FCA to appeal reduced judgment in Georgia Jeep case

FCA is appealing the $40 million verdict against it in a case in Georgia where a four-year-old boy died in a fire in a Jeep Grand Cherokee, according to The Detroit News. The jury originally awarded the child's family $150 million, but the judge decided to significantly to reduce the amount based on other precedents. The automaker has been considering further legal options since the decision was announced in July. The boy's death happened in 2012 when he was riding in a Grand Cherokee. The vehicle was rear-ended, and the fuel tank burst, causing a fire. This is the same issue that led to a recall of millions of the SUVs and a recent agreement with the US government from FCA to pay to get them fixed. In the original ruling, the jury said that the automaker was 99 percent responsible for the fatality and didn't adequately warn owners. It asked the company to pay $120 million for wrongful death and $30 million for his pain and suffering. FCA countered that the Jeeps met the safety standards of the time they were made. FCA requested that the jury's award be reduced in May calling the amount "grossly excessive." If the family didn't agree to a lower amount, the company also threatened to seek a new trial. Among the arguments was that $30 million was too much for the child's one minute of suffering. The parents did accept the judge's adjusted figure, though.

NYIAS: 2017 Jeep Grand Cherokee Trailhawk, ooh-rah!

I was very happy to see Jeep offer a stand-alone, off-road-oriented model to the Grand Cherokee for 2017, the Trailhawk. This is not the first time for a GC Trailhawk, as they offered a limited run a few years ago to see if there might be a market for such a model. Looks like there is, as there are Trailhawk models for the Cherokee and Renegade, and now the Grand Cherokee as well. Just to be clear here, Jeep has always offered off-road ready packages (tow hooks, one inch more ground clearance, skid plates) for the Grand Cherokee and Cherokee in the past. They were called "Up Country," or more recently, "Off Road" groups. That was all well and good but, at least where I was living, almost impossible to find. Rarely would you ever find one so-equipped on dealer lots. If you ever saw one on the street, most likely the owner special-ordered it. Having said that, now that I'm living by the beach, I am seeing a few Up Country-equipped older Jeeps; not many, but more than I've seen in the past. As to the new Cherokee and Renegade Trailhawks; I'm seeing a bunch of them. It took a little while for the public to discover this trim level, but now I see them everywhere. Must be the orange tow hooks? Speaking of orange tow hooks... I'm not a big fan of them. Tow hooks for sure, orange ones, not so much; same with the matte black hood decal, not a fan. If I were ever to get a Trailhawk, it would be either dark gray or black, as that effectively hides the hood decal. So Jeep has packaged the Trailhawk as a premium model within each respective model line. While I fully understand the thinking, I do wish Jeep would also offer an entry-level off-road model, one with all the Trailhawk off-road goodness, but minus all the visual and luxury fluff. A lot of off-roaders don't want to pay, or can't pay top dollar for stuff they don't want or need. As to a name, how about "Trail," that being Trailhawk minus the "hawk;" or perhaps "Pioneer?" That's an old name from Cherokees of yesteryear. Back then the Pioneer was positioned as a mid-low level model. I think either name would work well for a back-to-basics-off-road-focused Cherokee and/or Renegade. Content it like the current entry-level Sport or mid-level Latitude models, but include the Trailhawk's off-road prowess. GM being sued over imploding Bosch fuel pumps in Duramax diesel trucks

Texas-based law firm Hilliard Martinez Gonzalez (HMG) this week filed a class-action lawsuit against General Motors over an alleged issue with Bosch CP4 fuel pumps. The suit claims Bosch designed the CP4 pump to work with European diesel fuel, which is thicker than U.S. diesel. When GM installed that pump in the 6.6-liter Duramax engine used from the 2011 to 2016 model years, the lawsuit claims the thinner U.S. fuel didn't provide enough lubrication, allowing air pockets to form in the fuel pump. That, in turn, allegedly let metal rub against metal inside the pump, causing the pump to eventually disintegrate and "send thousands of metal shards into the fuel injection system and every part of the engine." The Detroit News reported on the most recent lawsuit filed in Michigan's Eastern District Court, but the case is another piece of nationwide legal maneuvering going on since at least last September. Every U.S. truck maker used the Bosch CP4 fuel pump, and HMG originally went after all of them, as well as Bosch. On September 30, 2018, HMG filed a class-action suit in Texas on behalf of eight plaintiffs. The law firm wanted to prosecute the affair under RICO — the Racketeer Influenced and Corrupt Organizations Act — and named 10 defendants: FCA US LLC, FCA North America Holdings, LLC, F/K/A Chrysler Group, Fiat Chrysler Automobiles, N.V., Ford Motor Company, General Motors LLC, Robert Bosch GmbH, Robert Bosch LLC, VM North America, Inc., and VM Motori S.P.A.  The firm filed another suit in Florida on Nov. 2, 2018, against the same 10 defendants, again under the RICO statute, this time on behalf of more than 30 plaintiffs. We don't know how many other suits might have been filed, but the two suits mentioned apparently didn't have legs — the courts dismissed both quickly. So HMG shifted its strategy away from the RICO angle, and focused its efforts on GM, filing suit in California on Nov. 20, 2018. Instead of trying to catch 10 fish with a small net, HMG wants to score one fish with a big net. The results have borne more promise for the plaintiffs. In July this year, a judge in California denied GM's motion to dismiss, noting "the alleged defect is central to the vehicleÂ’s function." This latest suit filed on Aug. 6 in Detroit singles out GM again.  The Bosch CP4 is known to be problematic, however.
