performance or other characteristics of the vehicles.

Jeep Wrangler by Vilner takes extreme luxury off-road

Vilner turned its customary and intensely luxurious attentions to a two-door Jeep Wrangler Sahara Unlimited back in 2012, following that up this year with its take on the four-door version. A coat of lustrous black paint outside is brightened up LED headlights, foglights and taillights and layers of chrome laid on the grille, mirrors, door handles and fuel filler cap.
Stance gets an injection of brawn from the 20-inch wheels, and they'll roll faster thanks to the power upgrade from 197 horsepower and 339 pound-feet of torque in the 2.8-liter diesel to 257 hp and 412 lb-ft.
