FCA seeking new trial in Jeep fire case, calls $150M judgement 'grossly excessive'

Fiat Chrysler Automobiles is fighting back after a Decatur County, GA jury ordered the company to pay $150 million to the family of a four-year-old boy that was killed after a 1999 Jeep Grand Cherokee crashed and caught fire. The company is requesting the judge reduce the award, and should Walden's family not agree to the lower sum, that a new trial be held. The Detroit Free Press reports that FCA would be forced to pay $120 million over the death of young Remington Walden, with an extra $30 million being paid to the boy's family. Neither figure sits well with the automaker, though, which called the fine "grossly excessive," and claimed it was in violation of Georgia state law. The judgment stems from FCA's long-running problem with the fuel tanks of certain Jeep models built in the 1990s and 2000s. According to the newspaper, FCA argues that the jury was biased after the Waldens' attorneys played on the their passions and pushed for a big award, saying the wrongful death award was 11 times more than any appeals court has ever upheld. FCA said attorneys for the plaintiffs told the jury to base the settlement on Sergio Marchionne's total compensation, $68 million. FCA also claims in its motion that the young boy's suffering was brief. "A $30-million pain-and-suffering award for what plaintiffs acknowledge was at most one minute of suffering is irrational," the motion, which was obtained by The Detroit Free Press, read. "Where such plainly improper arguments are immediately followed by irrational and stunningly excessive damage awards, there can be no doubt that the jury acted from passion and prejudice." Jim Butler, the attorney for the Waldens, has called the motion "nonsense," although he said the family will accept whatever figure the judge sets.

FCA design chief Ralph Gilles uses Jeep to help couple in fiery wreck

Fiat Chrysler's head of design Ralph Gilles recently rendered assistance at a fiery crash scene that left one dead. Gilles helped two people trapped inside a vehicle following a pair of collisions that left them pressed up against a burning vehicle. He used his Jeep Wrangler to nudge a Ford Edge engulfed in flames across the road. The 57-year-old female passenger who was trapped inside the other car was later pronounced dead at a local hospital. The first crash happened early Sunday, Feb. 18, in a rural area north of Detroit when a 2013 Ford Fiesta carrying the woman and her husband collided head-on with a 2013 Ford Edge that had crossed the center line. The driver of that vehicle sustained minor injuries; police said alcohol is believed to have played a role. Gilles was driving home with his wife, Doris, when they came upon the accident, stopped and called 911. He told the Oxford Leader he and the driver of the Edge tried to help the couple in the Fiesta, but none of the doors would open. After Gilles went to move his Wrangler out of the way, he saw a Buick LeSabre broadside the already-crippled Fiesta and push it up against the Edge, which then caught fire. With the couple still trapped inside the Fiesta, Gilles got the idea to put the Wrangler into four-wheel drive and push the Edge to the opposite shoulder using his Jeep. "The only thing I can remember thinking (is) I've got a Jeep, it's got a bumper on it, I think I can do this. All I could think about were the two people still inside the other car." Firefighters were later able to extract the couple from the Fiesta and transport them to a hospital. The woman was then airlifted to a second hospital, where she was pronounced dead. Her husband was listed in stable condition. Gilles posted a short video of the burning vehicle on Instagram and wrote that he was "NOT a hero." "It made us appreciate the true heroes. Jeep still working to improve Cherokee's 9-speed auto

Fiat Chrysler is hoping an upcoming software update will stem the tide of consumer complaints surrounding its nine-speed automatic transmission. Owners of the 2014 Jeep Cherokee have reported a number of problems on the National Highway Traffic Safety Administration's SaferCar.gov website, since the new model and its troubled gearbox arrived way back in October 2013. The software update is "intended to keep the vehicle performing as intended, and to prevent durability issues from occurring in the future," an FCA spokesperson told Automotive News, and will be available to owners of both the 2014 to 2015 Jeep Cherokee and the 2015 Chrysler 200, which also uses the 9AT. While FCA will be notifying consumers of the update, owners can also request the software reflash if they happen into their dealer before then. Despite the widely documented problems with the transmission, the only complaints on NHTSA's website relate to the 2014 Cherokee – neither the 2015 Jeep nor the 200 have received any complaints. That bodes well as FCA prepares to begin deliveries of the 2015 Jeep Renegade and launch the Fiat 500X, both of which pair the 9AT with the 2.4-liter Tigershark four-cylinder. "We have had to do an inordinate amount of intervention on that transmission, surely beyond what any of us had forecast," FCA CEO Sergio Marchionne told Automotive News. "There are things that we have done – that we continue to do. Our proactive customer care intervention has actually increased in intensity on these vehicles in 2014, especially in the second half." What's fascinating about the 9AT's problems are that they haven't been the fault of manufacturer ZF, but have related to software that wasn't "mature" and had "teething problems," Marchionne has said previously, AN reports. With the lack of criticism for the 9AT in 2015 models and this pending software update, though, here's hoping that FCA has finally figured out its fuel-sipping gearbox. Related Video:
