$40M award for boy's death in Jeep fire upheld by Georgia high court

The Georgia Supreme Court on Thursday unanimously upheld a $40 million award to the family of a 4-year-old boy killed in 2012 when the 1999 Jeep Grand Cherokee in which he was riding was rear-ended and burst into flames. A lower court in 2015 reduced a jury verdict from nearly $150 million to $40 million. Fiat Chrysler spokesman Michael Palese said the company was "disappointed in this decision. We are considering our legal options." The Jeep's fuel tank was placed near the back of the vehicle, which plaintiffs said made it vulnerable to rear-end collisions. The Supreme Court ruling said "evidence showed that Chrysler had long known that mounting a gas tank behind the rear axle was dangerous. Evidence also showed that Chrysler's placement of the gas tank behind the rear axle was contrary to industry trends, which favored placing tanks in front of the rear axle." Fiat Chrysler lawyers said during the trial that the fire did not cause Walden's death and blamed the driver of the pickup truck that hit the vehicle. The company said Thursday it "continues to extend sympathies to the family of Remi Walden for their loss." On appeal, the company contended it was prejudicial to raise Fiat Chrysler Chief Executive Sergio Marchionne's compensation, which totaled more than $68 million, according to a company executive who testified at trial. The automaker had denied there was a safety issue and has said the vehicles were no more dangerous than comparable SUVs built at the time. The National Highway Traffic Safety Administration (NHTSA) linked more than 50 deaths to the Jeep fuel-tank issue. Under government pressure, Fiat Chrysler recalled 1.56 million 2002-07 Jeep Liberty and 1993-2004 Jeep Grand Cherokee SUVs in June 2013 to address fire risks and agreed to install trailer hitches to protect the gas tanks. The recall and a "customer satisfaction campaign" that covered the Jeep in the fatal Georgia crash occurred after Marchionne held private talks with senior U.S. Transportation Department officials in 2013. The Georgia Supreme Court opinion said the award was proper in part because Marchionne was "alleged to have specifically interjected himself in a federal safety investigation to the detriment" of the Walden family. In 2015, NHTSA announced Fiat Chrysler would pay a then-record $105 million civil penalty over lapses in safety recalls involving millions of vehicles, including older Jeep SUVs for fire risks. 2019 Jeep Cherokee reveals a much more normal face

Since we started seeing redesigned Jeep Cherokee prototypes, we've suspected that the crossover would lose its controversial split headlights and pointy grille. Finally, we get a good look at a mostly uncovered test car, and it confirms that the new Cherokee will look quite conventional. The obvious change is the headlights. Instead of the slender daytime running lights at the top next to the grille, and the actual illuminating headlights lower in the bumper, all of the elements are integrated into single housings on either side. They're somewhat rectangular now, looking more like those on the Compass and the Grand Cherokee. But you can still see the same hockey-stick shaped LED running light design in the new lamps. The grille has changed, too. It looks much more blunt than the sharply creased, almost pointy grille of the current model. It also looks as though it may extend farther down than the current version. The rest of the Cherokee is very similar to the current model. The flanks are virtually unchanged, as is the interior, and the tail sees only minor changes. The most significant is the move of the license plate from the bumper to the hatch. The taillights' shape hasn't really changed, but the white section is now broken up by black lines, and the red element looks darker. We expect to see the Cherokee refresh soon, possibly by the end of the year. Related Video:

FCA to recall nearly 900,000 vehicles that don't meet emissions standards

WASHINGTON — Fiat Chrysler Automobiles will recall 862,520 gasoline-powered vehicles in the United States that do not meet U.S. emissions standards, the Environmental Protection Agency said on Wednesday. The recall was prompted by in-use emissions investigations conducted by the EPA and in-use testing conducted by Fiat Chrysler as required by U.S. regulations, the agency said. EPA said it will continue to investigate other Fiat Chrysler vehicles that are potentially noncompliant and may become the subject of future recalls. The recall includes 2011-2016 Dodge Journeys, 2011-2014 Chrysler 200s and Dodge Avengers, 2011-2012 Dodge Calibers and 2011-2016 Jeep Compass/Patriots. Fiat Chrysler said in a statement the EPA announcement "has no safety implications. Nor are there any associated fines." "The issue was discovered by FCA during routine in-use emissions testing and reported to the agency," the company said. "We began contacting affected customers last month to advise them of the needed repairs, which will be provided at no charge." Its U.S.-traded shares were down 1 percent. "EPA welcomes the action by Fiat Chrysler to voluntarily recall its vehicles that do not meet U.S. emissions standards," EPA Administrator Andrew Wheeler said in a statement. "We will provide assistance to consumers navigating the recall and continue to ensure that auto manufacturers abide by our nation's laws designed to protect human health and the environment." Fiat Chrysler owners can continue to drive their vehicles, the government said. Due to the "large number of vehicles involved and the need to supply replacement components — specifically to the vehicle's catalytic converter — this recall will be implemented in phases during the 2019," the EPA said In January, Fiat Chrysler agreed to a settlement worth about $800 million to resolve claims by the U.S. Justice Department and state of California that it used illegal software to produce false results on Ran and Jeep vehicles. But that incident involved diesel engines. It is awaiting the outcome of a criminal probe. The hefty penalty was the latest fallout from the U.S. government's stepped-up enforcement of vehicle emissions rules after Volkswagen AG admitted in September 2015 to intentionally evading emissions rules.
