Ram and Jeep diesel emissions allegations spur class action lawsuits

This shouldn't come as a surprise. Last week, the EPA issued a notice of violation to FCA after it determined that Jeep and Ram installed eight undisclosed auxiliary emissions control devices on diesel vehicles. Since then US law firm Heninger Garrison Davis, LLC and Canadian firm Sotos LLP have launched class action suits on behalf of owners. These latest lawsuits are unrelated to a previous class action suit brought against FCA and Cummins over NOx emissions in 2007 to 2012 Ram models. The violation notice – and the subsequent lawsuits – covers 2014 to 2016 Jeep Grand Cherokee and Ram 1500 models equipped with the 3.0-liter turbodiesel V6, a total of about 104,000 vehicles in the US. The EPA says that while the emissions control devices aren't necessarily illegal, installing them without disclosing them to the EPA is, as they produce more emissions in real world use than in testing. Skirting certification in this way might be a violation of the Clean Air Act. FCA could see fines of up to $45,000 per vehicle, depending on the outcome of the EPA investigation. FCA denies that these are cheat devices, and has proposed software updates to bring the vehicles into compliance. As for the lawsuits, Heninger Garrison Davis says that "Fiat Chrysler marketed those vehicles as environmentally friendly with enhanced fuel efficiency, better performance, and lower emissions. Although the diesel vehicles were successfully marketed as 'clean,' their environmentally-friendly representations were deceptive to consumers." The suit seeks an undisclosed amount of compensation for owners of these vehicles. In Canada, Sotos LLP is seeking $250 million in damages on behalf of owners. This suit, filed in the Ontario Superior Court of Justice, also claims deception on the part of FCA, "resulting in losses and damage" to owners. These are similar claims to group actions against Volkswagen with regard to its diesel emissions cheating scandal. While VW is fixing or buying back many of the affected vehicles, the company is defending itself against some suits on behalf of owners, saying it expects " no decline in the residual values of the affected vehicles as a result of this issue." Don't be surprised if FCA mounts a similar defense.

EPA posts 2018 Jeep Wrangler Unlimited fuel economy

When Jeep loosed a trio of 2018 Wrangler photos in October, Jeep cognoscenti parried over details like radio antenna placement and painted tailgate hinges, while every other viewer merely noted, "It's still a Wrangler." Now that the Environmental Protection Agency's listed fuel economy ratings for the 2018 Wrangler Unlimited with the 3.6-liter V6, Jeep savants will again parry over details. Every other viewer will merely note, "It's still got Wrangler gas mileage." According to the EPA, the current Wrangler Unlimited with the 3.6-liter V6 and six-speed manual clocks 16 miles per gallon in the city, 21 on the highway, and 18 combined. The 2018 version with the same six-speed manual comes in at 17/23/19. Switching transmissions, the current model with the five-speed automatic hooks up 16/20/18, the 2018 model with an eight-speed automatic does 18/23/20. Those numbers might not jump off the page, yet according to the EPA's cost calculator, you'll save $250 per year on gas with the eight-speed auto 2018 Wrangler Unlimited, $150 per year with the coming six-speed manual. The eight-speed auto option also exceeds Chrysler's prediction from 2014 of a nine-percent improvement in fuel economy over the five-speed auto. Now we wait for numbers on the dark horse four-cylinder, which we'd expect to best the sixer's numbers, unless the rumors are true and the four-pot really is packing every wild horse it can handle. FCA recalls 894k total vehicles worldwide in two campaigns

FCA is recalling a total of 893,698 vehicles worldwide in two campaigns to fix problems with inadvertent airbag deployment, failure of the anti-lock brakes, and stability control systems in the Jeep Grand Cherokee, Liberty, Dodge Journey, and Fiat Freemont. 559,703 of these vehicles are in the US. The larger recall affects 284,089 examples of the 2003 Jeep Liberty and 2004 Jeep Grand Cherokee, and there are also 13,411 of them in Canada, 6,277 in Mexico, and 48,212 outside the NAFTA region. Because of "electrical noise beyond the tolerance of the airbag electronic control module", part of that component can fail, according to the National Highway Traffic Safety Administration. This can cause the front and side airbags to deploy and the seatbelt pre-tensioners to activate inadvertently. FCA US has seven reports of alleged injuries from this problem. To fix the situation, the Jeeps need their Occupant Restraint Control modules replaced, as well as the front- and side-impact sensors. According to the NHTSA, the replacement parts won't be available until early 2016. Still, FCA US will advise owners about the problem in a letter by the end of December and will send a second notification when the components are ready. The second campaign affects 275,614 examples of the 2012-2015 Dodge Journey in the US; plus 78,148 of them in Canada, 36,471 in Mexico, and 151,476 left-hand drive units outside of NAFTA where it's sold as the Fiat Freemont. On these vehicles, water intrusion can disable the anti-lock brakes and electronic stability control, although a warning light often illuminates when this issue occurs, and the problem doesn't affect regular braking. There are also no reports of injuries or accidents. To fix the issue, dealers will seal the ABS wiring harness and will replace any already affected components as necessary, like the ABS module or the headlamp and dashboard wiring harness. Within this vehicle population, FCA US became aware of seven injuries caused by inadvertent air-bag deployments and advised NHTSA accordingly. The affected vehicles are not equipped with Takata Corp. air-bags. The Company is unaware of any related accidents.
