Fiat Chrysler to pay $800M in Jeep, Ram emissions cheating case

WASHINGTON — Fiat Chrysler Automobiles NV has agreed to a settlement worth about $800 million to resolve claims from the U.S. Justice Department and state of California that it used illegal software that produced false results on diesel-emissions tests, but still faces an ongoing criminal probe. The hefty penalty is the latest fallout from the U.S. government's stepped-up enforcement of vehicle emissions rules after Volkswagen AG admitted in September 2015 to intentionally evading emissions rules. The Fiat Chrysler settlement includes $311 million in total civil penalties to U.S. and California regulators, up to $280 million to resolve claims from diesel owners, and extended warranties worth $105 million. It covers 104,000 Fiat Chrysler 2014-16 Ram 1500 and Jeep Grand Cherokee diesels, the Justice Department said. Regulators said Fiat Chrysler used "defeat devices" to cheat emissions tests in real-world driving. Fiat Chrysler said in a statement that "the settlements do not change the Company's position that it did not engage in any deliberate scheme to install defeat devices to cheat emissions tests." The company did not admit liability. "You wouldn't pay $311 million total dollars to the federal government in civil penalties if there were not a serious problem," U.S. assistant attorney general Jeff Clark told a news conference. The settlement also includes $72.5 million for state civil penalties, and $33.5 million in payments to California to offset excess emissions and consumer claims. German auto supplier Robert Bosch GmbH, which provided the emissions control software for the vehicles, also agreed to pay $27.5 million to resolve claims from diesel owners. Owners will receive an average of $2,800 to obtain software updates as part of the emissions recall, Fiat Chrysler said. Elizabeth Cabraser, a lawyer for the owners, said the "substantial cash compensation" will ensure that consumers get the recall fix. Bosch, which also provided diesel emissions software to Volkswagen, also agreed to pay $103.5 million to settle claims with 47 U.S. states that said the supplier "enabled" the cheating and should have known its customers would use the software improperly, the New York Attorney General's Office said.

There's an old maxim in off-roading that states, "Four-wheel drive doesn't keep you from getting stuck, it just gets you stuck in worse places." The truth of this statement was perfectly illustrated recently in a YouTube video of a Jeep Wrangler digging its own grave at the beach. On May 11, a YouTuber named Dan M uploaded a video he titled, "Drunk guy doesn't know how to off-road and ruins nice Jeep." The video, shot at dusk on a rocky looking beach, shows a blue Wrangler driving out into the surf without a care in the world. Dan, providing commentary along with an unseen female companion, was impressed with the Jeep driver's dash at first. "Wow, he must do that a lot because he ain't scared of getting stuck or anything," said Dan. As the Wrangler got deeper into the water, the Dan's friend expressed her doubts that the Jeep driver would make it out, especially when the Jeep got snagged on a little spit of sand sticking out into the water. Dan wasn't worried, however. "No, he'll manage to get out of there, he'll make it out of there. He'll back out and get out," he said. Dan's confidence in the Jeep driver was sadly misplaced, unfortunately. The driver managed to get the Jeep stuck on the sand bar then made the rookiest of rookie mistakes–he just gunned it. "Oh man, he's done! He's done!" yelled Dan as the Jeep driver proceeded to dig a huge hole in the sand that sunk the Wrangler up to its frame just as the tide started coming in. With that kind of dunking, especially in salt water, that Wrangler was probably a total loss, much like the Grand Cherokee that got washed downriver last week somewhere in Europe. Chrysler recalls 468,700 Jeep Grand Cherokees, Commanders over rollaway risk

Chrysler has issued a recall covering a combined 469,000 units of the 2005-2010 Jeep Grand Cherokee and the 2006-2010 Jeep Commander (inset). Of that number, 295,000 are in the US, roughly 33,000 in Canada and Mexico and the remainder in other markets. It seems an electrical fault in the transfer case can allow the affected SUVs to shift into neutral on their own, while an Associated Press report says that Chrysler had "found cracks in a circuit board that turns the four-wheel-drive system on and off." The issue was discovered when an owner started his car remotely and it rolled away.
Chrysler is expected to begin notifying owners in June 2013, who can then take their cars to dealers. The dealer will reflash the final drive controller free of charge. There's a bulletin from the National Highway Traffic Safety Administration below with more information.
