Researchers who busted VW cheating say FCA's diesels dirty, too

The Wall Street Journal today reported on an upcoming report from West Virginia University's Center for Alternative Fuels Engines and Emissions, which is the same lab that investigated Volkswagen emissions cheating. The report, which will be released in a matter of weeks, alleges that 2014 and 2015 model year Jeep and Ram vehicles with diesel engines emit excess pollution. But it does not specify whether the company used defeat devices. Since the report discusses Jeep Grand Cherokees, and that engine is also available in the Ram 1500, it's safe to assume that one of the implicated engines is the EcoDiesel V6, a unit actually produced by VM Motori. It's unclear whether the report covers any of the Cummins engines used in heavier-duty Ram pickups. This report comes on the heels of a federal investigation into FCA's diesel vehicles. That investigation focused on the EcoDiesel engine used in 2014-2016 vehicles. The feds were seeking a fine of up to $4.6 billion. The EPA and the State of California also previously accused FCA of using a defeat device on the same vehicles back in January. FCA, for its part, alleges that the WVU study might have been commissioned by people interested in suing the company, and disputes the testing methodology, according to the WSJ. FCA expands Jeep Cherokee recall to 68k more vehicles

FCA is expanding its airbag software update for the 2014 and 2015 Jeep Cherokee to cover 68,593 more of the vehicles worldwide. This brings the total to 316,774 Cherokees. Of those, there are now 230,240 in the US, 28,110 in Canada, 6,367 in Mexico, and 52,057 outside of NAFTA. According to the automaker, after reviewing the potentially affected population, it discovered these additional Cherokees in need of the upgrade. The original campaign to repair these vehicles was announced in early February. Engineers found a small number of cases where dramatic changes to the angle of the vehicle that upset its balance caused the side-curtain and seat-mounted side airbags to deploy because they anticipated a rollover. This especially occurred when driving off-road. According to FCA, there're no additional reports of this happening, and the company isn't aware of any injuries or accidents. The fix is simply a software upgrade that recalibrates the airbags' deployment. The action follows a routine review of the originally reported vehicle population by FCA US engineers. There have been no additional incidents and FCA US is unaware of any related injuries or accidents. The campaign will upgrade software that governs side-curtain and seat-mounted side air bags following a small number of inadvertent deployments – most of which occurred in harsh, off-road environments. They were prompted by maneuvers that dramatically changed the vehicles' angle of operation, relative to the ground, and the air-bag systems – sensing potential rollover conditions – automatically activated. The software upgrade will recalibrate the threshold for deployment and the vehicles will remain compliant with all applicable safety regulations. Affected are certain 2014 and 2015 Jeep Cherokees. Ram and Jeep diesel emissions allegations spur class action lawsuits

This shouldn't come as a surprise. Last week, the EPA issued a notice of violation to FCA after it determined that Jeep and Ram installed eight undisclosed auxiliary emissions control devices on diesel vehicles. Since then US law firm Heninger Garrison Davis, LLC and Canadian firm Sotos LLP have launched class action suits on behalf of owners. These latest lawsuits are unrelated to a previous class action suit brought against FCA and Cummins over NOx emissions in 2007 to 2012 Ram models. The violation notice – and the subsequent lawsuits – covers 2014 to 2016 Jeep Grand Cherokee and Ram 1500 models equipped with the 3.0-liter turbodiesel V6, a total of about 104,000 vehicles in the US. The EPA says that while the emissions control devices aren't necessarily illegal, installing them without disclosing them to the EPA is, as they produce more emissions in real world use than in testing. Skirting certification in this way might be a violation of the Clean Air Act. FCA could see fines of up to $45,000 per vehicle, depending on the outcome of the EPA investigation. FCA denies that these are cheat devices, and has proposed software updates to bring the vehicles into compliance. As for the lawsuits, Heninger Garrison Davis says that "Fiat Chrysler marketed those vehicles as environmentally friendly with enhanced fuel efficiency, better performance, and lower emissions. Although the diesel vehicles were successfully marketed as 'clean,' their environmentally-friendly representations were deceptive to consumers." The suit seeks an undisclosed amount of compensation for owners of these vehicles. In Canada, Sotos LLP is seeking $250 million in damages on behalf of owners. This suit, filed in the Ontario Superior Court of Justice, also claims deception on the part of FCA, "resulting in losses and damage" to owners. These are similar claims to group actions against Volkswagen with regard to its diesel emissions cheating scandal. While VW is fixing or buying back many of the affected vehicles, the company is defending itself against some suits on behalf of owners, saying it expects " no decline in the residual values of the affected vehicles as a result of this issue." Don't be surprised if FCA mounts a similar defense.
