$40M award for boy's death in Jeep fire upheld by Georgia high court

The Georgia Supreme Court on Thursday unanimously upheld a $40 million award to the family of a 4-year-old boy killed in 2012 when the 1999 Jeep Grand Cherokee in which he was riding was rear-ended and burst into flames. A lower court in 2015 reduced a jury verdict from nearly $150 million to $40 million. Fiat Chrysler spokesman Michael Palese said the company was "disappointed in this decision. We are considering our legal options." The Jeep's fuel tank was placed near the back of the vehicle, which plaintiffs said made it vulnerable to rear-end collisions. The Supreme Court ruling said "evidence showed that Chrysler had long known that mounting a gas tank behind the rear axle was dangerous. Evidence also showed that Chrysler's placement of the gas tank behind the rear axle was contrary to industry trends, which favored placing tanks in front of the rear axle." Fiat Chrysler lawyers said during the trial that the fire did not cause Walden's death and blamed the driver of the pickup truck that hit the vehicle. The company said Thursday it "continues to extend sympathies to the family of Remi Walden for their loss." On appeal, the company contended it was prejudicial to raise Fiat Chrysler Chief Executive Sergio Marchionne's compensation, which totaled more than $68 million, according to a company executive who testified at trial. The automaker had denied there was a safety issue and has said the vehicles were no more dangerous than comparable SUVs built at the time. The National Highway Traffic Safety Administration (NHTSA) linked more than 50 deaths to the Jeep fuel-tank issue. Under government pressure, Fiat Chrysler recalled 1.56 million 2002-07 Jeep Liberty and 1993-2004 Jeep Grand Cherokee SUVs in June 2013 to address fire risks and agreed to install trailer hitches to protect the gas tanks. The recall and a "customer satisfaction campaign" that covered the Jeep in the fatal Georgia crash occurred after Marchionne held private talks with senior U.S. Transportation Department officials in 2013. The Georgia Supreme Court opinion said the award was proper in part because Marchionne was "alleged to have specifically interjected himself in a federal safety investigation to the detriment" of the Walden family. In 2015, NHTSA announced Fiat Chrysler would pay a then-record $105 million civil penalty over lapses in safety recalls involving millions of vehicles, including older Jeep SUVs for fire risks. I take this JL thing as a sign from God that I am supposed to finally buy a new Wrangler, the very first car of my dreams when my dreams included saving $25,000 and living off the grid in a one-room log cabin with all of my cast iron pots and pans. I did live in a tiny log cabin once, but when I discovered there was no line for phone, fax and printer, I trudged down the dirt road a half mile, knocked on a stranger's door and borrowed their phone to call AT&T. So much for living off the grid. And so much for the Wrangler. I bought a truck, which was useful, but it was not a Jeep, a fact confirmed when I landed a job writing about cars. Among the Porsches and Fords and Ferraris and Dodge Power Wagons were Jeep Wranglers. Wranglers meant adventure. Here are two favorites:1981 — Delivering the Pig of Bronze, Car and Driver's over-accessorized 1978 project Jeep CJ-7 (named for its chrome hood ornament), to the police chief of rural Waterloo, Neb. He got it because he wrote the editor a letter asking for it. It was my assignment to drive it there. I plotted as many miles of dirt roads as possible between Michigan and Nebraska, not wanting to waste my first big Jeep adventure on pavement and never questioning the ability of this denim-trimmed orange Jeep and its aftermarket aluminum wheels to get us there.So naive. Somewhere in deepest Iowa with the windshield flipped down to the hood for maximum coolness, the Pig's rear end began to shudder. As we rolled to a stop, the photographer looked back in time to see one of the five fancy extra-long chrome lug nuts plop into the dust. Two others had vanished. The last two had backed off to the ends of their studs.

Chrysler recalling 644k more Dodge Durango and Jeep Grand Cherokee SUVs over brakes

Early last month, we reported on Chrysler issuing a preemptive, proactive recall for about 25,000 units of the Jeep Grand Cherokee and Dodge Durango. The issue revolved around a brake system that wasn't causing any actual problems, but delivered an unsatisfactory brake feel, so Auburn Hills called in a good 25,000 of SUVs around the world, including 18,700 in the United States.
Now Chrysler, having apparently determined that the brake problem on its sport utes is actually much bigger than it initially realized, has drastically broadened the scope of the recall. As a result, the National Highway Traffic Safety Administration has issued a recall for precisely 655,354 examples of the Grand Cherokee and Durango, covering the 2011 through 2014 model years. In addition, Chrysler is recalling 42,380 units in Canada, 21,376 in Mexico and 159,685 overseas.
The problem which Chrysler found revolves around the brake booster, whose center shell has been found to be subject to corrosion, allowing water to get into the brake system. That water in turn could freeze, preventing the brakes from working as well as expected.
