FCA seeking new trial in Jeep fire case, calls $150M judgement 'grossly excessive'

Fiat Chrysler Automobiles is fighting back after a Decatur County, GA jury ordered the company to pay $150 million to the family of a four-year-old boy that was killed after a 1999 Jeep Grand Cherokee crashed and caught fire. The company is requesting the judge reduce the award, and should Walden's family not agree to the lower sum, that a new trial be held. The Detroit Free Press reports that FCA would be forced to pay $120 million over the death of young Remington Walden, with an extra $30 million being paid to the boy's family. Neither figure sits well with the automaker, though, which called the fine "grossly excessive," and claimed it was in violation of Georgia state law. The judgment stems from FCA's long-running problem with the fuel tanks of certain Jeep models built in the 1990s and 2000s. According to the newspaper, FCA argues that the jury was biased after the Waldens' attorneys played on the their passions and pushed for a big award, saying the wrongful death award was 11 times more than any appeals court has ever upheld. FCA said attorneys for the plaintiffs told the jury to base the settlement on Sergio Marchionne's total compensation, $68 million. FCA also claims in its motion that the young boy's suffering was brief. "A $30-million pain-and-suffering award for what plaintiffs acknowledge was at most one minute of suffering is irrational," the motion, which was obtained by The Detroit Free Press, read. "Where such plainly improper arguments are immediately followed by irrational and stunningly excessive damage awards, there can be no doubt that the jury acted from passion and prejudice." Jim Butler, the attorney for the Waldens, has called the motion "nonsense," although he said the family will accept whatever figure the judge sets.

Federal grand jury issues subpoenas to U.S. FCA dealers

Despite an attempt to clarify and backtrack, it seems the investigation into Fiat Chrysler Automobile's false sales reporting is picking up steam. According to Automotive News, FCA dealers and regional offices have received subpoenas ordering them to supply documents and testimony to a grand jury in Detroit. Of course, the dealers are objecting to the request. They claim the subpoenas are too broad and would require them to hand over too much personal information, like personal phone numbers of dealer employees going back years. The group wants to make it clear that FCA has clarified its sales reporting and that the issue is with the manufacturer, not dealers. The dealers say that FCA employee records and testimony should be enough. It's rumored that a dealer group is the one that sparked the investigation in the first place. FCA confirmed on July 18 that it indeed was under investigation by a number of federal agencies. FCA believes thieves aren't getting into Jeeps with laptops

Last week, we reported on an incident where thieves stole a 2010 Jeep Wrangler from an owner's driveway in Houston, TX with nothing but a laptop. While the security footage made it seem like the perpetrator hacked into the vehicle, we had a conversation with FCA's senior manager of security architecture Titus Melnyk who set the record straight. According to Melnyk, the thief in the video isn't using the laptop to get into the vehicle, but rather as a means of coding a blank key fob and then using that fob to get into the Jeep. According to Melnyk, the suspects have gained access to a key programming tool, which allows them to pair blank key fobs to FCA vehicles. With the key fob now coded, the suspects can get into the vehicle and drive away. The thieves, believes Melnyk, have acquired the programming tool through a dishonest dealership or locksmith. Since the suspects are using a process designed to be used (honestly) by dealers, FCA doesn't consider this to be hacking and believes that there are no security flaws in the vehicles. How are the thieves getting key fobs? While Melnyk believes it is possible to recode an existing key fob, he points out that it's much easier to purchase a blank key fob on Ebay for less than $25.
