EU finds Jeep Grand Cherokee and Suzuki Vitara break emissions rules

AMSTERDAM — Fiat Chrysler's Jeep Grand Cherokee and Suzuki's Vitara diesel models both break emissions rules and must be fixed or face a ban on sales across Europe, the Dutch road authority ruled on Thursday. The RDW authority, acting as the reference regulator for across the European Union, said Jeep had developed a software fix and that the authority had ordered the company to recall the model across Europe to roll it out. It added Suzuki had yet to find a credible solution for the Vitara. "Suzuki must come with adequate improvement measures or the RDW will begin the process of revoking its European type approval," the RDW said in a statement, adding it had also started the process of revoking approval for the Jeep Grand Cherokee as a "precautionary measure." Regulators across the world have been testing diesel models since Volkswagen admitted in 2015 that it used illegal software to cheat U.S. emissions tests. The RDW said it had found both the Jeep Grand Cherokee and Vitara had used "prohibited emissions strategies" that led them to emit higher levels of harmful nitrogen oxide (NOx) on the road than under testing conditions. Dutch State Secretary for Infrastructure, Stientje van Veldhoven, said in a letter to parliament she would inform prosecutors of the RDW's findings. CEO Sergio Marchionne curses FCA spokesman for emissions cheating denial

WASHINGTON — Fiat Chrysler Chief Executive Officer Sergio Marchionne reprimanded the company's top U.S. spokesman for issuing press releases about Fiat's vehicle emissions practices days after Volkswagen's disclosure in September 2015 that the German automaker had used illegal software to evade emissions tests, documents released Monday show. Lawyers suing Fiat Chrysler Automobiles in a securities case filed excerpts of an email from Marchionne to Gualberto Ranieri, then the company's U.S. spokesman, in a filing in federal court in New York criticizing him for saying that the company does not use defeat devices. "Are you out of your goddam mind?" Marchionne wrote in an email on Sept. 22, 2015, adding that Ranieri should be fired and calling his actions "utterly stupid and unconscionable." The company said in a statement on Monday it was "understandable that our CEO would have a forceful response to any employee who would opine on such a significant and complex matter, without the matter having been fully reviewed through its appropriate channels." The statement added that Ranieri's comments came just days after VW's emissions issue became public "and before a comprehensive internal review and discussions with component suppliers was possible." Fiat Chrysler was sued in 2015 along with Marchionne and other executives over claims it defrauded shareholders by overstating its ability to comply with vehicle safety laws. An amended version of the complaint filed in 2017 added claims about its compliance with emissions laws. The shareholders accused the defendants of inflating Fiat Chrysler's share price by hundreds of millions of dollars from October 2014 to October 2015 by downplaying safety concerns. They said the shortcomings materialized in 2015 when the automaker was fined $175 million by the National Highway Traffic Safety Administration, and took a roughly $670 million charge for recalls. Plaintiffs filed the excerpts seeking approval to take up to 40 additional depositions, including Marchionne's. The U.S. Justice Department sued Fiat Chrysler in May 2017, accusing it of illegally using software to bypass emission controls in 104,000 diesel vehicles sold since 2014. Fiat Chrysler has held numerous rounds of settlement talks with the Justice Department and California Air Resources Board to settle the civil suit, including talks as recently as earlier this month. It faces a separate criminal probe into the matter.

Updated 2014 Jeep Grand Cherokee ace same controversial moose test it failed in 2012 [w/video]

Some background: one of the more scandalous international incidents of he-said/he-said from 2012 was when Swedish magazine Teknikens Varld put the Jeep Grand Cherokee through its "moose (or elk) test" and reported that the SUV nearly rolled over. That lead to a whole lot of accusations and rebuttals: more than one website and Chrysler's own blog reported that the Jeep was overloaded; Chrysler said Teknikens printed the magazine then let Chrysler respond, Teknikens answered all of the charges in a lengthy post and said Chrysler was given a chance to comment before it went to print; when Chrysler sent investigators to oversee the test and the Jeep didn't go up on two wheels as it did in the first test, furthermore all four wheels stayed on the ground when Auto Motor und Sport tested a Grand Cherokee in the same way.
Teknikens then re-ran the test with a new vehicle and said it's been doing this test since the 1970s, uses the loading information that Chrysler provides to the Swedish motor authority and the previous Grand Cherokee passed with no problem. In the second test, the Jeep failed again, then it gave Chrysler engineers access to the car's electronics and ran the test again. In that second round the Grand Cherokee didn't repeat the lurid two-wheel action, but in eleven runs it blew out front left tire seven times. Chrysler still objects to the results of all of those tests and maintains that vehicle was safe.
The 2014 Grand Cherokee was given its shot at the gauntlet in the latest round of moose tests, and Teknikens Varld reports that it passed without any problem at all, its stability control working perfectly, controlling motion at low speeds and all the way up to 44.1 miles per hour.
