$40M award for boy's death in Jeep fire upheld by Georgia high court

The Georgia Supreme Court on Thursday unanimously upheld a $40 million award to the family of a 4-year-old boy killed in 2012 when the 1999 Jeep Grand Cherokee in which he was riding was rear-ended and burst into flames. A lower court in 2015 reduced a jury verdict from nearly $150 million to $40 million. Fiat Chrysler spokesman Michael Palese said the company was "disappointed in this decision. We are considering our legal options." The Jeep's fuel tank was placed near the back of the vehicle, which plaintiffs said made it vulnerable to rear-end collisions. The Supreme Court ruling said "evidence showed that Chrysler had long known that mounting a gas tank behind the rear axle was dangerous. Evidence also showed that Chrysler's placement of the gas tank behind the rear axle was contrary to industry trends, which favored placing tanks in front of the rear axle." Fiat Chrysler lawyers said during the trial that the fire did not cause Walden's death and blamed the driver of the pickup truck that hit the vehicle. The company said Thursday it "continues to extend sympathies to the family of Remi Walden for their loss." On appeal, the company contended it was prejudicial to raise Fiat Chrysler Chief Executive Sergio Marchionne's compensation, which totaled more than $68 million, according to a company executive who testified at trial. The automaker had denied there was a safety issue and has said the vehicles were no more dangerous than comparable SUVs built at the time. The National Highway Traffic Safety Administration (NHTSA) linked more than 50 deaths to the Jeep fuel-tank issue. Under government pressure, Fiat Chrysler recalled 1.56 million 2002-07 Jeep Liberty and 1993-2004 Jeep Grand Cherokee SUVs in June 2013 to address fire risks and agreed to install trailer hitches to protect the gas tanks. The recall and a "customer satisfaction campaign" that covered the Jeep in the fatal Georgia crash occurred after Marchionne held private talks with senior U.S. Transportation Department officials in 2013. The Georgia Supreme Court opinion said the award was proper in part because Marchionne was "alleged to have specifically interjected himself in a federal safety investigation to the detriment" of the Walden family. In 2015, NHTSA announced Fiat Chrysler would pay a then-record $105 million civil penalty over lapses in safety recalls involving millions of vehicles, including older Jeep SUVs for fire risks. Side-X-Sides: The next Wrangler?

The Jeep Wrangler has a huge following, but I've long thought that it is ripe for plucking. And if rumors of a neo-Bronco prove to be true, it sounds like Ford may agree. If a new Bronco does pan out, I hope it's small like the original Bronco, and not a huge F-150-based vehicle. To be a true Wrangler-fighter it has to be small and nimble. Here's another option How about developing a slightly larger, but street-legal version of the popular side-x-sides which are so popular with hunters, fishermen, farmers and anyone outdoors-oriented? This, to me, seems to be the next logical evolution of these side-x-sides. Currently side-x-sides have to be either trailered or stuffed into the back a of a pickup to wherever they're going to be used. Offering a street-legal off-roader solves that problem. There's no shortage of side-x-side makers out there. Any one of them could engineer and market such a vehicle, should they decide to. Plus there are plenty of dealer outlets, although Honda is the only one that currently sells cars, etc.; so they could have an edge in the selling and servicing aspects of such a vehicle. That said, I'm not sure Honda would want to sell such a vehicle in their car outlets. It may be better suited to their dealers that sell motorcycles, ATVs, watercraft, etc., as that outdoorsman type of customer already frequents those dealers. Then again, if the new Ridgeline proves popular, such a vehicle could offer something much more capable and sporting to that customer who is looking for something more extreme. The Wrangler has its fans, and they love it just as it stands. In fact Wrangler fans would reject any drastic engineering changes to their beloved off-roaders Side-x-sides, on the other hand, offer a completely different take on how to engineer a small but serious off-roader. Both are valid approaches. Currently the only thing missing are street-legal side-x-sides that go head-to-head against the Wrangler. NHTSA upgrading Jeep Grand Cherokee, Dodge Durango headliner fire probe

The National Highway Traffic Safety Administration investigation into headliner fires experienced by a small number of Jeep Grand Cherokee and Dodge Durango owners has been upgraded to an engineering analysis, the step before the initiation of a recall. In August last year the investigation began with 146,000 Grand Cherokees from 2012 after three complaints were received, but a report on Edmunds says it has been expanded to include 593,299 vehicles covering the 2011-2013 model years for the Jeep and the Dodge Durango, which uses the same headliner assembly, because of possibly 52 incidents of fire.
In some of those incidents drivers have reported a burning odor, smoke or open flames that were contained to the headliner or migrated to another area of the passenger compartment. The culprit has apparently been found: NHTSA blaming an electrical short in the sun visor vanity light wiring, which is routed under the headliner and held in place by three screws. Chrysler began its own probe into the issue when it was first reported and is still looking into the situation while, "fully supporting the National Highway Traffic Safety Administration's investigation."
