Prosecutors indict three FCA employees in alleged emissions-cheating case

Federal prosecutors indicted three Fiat Chrysler Automobiles (FCA, now Stellantis) employees as part of an investigation into alleged emissions cheating. Charges unsealed on April 20, 2021, accuse the defendants of helping rig the emissions control system fitted to the 3.0-liter turbodiesel V6 used in some models during the 2010s. Prosecutors claim Emanuele Palma, Sergio Pasini, and Gianluca Sabbioni played a determining role in developing a defeat device that allowed the V6 to obtain certification from the Environmental Protection Agency (EPA) while polluting too much in normal driving conditions. Jeep and Ram began making the engine available in the Grand Cherokee and the 1500, respectively, in 2014, but the charges state plans to game the EPA started in 2011. Palma, Pasini, and Sabbioni knowingly mislead federal regulators, the charges claim; they called it "cycle beating," according to The Detroit News. While the three men were part of FCA's research and development department, they started the project while working for an Italian supplier named VM Motori, which FCA purchased in 2013. Pasini and Sabbioni are each charged with one count of conspiracy to defraud the United States and to violate the Clean Air Act, one count of conspiracy to commit wire fraud, and six counts of violating the Clean Air Act. They could spend several years behind bars if they're found guilty. Both are currently in their home country of Italy. Palma's legal troubles are more serious. He was charged with several counts in September 2019, though four wire fraud charges were dropped in November 2020. He lives in Bloomfield Hills, a city located on the far outskirts of Detroit. Prosecutors claim motorists spent over $4 billion on over 100,000 trucks and SUVs fitted with the non-compliant engine between January 2013 and September 2017. FCA has already agreed to pay $800 million to resolve civil claims from the Justice Department, state officials and customers, though it significantly has not admitted guilt. It stressed that "it did not engage in any deliberate scheme to install defeat devices to cheat emissions tests."

Researchers who busted VW cheating say FCA's diesels dirty, too

The Wall Street Journal today reported on an upcoming report from West Virginia University's Center for Alternative Fuels Engines and Emissions, which is the same lab that investigated Volkswagen emissions cheating. The report, which will be released in a matter of weeks, alleges that 2014 and 2015 model year Jeep and Ram vehicles with diesel engines emit excess pollution. But it does not specify whether the company used defeat devices. Since the report discusses Jeep Grand Cherokees, and that engine is also available in the Ram 1500, it's safe to assume that one of the implicated engines is the EcoDiesel V6, a unit actually produced by VM Motori. It's unclear whether the report covers any of the Cummins engines used in heavier-duty Ram pickups. This report comes on the heels of a federal investigation into FCA's diesel vehicles. That investigation focused on the EcoDiesel engine used in 2014-2016 vehicles. The feds were seeking a fine of up to $4.6 billion. The EPA and the State of California also previously accused FCA of using a defeat device on the same vehicles back in January. FCA, for its part, alleges that the WVU study might have been commissioned by people interested in suing the company, and disputes the testing methodology, according to the WSJ. VIDEO TRANSCRIPT Hi, I'm Adam Morath for Autoblog. Now, undoubtedly, one of the coolest things about this job is that you're in and out of so many different vehicles, but, I'll be honest, there are times where, if you're in very similar vehicles, they can start to run together a little bit. That's why I love getting into a car like this that just snaps you right out of it because it's so unique and so different from anything else on the market. Of course I'm talking about the Jeep Wrangler. I'm in a 2015 Jeep Wrangler Unlimited. This is the X Edition, which stands for X Games. Jeep is a big title sponsor of the 2015 Aspen X Games and you can see that all over this vehicle. You have white, glossy accent plastic in the interior; mountain graphics throughout the interior and exterior of the vehicle – a nod, obviously, to the winter sports and skiing that you would do out in Aspen. And then in keeping with that mountainous theme, you have an Alpine nine-stereo speaker system. I'll be honest, though, that some of it feels a little overdone to me. For instance, there's a power-bulge in the hood. Credit to Jeep: the vents are actually functional, but this is not the trim I would go for, just personally. It's one of those vehicles that people are always wondering, "I really like the look of it [and] I like the capability, but could I live with a Wrangler?" It's the same sort of question you'll get from people who are looking at a sports car, "could I actually live with this is my daily driver?" And I have to say, Jeep has come a long way – Wrangler, in particular, has come a long way – in terms of driving comfort. Of course, don't expect "Lexus quiet." You can probably hear it's a big noisy in the cabin. It's a bit of a bumpy ride. There are things about this vehicle that I could see being annoying in your day-to-day life. For instance, the door: it's essentially an external hinge on the door, but it doesn't stay open for you. So, if you're on any sort of a tilt, the door will come back in and you have to just prop it open with your leg. Little things like that.
