U.S. appeals court preserves $210M Hyundai-Kia fuel economy class settlement

A U.S. appeals court restored a $210 million nationwide class-action settlement for hundreds of thousands of owners of Hyundai Motor Co and Kia Motors Corp vehicles whose fuel economy estimates were inflated. By an 8-3 vote on Thursday, in a case closely watched by class-action lawyers, the 9th U.S. Circuit Court of Appeals in Pasadena, California, said vehicle owners had enough in common to let them settle as a group. It also rejected arguments by owners opposed to the settlement that the claims process was too burdensome, and that lawyers for the class had colluded with the automakers to extract a "sweetheart deal" that undervalued their claims. The case began after the U.S. Environmental Protection Agency found flaws in Hyundai's and Kia's testing procedures, prompting the automakers to lower fuel efficiency estimates for about 900,000 vehicles from the 2011, 2012 and 2013 model years. Lawyers for objecting drivers had no immediate comment. Hyundai said it was grateful for the decision. Kia and its lawyers did not immediately respond to requests for comment. The decision by Circuit Judge Jacqueline Nguyen upheld a settlement approved in June 2015 by U.S. District Judge George Wu in Los Angeles. Wu "made careful findings, which the objectors here largely do not challenge, and which more than support the judgment," Nguyen wrote. The decision reversed a divided three-judge 9th Circuit panel's January 2018 rejection of the settlement and decertification of the class action. That panel said Wu failed to assess whether differences in state laws prevented certification of a nationwide class. It also said used car owners should have been excluded because it was unclear whether they had relied on the South Korean automakers' fuel economy claims. Lawyers had said it would become much harder to obtain nationwide settlements if the panel ruling stood. Nguyen had dissented from the panel ruling. Circuit Judge Sandra Ikuta, who wrote it, dissented on Thursday. Ikuta accused the majority of failing to determine what law should apply to the nationwide class or how the settlement, and thus attorneys' fees, should be valued. "The majority's failure to correct these errors may be beneficial for the class action bar, but it detracts from compliance with Supreme Court precedent," Ikuta wrote. The 9th Circuit covers nine western U.S. states, Guam and the Northern Mariana Islands.

2016 Hyundai Sonata Hybrid, PHEV gets conservative new look, more range

The plug-in hybrid middle ground between the 2015 Toyota Prius Plug-In (11 miles of EV range) and the 2016 Chevrolet Volt (50 miles) has long been the Ford domain. The Blue Oval has two plug-in hybrids with 20 miles of all-electric range, its 2015 Fusion and C-Max Energi Plug-in Hybrids. Entering this fray later this year will be the 2016 Hyundai Sonata Plug-In Hybrid, which will arrive with 22 miles of EV range and 93 MPGe. Hyundai made that announcement at the Detroit Auto Show this morning, saying that 22 miles is "farther than any other midsize PHEV sedan." Those zero-emission miles will come from a 9.8-kWh lithium polymer battery and a 50-kW electric motor. Once the pack runs out, Hyundai expects the PHEV to get 40 mpg combined (as well as 38 mpg city and 43 mpg highway) thanks to the gas-powered heart of the powertrain: a 154-horsepower, 2.0-liter Nu GDI four-cylinder engine that puts out 140 pound-feet of torque. When combined with the motor, the total system output is 202 horsepower. Hyundai is also showing off a non-plug Sonata Hybrid, which is expected to get a 10-percent fuel economy boost. The current version gets 38 mpg, combined, so that hints at around 42 mpg on the sticker when the car arrives in dealerships. The plugless model has to make due with a 51-hp, 38-kW electric motor that offers 151 pound-feet of torque and a net power rating of 193 horsepower. The two new Sonata Hybrid models have their own, more aerodynamic front and rear fascias as well as "purposefully unique wheels" that help drop the drag coefficient to just 0.24. The PHEV has a unique grille and a charge port on the front driver's side. Both models will arrive in dealerships later this year. Hyundai Genesis Coupe joins the SEMA fray

With several tuned rides already headed to the show, Hyundai finishes off this year's slate with a mean-looking Genesis Coupe from Tjin Edition painted in a searing shade of green. The coupe's 3.8-liter V6 gets a Vortech supercharger and front-mounted intercooler to help push the claimed output to over 500 horsepower. A set of KW coilovers and Baer brakes also make sure the coupe handles and stops just as well as it accelerates. Tjin's custom shade of lime green paint will draw attention to this Genesis Coupe at Hyundai's booth. Once attendees get closer, they can check out the car's tweaked front lip, trunk lid, and rear spoiler from Unique Fabrication. Meanwhile, the interior mixes performance and comfort by combining a roll cage and Alea leather upholstery. The Tijn Edition Genesis Coupe will join Hyundai's other offerings at this year's SEMA Show in Las Vegas on November 3. With the addition of Rotiform 19-in. 3-piece HUR wheels, custom Baer x CBA Extreme Plus brake calipers and Falklen FK345 tires, the vehicle's stopping power is now on par with its go-fast performance. The vehicle now sits lower on KW coilovers to give a more aggressive stance. Unique Fabrication supplied a custom front lip, rear spoiler and custom trunk lid, and the exterior was finished in a custom Kylie Tjin Axalta green paint job.
