FCA facing class-action lawsuit over Grand Cherokee shifters

Fiat Chrysler Automobiles is now facing a multi-million-dollar class-action lawsuit over the recalled shifter design in the 2014 and 2015 Jeep Grand Cherokee, and the 2012 to 2014 Dodge Charger and Chrysler 300. Grand Cherokee owners, galvanized by Star Trek actor Anton Yelchin's fatal accident, filed the suit. According to The Wall Street Journal, the owners allege that FCA concealed the shifter's problems. On top of restitution, the class action suit is demanding a court order force FCA to issue a do-not-drive warning to owners of affected vehicles until it fixes the problem. FCA started distributing a software fix to dealers last week – according to the WSJ, the update will add more warnings about the shifter's position and will automatically kick the vehicle into park if the driver steps out. FCA's shifter problems have been bubbling under the surface as part of the company's recall issues. The US government dinged FCA with a $105 million fine last year for its recall practices (or lack thereof) last year, but things have exploded this week after Yelchin's death. The 27-year-old, best known for playing Ensign Pavel Chekov in the rebooted Star Trek film series, was killed after his 2015 Grand Cherokee rolled down his driveway and pinned the actor against a security gate. According to Jeep CEO Mike Manley, the company will dispatch engineers to analyze Yelchin's vehicle. Related Video:

Jeep 'trailer hitch' recall repair rates lag amidst reports of new death

The problem with exploding fuel tanks in the 1993-1998 Jeep Grand Cherokee and 2002-2007 Jeep Liberty in some rear collisions continues to be a problem for FCA US, formerly Chrysler. The campaign to fix the utility vehicles was first announced in June 2013 after 51 claimed fatalities, and the fixes reportedly began in January 2014. However, there continue to be new deaths blaming the problem in unrepaired models, according to The Detroit News, citing data from the Center for Auto Safety. The automaker initially refused NHTSA's pressuring to conduct a recall because the models met applicable crash standards when they were manufactured, but eventually, there was a compromise to inspect and fix about 1.56 million Jeeps. With the fuel tank located between the rear axle and bumper, the unusual fix was to install a trailer hitch for extra protection. The National Highway Traffic Safety Administration later agreed that the change would provide added safety in lower to medium speed crashes, but not high-speed crashes. The most recent fatality, according to The Detroit News, occurred on a Michigan freeway in November 2014 when a pregnant woman in a 2003 Liberty was rear-ended when traffic slowed. Her Jeep impacted the vehicle in front, rolled over and a fire resulted. The family reportedly plans to file a lawsuit against FCA. At issue has been the rate at which the vehicles are being fixed. In July 2014, the automaker estimated it could have all of the vehicles repaired by March 2015 thanks to additional hitch supplies. But by November, NHTSA claimed that only three percent of the recalled models had been fixed. FCA says it continues to work to notify owners, though. According to Chrysler spokesperson Eric Mayne to Autoblog, "We are processing approximately 1,200 vehicles per day. Every owner who schedules service is receiving service. As of Jan. 8, that total was 193,490." The company has also mailed out over two million notifications to owners, more than the number officially called in. Given the age of these Jeeps, many of them have had multiple owners, and historically, the older a vehicle is, the less likely the recall fixes are to be carried out. Certain Chrysler owners eligible for buyback program

Certain car owners whose Chrysler vehicles contain dangerous defects will soon have a way to get rid of their lemons without losing money. As part of an agreement with federal regulators, Fiat Chrysler Automobiles has agreed to buy back more than 500,000 vehicles susceptible to veering out of control without warning at above market-value prices. The deal mainly covers certain models of RAM trucks, the Dodge Dakota pickup and Dodge Durango SUV. Further, owners of more than 1.5 million Jeep Liberty and Grand Cherokees at heightened risk for lethal fires are eligible to trade in their vehicles at above market value or, alternately, get a gift certificate if they prefer to have repairs made. Chrysler has "a heavy responsibility to make sure the products they make are safe for the traveling public," said Mark Rosekind, administrator of the National Highway Traffic Safety Administration. "... Here, we are sending an unambiguous signal to industry that if you skirt the laws or violate the law, or don't live up to the responsibility that consumers expect, we are going to penalize you." The buy-back and trade-in options for motorists come as part of an unprecedented penalty NHTSA slapped against Chrysler for violating federal motor-vehicle safety laws. Chrysler will pay a $105 million fine, the highest ever levied by the regulatory agency. In addition to the buy-backs, Chrysler also agreed to an independent monitor for three years. Investigators had outlined problems in the company's conduct in 23 recalls that affected more than 11 million defect vehicles. As part of a consent-order agreement, Chrysler acknowledged it did not notify vehicle owners of recalls in an effective manner and did not notify NHTSA of safety problems. Though those recalls affected millions of drivers, the buy-back and trade-in options are only for a small portion of the vehicles involved. Because Chrysler struggled to fix the problem and no repair was apparent, Rosekind said the buy-backs are reserved "for customers who didn't have a remedy." Buy-backs are for trucks and SUVs affected by three recalls that occurred in 2013 (recalls 13V-038, 13V-527 and 13V-529), that addressed a rear-axle pinion nut that could come loose and cause a loss of vehicle control. Those recalls covered 579,228 vehicles, including 2009-2012 Ram 1500, 2500, 3500, 4500 and 5500 trucks, 2009-2012 Dodge Dakotas, 2009 Chrysler Aspen and the 2009 Dodge Durango.
