U.S. appeals court preserves $210M Hyundai-Kia fuel economy class settlement

A U.S. appeals court restored a $210 million nationwide class-action settlement for hundreds of thousands of owners of Hyundai Motor Co and Kia Motors Corp vehicles whose fuel economy estimates were inflated. By an 8-3 vote on Thursday, in a case closely watched by class-action lawyers, the 9th U.S. Circuit Court of Appeals in Pasadena, California, said vehicle owners had enough in common to let them settle as a group. It also rejected arguments by owners opposed to the settlement that the claims process was too burdensome, and that lawyers for the class had colluded with the automakers to extract a "sweetheart deal" that undervalued their claims. The case began after the U.S. Environmental Protection Agency found flaws in Hyundai's and Kia's testing procedures, prompting the automakers to lower fuel efficiency estimates for about 900,000 vehicles from the 2011, 2012 and 2013 model years. Lawyers for objecting drivers had no immediate comment. Hyundai said it was grateful for the decision. Kia and its lawyers did not immediately respond to requests for comment. The decision by Circuit Judge Jacqueline Nguyen upheld a settlement approved in June 2015 by U.S. District Judge George Wu in Los Angeles. Wu "made careful findings, which the objectors here largely do not challenge, and which more than support the judgment," Nguyen wrote. The decision reversed a divided three-judge 9th Circuit panel's January 2018 rejection of the settlement and decertification of the class action. That panel said Wu failed to assess whether differences in state laws prevented certification of a nationwide class. It also said used car owners should have been excluded because it was unclear whether they had relied on the South Korean automakers' fuel economy claims. Lawyers had said it would become much harder to obtain nationwide settlements if the panel ruling stood. Nguyen had dissented from the panel ruling. Circuit Judge Sandra Ikuta, who wrote it, dissented on Thursday. Ikuta accused the majority of failing to determine what law should apply to the nationwide class or how the settlement, and thus attorneys' fees, should be valued. "The majority's failure to correct these errors may be beneficial for the class action bar, but it detracts from compliance with Supreme Court precedent," Ikuta wrote. The 9th Circuit covers nine western U.S. states, Guam and the Northern Mariana Islands.

88,000 interested in Hyundai Tucson fuel cell, first units due in 60 days

Hyundai thinks it has a hit on its hands with the Tucson Fuel Cell CUV, an Internet hit at the very least. At the Washington Auto Show this week, Michael O'Brien, the vice president of corporate and product planning for Hyundai Motor America, announced that 88,000 people have visited the car's microsite. Since the company isn't yet taking orders for the vehicle, we'll have to take this as a sign that people are interested in a hydrogen-powered CUV. "The response surprised even us," O'Brien said. "The response surprised even us" Hyundai expects to deliver the first Tucson Fuel Cell to a "small group" of customers in the US within 60 days, O'Brien said. As we learned last year, Hyundai will lease the CUV for $499 a month (and $2,999 down) for 36 months. That price includes as much hydrogen refueling as you like, plus Hyundai's Valet Maintenance. The Tucson Fuel Cell is already in production and available in other markets (as the ix35 Fuel Cell), following 16 years of development and what O'Brien said were "hundreds of millions of dollars" spent on R&D. Hyundai has tested its fuel cell cars for over 2.4 million miles, including extreme heat, cold and altitude tests (but it hasn't shot a bullet into the tank a la Toyota). Hydrogen cars are "as clean and by some measures cleaner than today's EVs" but are more practical, with longer range and shorter refueling times, O'Brien said in DC. Hyundai, Kia to put solar panels on vehicle roofs

Hyundai Motor Group said Wednesday that future Hyundai and Kia models will be equipped with solar panels capable of generating electricity as a way to increase fuel-efficiency and range and lower CO2 emissions. Hyundai says the solar panels will feature in the rooftops or hoods of select vehicles "after 2019" and will supplement traditional internal combustion, hybrid and battery-electric vehicles. The parent group said it's developing three different types of solar roof charging systems comprised of a solar panel, controller and battery. The first generation will be a silicon solar panel system mounted to the rooftops of hybrid models and capable of charging 30 to 60 percent of the battery per day, depending on weather conditions and other factors, starting as early as 2020. The second generation involves a semi-transparent solar roof system applied to a panoramic sunroof and capable of charging an electric-vehicle battery or a battery mounted on a gasoline engine. Hyundai says the latter configuration will help it increase vehicle exports, since solar-equipped ICE vehicles will be able to adhere to regulations limiting CO2 emissions. A third-generation system is being tested right now. It will add solar production capability in the hood and roof of EVs – but the companies don't provide more detail than that at this moment. "In the future, various types of electricity-generating technologies, including the solar charging system, will be connected to vehicles," said Jeong-Gil Park, executive vice president of engineering design at Hyundai Motor Group. "This will enable them to develop from a passive device that consumes energy to a solution that actively generates energy. The paradigm of the vehicle owner will shift from that of a consumer to an energy prosumer." To date, solar vehicle charging technology has mostly been for light-duty tasks, like cooling off the interior or trickle-charging a conventional battery, such as the system offered in the previous Nissan Leaf. Systems that do more than this have typically come with a very steep pricetag for modest capabilities. Panasonic has developed a 180-watt solar roof available for the Japanese version of the Toyota Prius Prime plug-in hybrid that is capable of adding up to 3.7 miles of range per day – at an unspecified (as of this writing) but undoubtedly high cost. Elon Musk, unsurprisingly, has also discussed making a solar roof optional for the Tesla Model 3.
