FCA seeking new trial in Jeep fire case, calls $150M judgement 'grossly excessive'

Fiat Chrysler Automobiles is fighting back after a Decatur County, GA jury ordered the company to pay $150 million to the family of a four-year-old boy that was killed after a 1999 Jeep Grand Cherokee crashed and caught fire. The company is requesting the judge reduce the award, and should Walden's family not agree to the lower sum, that a new trial be held. The Detroit Free Press reports that FCA would be forced to pay $120 million over the death of young Remington Walden, with an extra $30 million being paid to the boy's family. Neither figure sits well with the automaker, though, which called the fine "grossly excessive," and claimed it was in violation of Georgia state law. The judgment stems from FCA's long-running problem with the fuel tanks of certain Jeep models built in the 1990s and 2000s. According to the newspaper, FCA argues that the jury was biased after the Waldens' attorneys played on the their passions and pushed for a big award, saying the wrongful death award was 11 times more than any appeals court has ever upheld. FCA said attorneys for the plaintiffs told the jury to base the settlement on Sergio Marchionne's total compensation, $68 million. FCA also claims in its motion that the young boy's suffering was brief. "A $30-million pain-and-suffering award for what plaintiffs acknowledge was at most one minute of suffering is irrational," the motion, which was obtained by The Detroit Free Press, read. "Where such plainly improper arguments are immediately followed by irrational and stunningly excessive damage awards, there can be no doubt that the jury acted from passion and prejudice." Jim Butler, the attorney for the Waldens, has called the motion "nonsense," although he said the family will accept whatever figure the judge sets.

We'll probably have to wait until 2019 to see the Wrangler pickup fully revealed and on dealer lots, but it seems that the truck is already showing up in FCA's computer systems. Someone at Jeep Scrambler Forum did a little digging and found the truck's chassis code, "JT," listed with a number of parts. Among those parts were different tops, seemingly confirming that the Wrangler pickup will have a soft folding top and removable hardtops available, just like a normal Wrangler. These include the plain black soft top, a black hard top, or a body-color hard top. The hard tops are also listed as three-piece units like on a conventional Wrangler, so parts can be removed, or the entire top. The forum quotes sources as saying the pickup will be called the Jeep Scrambler. The company renewed the trademark on that model name in 2015. The forum discovered a few other mechanical details, too. The truck's code is listed under the diesel engine option, confirming that powertrain for the pickup, though no other engine or transmission info was found. The forum also found CAD models of the frame and axles. Jeep Scrambler Forum estimates the frame is about 33 inches longer than the upcoming Wrangler Unlimited four-door SUV. This isn't entirely surprising, as photos show that the Wrangler pickup prototypes are substantially longer than the four-door Unlimited models. And even AEV had to lengthen the Wrangler's frame to turn it into the Brute pickup. Finally, the forum noted that the axles are different from the current generation of Wrangler, and could possibly be stronger than normal for improved towing and payload. NHTSA investigating 2015 Jeep Cherokee after new owner's total-loss fire [w/video]

The National Highway Traffic Safety Administration has opened a Preliminary Evaluation into the 2015 model year Jeep Cherokee after a single example caught on fire in California. This investigation will decide the cause, scope and frequency of this possible problem and will decide whether a recall is necessary for 50,415 potentially affected examples. According to Automotive News, the Cherokee's owner only purchased the CUV about two days before the fire, and it had been driven less than 100 miles. The new buyer reported parking the Jeep, and noticed a smell like smoke. Shortly after, the vehicle was consumed in flames. There were no injuries, but much of the incident was captured on video. NHTSA is also trying to decide whether another report is related. In this case, a driver noticed smoke under the hood of a 2015 Cherokee with just 45 miles on it, while driving at 60 miles per hour.
