Mahindra fights FCA's Jeep infringement claims
Wed, Aug 29 2018The Indian manufacturer Mahindra is fighting tooth and nail to keep building its Roxor off-road vehicle to sell in the United States. In early August, Jeep mother company FCA filed a complaint with the U.S. International Trade Commission to stop Roxor sales in the U.S. FCA claims the Roxor design is an intellectual property infringement on Jeep design, meant to undercut FCA's own Jeep products on the market. Now Mahindra has released a statement to the commission saying that FCA's complaint is without merit. While FCA stated in its claim that the Roxor is "an imported low-quality knock-off kit car," Mahindra points out that the vehicle took several years to develop and is manufactured in Michigan. Mahindra intends the Roxor to be an off-road vehicle only, and says it does not compete with Jeeps. The Roxor isn't road legal, only comes with a diesel engine and reaches a top speed of only 45 mph. However, it has to be said that the uncomplicated Roxor is far closer to the original ethos of WWII-era Jeeps than the Jeeps FCA currently manufactures. Mahindra also states that FCA agreed in 2009 not to bring about infringement claims as long as Mahindra used a grille design that FCA approved — going with a grille design that clearly differs from the classic Jeep trademark grille. The matter might partially muddled by the fact that the grille agreement was made with 2009's Chrysler instead of today's FCA. Looking back several decades, the entire Mahindra Roxor appearance is at its core based on a 1940s license agreement made with Willys, the original Jeep manufacturer. Mahindra's statement addresses FCA as "Fiat," and it should not be forgotten that Fiat itself manufactured a Jeep lookalike, the Campagnola, from 1951 to 1973 — also with a different grille. Fiat Industrial subsidiary Iveco's history page says the 1951 Campagnola was constructed "according to the Willys mould". Mahindra claims that FCA is using the complaint to create negative publicity to damage Mahindra's reputation. The Indian manufacturer reminds us that it is the first automotive OEM to set up a new manufacturing operation in southeast Michigan in over 25 years — in Auburn Hills, not far from FCA's U.S. headquarters. FCA to appeal reduced judgment in Georgia Jeep case
Thu, Aug 13 2015FCA is appealing the $40 million verdict against it in a case in Georgia where a four-year-old boy died in a fire in a Jeep Grand Cherokee, according to The Detroit News. The jury originally awarded the child's family $150 million, but the judge decided to significantly to reduce the amount based on other precedents. The automaker has been considering further legal options since the decision was announced in July. The boy's death happened in 2012 when he was riding in a Grand Cherokee. The vehicle was rear-ended, and the fuel tank burst, causing a fire. This is the same issue that led to a recall of millions of the SUVs and a recent agreement with the US government from FCA to pay to get them fixed. In the original ruling, the jury said that the automaker was 99 percent responsible for the fatality and didn't adequately warn owners. It asked the company to pay $120 million for wrongful death and $30 million for his pain and suffering. FCA countered that the Jeeps met the safety standards of the time they were made. FCA requested that the jury's award be reduced in May calling the amount "grossly excessive." If the family didn't agree to a lower amount, the company also threatened to seek a new trial. Among the arguments was that $30 million was too much for the child's one minute of suffering. The parents did accept the judge's adjusted figure, though.

Advertisements starring the Oscar winner launched in September, and the results have been impressive. The number of customers clicking on Lincoln.com to check out the MKC – the crossover McConaughey pitched – has tripled since the ads began airing, a spokesman told Autoblog. They also generated 4.4 million views on YouTube and spawned parodies by Ellen DeGeneres, Conan O'Brien, South Park and Jim Carrey on Saturday Night Live, which racked up another 15 million views. Most importantly, Lincoln's sales have increased 15 percent through November, helped significantly by the strong launch of the MKC. Without the addition of the MKC, Lincoln's sales would have been essentially flat last year. The MKC has received solid reviews from consumers and the press, though it has had several recalls. "The overwhelming response to the MKC campaign sparked truly great awareness for Lincoln," Andrew Frick, Lincoln group marketing manager, said in a statement. Now Lincoln has launched another round of spots, which kicked off New Year's Day during college football bowl games. This time, McConaughey is hawking the MKZ sedan and its hybrid sibling. The spots, called Diner and Balance, use the same artistic formula as the earlier ads, with McConaughey intoning seriously about the cars in dramatic settings. They were shot over two days in Los Angeles and were directed by Nicolas Winding Refn, a Danish filmmaker who directed the 2011 move, Drive. The ads continue Lincoln's multiyear deal with McConaughey, who has said he's been long been interested in the brand. He starred in the 2011 thriller, The Lincoln Lawyer, as a defense attorney who worked out of a Town Car, though that was before his deal with Lincoln. In one of the earlier ads, McConaughey claims: "I've been driving a Lincoln since long before anybody paid me to drive one. I didn't do it to be cool. I didn't to it to make a statement. I just liked it." That sentiment appears to have worked for the MKC's launch, and with this new advertising blitz, Lincoln hopes it carries over to the MKZ.
