Hyundai To Fight $248 Million Judgment Over Fatal Montana Crash

A Montana jury has levied a $248 million ruling against Hyundai in the case of a crash that killed two occupants in July 2011. The automaker plans to appeal the ruling. Cousins Trevor and Tanner Olson were driving a 2005 Hyundai Tiburon when they hit another vehicle head-on. According to lawyers representing their family, the steering knuckle on the car cracked and this allegedly caused it to lose control. Hyundai claimed that fireworks had been let off inside the vehicle, which caused the driver to swerve. The company alleges that evidence that could have proved its innocence was barred from the case. The jury found in favor of the family and awarded them about $8 million in damages after a two-week trial. It claimed that Hyundai had shown "actual malice," according to Reuters. The jurors also slammed Hyundai with a further $240 million in punitive damages. Hyundai told Reuters that it plans to appeal immediately and called the verdict "outrageous." Eyewitness testimony established – and experts for both sides agree – that fireworks exploded in the unbelted teenagers' vehicle immediately before the July 2, 2011 accident, which involved the driver losing control, crossing the median and crashing head-on into an oncoming Pontiac at a closing speed of approximately 140 miles per hour – a speed confirmed by experts for both sides. Hyundai believes the jury's view of the evidence was distorted by a series of erroneous rulings by the Court, the most egregious of which prevented the jury from reviewing performance testing conducted by renowned failure analysis experts that would have disproven the plaintiffs' theory of the case – a theory derived by a local resident with no previous automotive experience. Hyundai closes the books on fuel economy litigation

Hyundai-Kia ended up with a lot of kimchi on its face in 2012 when it admitted it had mistakenly exaggerated fuel economy estimates on several 2012 and 2013 model-year offerings like the Hyundai Accent, Veloster and Elantra and Kia Soul. Before the admission a lawsuit had been filed by an entity called Consumer Watchdog, afterward there were "approximately 53" lawsuits filed in federal court that were eventually consolidated into one case in a California Central District court.
The companies apologized profusely and gave customers prepaid gas cards that they could refill with funds for as long as they own their vehicle, as well as perks like free car washes and routine maintenance services. The company has just announced that it has reached a preliminary settlement of the case by adding another method of reimbursement, a lump sum payment that would free drivers from having to go back to the dealership to have their mileage verified for debit card refills.
Assuming the preliminary agreement is approved by the judge, customers could choose the lump sum or the cards. The settlement's value could be as much as $210 million, but the exact number depends on which program plaintiffs choose. On average, affected customers will receive $353. 2016 Hyundai Tucson starts at $23,595, rated up to 33 mpg

The latest generation of the Hyundai Tucson had its all-new hexagonal face revealed at the 2015 Geneva Motor show earlier this year. But we're finally getting a much better idea of what the North America version of the crossover offers. The 2016 model arrives at Hyundai dealers in July with a base price of $23,595, after the $895 charge for all trims. That's a jump from the current post-destination MSRP of $22,525, but customers get more modern styling and a new powertrain option with the update. In addition to its handsome new styling, the 2016 Tucson grows slightly in length and width for greater cargo space inside. The base SE trim carries over the previous 2.0-liter four-cylinder, six-speed automatic, and front-wheel drive combo with 164 horsepower and 151 pound-feet of torque. Fuel economy jumps slightly to 23 miles per gallon city, 31 mpg highway, and 26 mpg combined – up from the 2015's 23/29/25. However, the real gains start showing up with the Eco, Sport and Limited trims. Those models share a 1.6-liter turbocharged four-cylinder and seven-speed dual-clutch gearbox to replace the previous 2.4-liter four and six-speed auto. The boosted engine is rated at 175 horsepower and 195 pound-feet of torque, which is 7 less ponies but 18 lb-ft more torque than the outgoing mill. In the Eco trim starting at $25,045, the powertrain is rated at 26/33/29 with front-wheel drive. Sport goes for $27,045 and Limited for $30,795, but the turbo engine is rated at 25/30/27 in those latter two guises. All-wheel drive adds $1,400 to any version and knocks one or two mpg from the combined fuel economy figures. Beyond the powertrain improvement, Tucsons are available with an alphabet soup of safety systems to let drivers feel more secure. Inside, a five-inch touchscreen infotainment display is standard and comes with a rearview camera. An optional eight-inch system with navigation is also optional.
