U.S. appeals court preserves $210M Hyundai-Kia fuel economy class settlement

A U.S. appeals court restored a $210 million nationwide class-action settlement for hundreds of thousands of owners of Hyundai Motor Co and Kia Motors Corp vehicles whose fuel economy estimates were inflated. By an 8-3 vote on Thursday, in a case closely watched by class-action lawyers, the 9th U.S. Circuit Court of Appeals in Pasadena, California, said vehicle owners had enough in common to let them settle as a group. It also rejected arguments by owners opposed to the settlement that the claims process was too burdensome, and that lawyers for the class had colluded with the automakers to extract a "sweetheart deal" that undervalued their claims. The case began after the U.S. Environmental Protection Agency found flaws in Hyundai's and Kia's testing procedures, prompting the automakers to lower fuel efficiency estimates for about 900,000 vehicles from the 2011, 2012 and 2013 model years. Lawyers for objecting drivers had no immediate comment. Hyundai said it was grateful for the decision. Kia and its lawyers did not immediately respond to requests for comment. The decision by Circuit Judge Jacqueline Nguyen upheld a settlement approved in June 2015 by U.S. District Judge George Wu in Los Angeles. Wu "made careful findings, which the objectors here largely do not challenge, and which more than support the judgment," Nguyen wrote. The decision reversed a divided three-judge 9th Circuit panel's January 2018 rejection of the settlement and decertification of the class action. That panel said Wu failed to assess whether differences in state laws prevented certification of a nationwide class. It also said used car owners should have been excluded because it was unclear whether they had relied on the South Korean automakers' fuel economy claims. Lawyers had said it would become much harder to obtain nationwide settlements if the panel ruling stood. Nguyen had dissented from the panel ruling. Circuit Judge Sandra Ikuta, who wrote it, dissented on Thursday. Ikuta accused the majority of failing to determine what law should apply to the nationwide class or how the settlement, and thus attorneys' fees, should be valued. "The majority's failure to correct these errors may be beneficial for the class action bar, but it detracts from compliance with Supreme Court precedent," Ikuta wrote. The 9th Circuit covers nine western U.S. states, Guam and the Northern Mariana Islands.

Hyundai's green vehicle line might be called AE

When we got spy shots back in June of Hyundai's challenger for the Toyota Prius, intel suggested Hyundai would name it AE HEV, an acronym that possibly meant Advanced Experimental or Alternative Energy Hybrid Electric Vehicle. The Korea Herald reports that AE is indeed the tentative project name, and that it could be applied to an entire model line of green-only models with hybrid, plug-in hybrid, and electric variants. We're told the hybrid's launch is slated for January 2016, the first configuration being a five-door hatchback based around the company's 1.6-liter direct-injected Cappa engine. The size of the battery pack and capability of the electric motor are still unknown. It aims to outdo the Prius in at least two ways, one of them being to exceed the Prius' rating of 21 kilometers per liter of combined fuel economy. The other would concern model range instead of on-road range: if the other powertrain options follow, the AE could be the world's first model with three different green drive configurations (if Honda doesn't get there first). The Korea Herald said Kia will be rolling out a hybrid-only vehicle of its own called the DE. We're not sure what the specs and timeline are for that car, nor if it is included in the "22 green cars" that a Hyundai spokesman told the paper the automaker plans to release by 2020. Right now we're awaiting the initial response to Hyundai's full dive into green waters with the Sonata PHEV that just went on sale. Hyundai, ARK Performance combine for SEMA-bound Legato Genesis Coupe

The latest body-kitted Hyundai Genesis Coupe scheduled to appear at the Specialty Equipment Market Association (SEMA) show in Las Vegas is the ARK Performance Legato Concept. In a nod to performance fiends, Hyundai built a stroker V6 good for 400 horsepower and 425 pound-feet of torque to really set the coupe off.
The extra power is a very good thing when one considers how fast the Legato Coupe looks. Speaking of the Italian musical term "legato," it translates to "tied together," and it was the theme ARK adhered to when it designed the car. In ARK's words, the the Legato conveys "the seamless integration of exotic design, tuned performance and luxury coupe interior ambience."
ARK's body kit includes front and rear bumpers, side skirts, deck lid and "wide-body cues." The 3.8-liter V6 was stroked to 4.0 liters courtesy of JE pistons, connecting rods and a billet steel crankshaft. ARK supplied an intake system and headers, and bolted on a lightweight pulley kit. An ARK oil cooler keeps the engine running at the right temperature. The tuning company also bolted on one of its dual-mass flywheels and carbon clutch kit to handle the extra power.
