FCA applies to trademark 'My Freedom' for subscription service

Almost a year ago to the day, several outlets reported that Fiat Chrysler would trial three car-swapping programs in Boston focused on the Jeep brand. One program covered peer-to-peer Jeep rentals through Turo; another was a three-month subscription service through Avis that allowed Jeep owners to swap for Ram or Dodge vehicles; the third was called "Car Borrowing" and enabled Jeep owners to buy "Jeep Coins" to use on a one-day rental of other Fiat Chrysler products. It's possible FCA is taking last year's lessons to the next phase, CarBuzz having discovered the automaker applied to trademark the term "My Freedom" with the U.S. Patent and Trademark Office. The listed purpose of the mark would be "motor vehicle subscription services, namely, providing temporary use of motor vehicles to members for their personal use." Having begun its research using Jeep, it's not clear if a potential My Freedom subscription service would retain the 4x4 SUV focus or include other brands in the fold; with Jeep's martial origins, the brand has made ample use of the Freedom name over the years. There's also a link to new partner Groupe PSA, as the French automaker's mobility division and subscription service is dubbed Free2Move.   Related: Autoblog's guide to car subscription services   FCA made no comment on the filing, but an analyst at AutoForecast Solutions told The Detroit News that the submission "prepares (FCA) for the future," as. "The idea that autonomy would prevent the need for your own vehicle leads perfectly into subscriptions." U.S. brands haven't cracked the subscription nut yet, even with their premium offerings. Ford bought subscription startup Canvas in 2016, then sold it last year to the car-rental app Fair. GM launch Book by Cadillac in 2016, and shut it down for retooling in 2018 before a re-launch scheduled to happen sometime this year. If nothing else, an FCA subscription program with access to the top-end product could give other-brand luxury owners an easy way to pay attention to Maserati and Alfa Romeo. Ram and Jeep Wrangler drive Fiat Chrysler profits up 61 percent

MILAN — Italian American automaker Fiat Chrysler says fourth-quarter net profits rose by 61 percent, powered by North American sales of the all-new Ram 1500 and Jeep Wrangler. Fiat Chrysler Automobiles on Thursday reported quarterly net profits of 1.29 billion euros ($1.46 billion), compared with 804 million euros in 2017. Revenues rose 6 percent to 30.6 billion euros. North America profits grew by 19 percent to 6.2 billion euros, accounting for the lion's share of the automaker's global profits. The carmaker continued to have trouble in Asia, which swung to a loss due to market weakness in China and more competition in Fiat Chrysler's core SUV market. Europe also lost ground, with profits dipping 44 percent on lower shipments and weaker pricing, while Latin America more than doubled. Based on the company's earnings last year, 44,000 unionized U.S. auto workers will get $6,000 profit-sharing checks. That's $500 more than in 2017, but smaller than U.S. rivals Ford and General Motors. Ram and Jeep diesel emissions allegations spur class action lawsuits

This shouldn't come as a surprise. Last week, the EPA issued a notice of violation to FCA after it determined that Jeep and Ram installed eight undisclosed auxiliary emissions control devices on diesel vehicles. Since then US law firm Heninger Garrison Davis, LLC and Canadian firm Sotos LLP have launched class action suits on behalf of owners. These latest lawsuits are unrelated to a previous class action suit brought against FCA and Cummins over NOx emissions in 2007 to 2012 Ram models. The violation notice – and the subsequent lawsuits – covers 2014 to 2016 Jeep Grand Cherokee and Ram 1500 models equipped with the 3.0-liter turbodiesel V6, a total of about 104,000 vehicles in the US. The EPA says that while the emissions control devices aren't necessarily illegal, installing them without disclosing them to the EPA is, as they produce more emissions in real world use than in testing. Skirting certification in this way might be a violation of the Clean Air Act. FCA could see fines of up to $45,000 per vehicle, depending on the outcome of the EPA investigation. FCA denies that these are cheat devices, and has proposed software updates to bring the vehicles into compliance. As for the lawsuits, Heninger Garrison Davis says that "Fiat Chrysler marketed those vehicles as environmentally friendly with enhanced fuel efficiency, better performance, and lower emissions. Although the diesel vehicles were successfully marketed as 'clean,' their environmentally-friendly representations were deceptive to consumers." The suit seeks an undisclosed amount of compensation for owners of these vehicles. In Canada, Sotos LLP is seeking $250 million in damages on behalf of owners. This suit, filed in the Ontario Superior Court of Justice, also claims deception on the part of FCA, "resulting in losses and damage" to owners. These are similar claims to group actions against Volkswagen with regard to its diesel emissions cheating scandal. While VW is fixing or buying back many of the affected vehicles, the company is defending itself against some suits on behalf of owners, saying it expects " no decline in the residual values of the affected vehicles as a result of this issue." Don't be surprised if FCA mounts a similar defense.
