$40M award for boy's death in Jeep fire upheld by Georgia high court

The Georgia Supreme Court on Thursday unanimously upheld a $40 million award to the family of a 4-year-old boy killed in 2012 when the 1999 Jeep Grand Cherokee in which he was riding was rear-ended and burst into flames. A lower court in 2015 reduced a jury verdict from nearly $150 million to $40 million. Fiat Chrysler spokesman Michael Palese said the company was "disappointed in this decision. We are considering our legal options." The Jeep's fuel tank was placed near the back of the vehicle, which plaintiffs said made it vulnerable to rear-end collisions. The Supreme Court ruling said "evidence showed that Chrysler had long known that mounting a gas tank behind the rear axle was dangerous. Evidence also showed that Chrysler's placement of the gas tank behind the rear axle was contrary to industry trends, which favored placing tanks in front of the rear axle." Fiat Chrysler lawyers said during the trial that the fire did not cause Walden's death and blamed the driver of the pickup truck that hit the vehicle. The company said Thursday it "continues to extend sympathies to the family of Remi Walden for their loss." On appeal, the company contended it was prejudicial to raise Fiat Chrysler Chief Executive Sergio Marchionne's compensation, which totaled more than $68 million, according to a company executive who testified at trial. The automaker had denied there was a safety issue and has said the vehicles were no more dangerous than comparable SUVs built at the time. The National Highway Traffic Safety Administration (NHTSA) linked more than 50 deaths to the Jeep fuel-tank issue. Under government pressure, Fiat Chrysler recalled 1.56 million 2002-07 Jeep Liberty and 1993-2004 Jeep Grand Cherokee SUVs in June 2013 to address fire risks and agreed to install trailer hitches to protect the gas tanks. The recall and a "customer satisfaction campaign" that covered the Jeep in the fatal Georgia crash occurred after Marchionne held private talks with senior U.S. Transportation Department officials in 2013. The Georgia Supreme Court opinion said the award was proper in part because Marchionne was "alleged to have specifically interjected himself in a federal safety investigation to the detriment" of the Walden family. In 2015, NHTSA announced Fiat Chrysler would pay a then-record $105 million civil penalty over lapses in safety recalls involving millions of vehicles, including older Jeep SUVs for fire risks. Refreshed Jeep Cherokee gets more conservative styling

When the Jeep Cherokee hit the market a few years ago, it created a bit of controversy within the Jeep community. The two biggest issues were the styling and the fact that the former rough-and-tumble Cherokee was now a soft, car-based crossover. While there isn't much that can be done about the latter, it looks like Jeep is planning to address the Cherokee's love-it-or-hate-it looks. These spy shots, in typical fashion, don't reveal as much as we would like. The Cherokee here has a good amount of camouflage covering the front and rear fascias, the two areas that generated controversy. It looks like the headlights have moved up and sit alongside the bumper, not below it. The seven-slot grille remains, but there would likely be fires in Toledo if that disappeared. The rear has been changed as well, and it looks like there is a body-width trim piece similar to that on the Grand Cherokee. When the refreshed Cherokee debuts, the Jeep lineup will be murkier than ever. More conservative styling would make it look like a baby Grand Cherokee, but that's exactly what the all-new Compass looks like. It seems the pair might step on each other's toes, but Jeep must hope it's better than going to another manufacturer. Look for a full reveal this fall. Are we about to see a real SUV revival?

Now that the marketplace has been oversaturated with cute-utes, crossovers, and CUV coupes, are we about to see a resurgence of real, honest-to-God SUVs? Ummm... maybe. The stars seem to be aligning in that direction, at least that's the sense I'm getting. We know an all-new Jeep Wrangler is only a few auto shows away; and that Jeep is about to introduce a new Grand Cherokee Trailhawk for 2017, in the same rugged spirit of the successful Cherokee and Renegade Trailhawks. Ford has hinted at a neo-Bronco, after showing the concept above in 2014 to wet the mouths of all those Duck Dynasty-types out there. And, and... wait for it... I recently learned that Subaru sent a questionnaire out to some Forester owners asking if they might be interested in an off-road package if it were offered. The items listed were pretty hardcore, serious stuff, such as: integrated tow/recovery hooks, additional ground clearance, more rugged wheels, skid plates, altimeter, front-view off-road camera, improved approach and departure angles, advanced differentials, Inclinometer, full-size spare tire, upgraded off-road suspension components, more aggressive tires, off-road driving mode (engine, transmission, throttle, and steering settings), more rugged styling, low-range gearing, and a more advanced traction management system. Folks that's not my wish list (well, actually it is), but those are words from Subaru, asking if that's what customers would like to see. Need proof? Go to the SubaruForester.org website.
