FCA to appeal reduced judgment in Georgia Jeep case

FCA is appealing the $40 million verdict against it in a case in Georgia where a four-year-old boy died in a fire in a Jeep Grand Cherokee, according to The Detroit News. The jury originally awarded the child's family $150 million, but the judge decided to significantly to reduce the amount based on other precedents. The automaker has been considering further legal options since the decision was announced in July. The boy's death happened in 2012 when he was riding in a Grand Cherokee. The vehicle was rear-ended, and the fuel tank burst, causing a fire. This is the same issue that led to a recall of millions of the SUVs and a recent agreement with the US government from FCA to pay to get them fixed. In the original ruling, the jury said that the automaker was 99 percent responsible for the fatality and didn't adequately warn owners. It asked the company to pay $120 million for wrongful death and $30 million for his pain and suffering. FCA countered that the Jeeps met the safety standards of the time they were made. FCA requested that the jury's award be reduced in May calling the amount "grossly excessive." If the family didn't agree to a lower amount, the company also threatened to seek a new trial. Among the arguments was that $30 million was too much for the child's one minute of suffering. The parents did accept the judge's adjusted figure, though.

FCA to recall nearly 900,000 vehicles that don't meet emissions standards

WASHINGTON — Fiat Chrysler Automobiles will recall 862,520 gasoline-powered vehicles in the United States that do not meet U.S. emissions standards, the Environmental Protection Agency said on Wednesday. The recall was prompted by in-use emissions investigations conducted by the EPA and in-use testing conducted by Fiat Chrysler as required by U.S. regulations, the agency said. EPA said it will continue to investigate other Fiat Chrysler vehicles that are potentially noncompliant and may become the subject of future recalls. The recall includes 2011-2016 Dodge Journeys, 2011-2014 Chrysler 200s and Dodge Avengers, 2011-2012 Dodge Calibers and 2011-2016 Jeep Compass/Patriots. Fiat Chrysler said in a statement the EPA announcement "has no safety implications. Nor are there any associated fines." "The issue was discovered by FCA during routine in-use emissions testing and reported to the agency," the company said. "We began contacting affected customers last month to advise them of the needed repairs, which will be provided at no charge." Its U.S.-traded shares were down 1 percent. "EPA welcomes the action by Fiat Chrysler to voluntarily recall its vehicles that do not meet U.S. emissions standards," EPA Administrator Andrew Wheeler said in a statement. "We will provide assistance to consumers navigating the recall and continue to ensure that auto manufacturers abide by our nation's laws designed to protect human health and the environment." Fiat Chrysler owners can continue to drive their vehicles, the government said. Due to the "large number of vehicles involved and the need to supply replacement components — specifically to the vehicle's catalytic converter — this recall will be implemented in phases during the 2019," the EPA said In January, Fiat Chrysler agreed to a settlement worth about $800 million to resolve claims by the U.S. Justice Department and state of California that it used illegal software to produce false results on Ran and Jeep vehicles. But that incident involved diesel engines. It is awaiting the outcome of a criminal probe. The hefty penalty was the latest fallout from the U.S. government's stepped-up enforcement of vehicle emissions rules after Volkswagen AG admitted in September 2015 to intentionally evading emissions rules.

Georgia jury awards $150 million in Jeep fire case

The automaker was found liable for 99 percent of the damages, and the remaining one percent was for the driver who rear-ended the family's SUV. In a statement from FCA US, the company said that it is considering an appeal. Under Georgia law, the automaker was allegedly unable to present a three-year investigation of rear-impact data to jurors. This was the same information the National Highway Traffic Safety Administration used to decide that the '99 Grand Cherokee "did not pose an unreasonable risk to motor vehicle safety." The original recall for the models covered 1.56 million examples of the 2002-2007 Liberty and 1993-1998 Grand Cherokee. With the fuel tank located between the rear axle and bumper, NHTSA and FCA eventually agreed to install a trailer hitch for extra protection. A further 1.2 million 1999-2004 Grand Cherokees owners received notice of a customer service action to have their vehicles inspected, though no hitch installed. Subsequent tests showed this remedy to be effective for impacts below 40 miles per hour. The automaker has maintained the SUVs met the applicable safety standards of the period when they were built. The company was chastised by NHTSA last year for low repair rates of the problem.
