Hawaii is first state to sue Takata

Hawaii became the first state to sue Takata Corp. alleging the company knowingly sold potentially defective airbags in a suit filed May 13. The state also claims Takata covered up data showing the airbags were a danger and then delayed recalling them. Hawaii also named Honda Motor Co., which owns part of Takata, and Honda's US affiliates, American Honda Motor Co., and Honda of America Manufacturing Inc., in the complaint. The state claims Takata switched to lower-cost ammonium nitrate for its airbag inflators, despite internal testing that the propellant was "unpredictable and prone to explode." Hawaii, which brought the suit through its Department of Commerce and Consumer Affairs Office of Consumer Protection, is seeking the maximum civil penalty of $10,000 per violation. It also wants Takata to make restitution to owners, run an educational campaign to spur owners to get their cars fixed, and repay profits made from the faulty airbags. Faulty Takata airbags have killed 13 people and are estimated to have injured more than a 100 more. NHTSA says 28.8 million vehicles with the airbags have been recalled, and potentially 40 million more may need to be recalled. It turns out Takata isn't willing to expand airbag recall nationally after all

There have been "approximately 0.000006 failures per air bag deployment, which is far below the failure rate" of most recalls, Takata claims. Takata has seemingly made an about face following reports that it would expand its regional airbag recall into a nationwide repair effort, issuing a scathing, four-page letter rebutting allegations by the National Highway Traffic Safety Administration and its Office of Defects while simultaneously attacking the government's handling of the situation. The Japanese supplier claims in its letter that the "currently available, reliable information does not support a nationwide determination of a safety defect," arguing that there were "approximately 0.000006 failures per air bag deployment, which is far below the failure rate in the vast majority of the thousands of recalls," The Detroit News reports. Takata then breaks down the two specific incidents mentioned in NHTSA's original recall request letter, a 2005 Honda Accord and 2007 Ford Mustang. Referencing the two crashes, NHTSA Administrator David Friedman said last month "one incident is an anomaly, but two are a trend." The supplier, though, argues the Honda issue is already being covered by that company's soon-to-be-national recall (more on that in a moment). The company then goes on to point out that neither Takata nor NHTSA has been able to analyze the Mustang's airbag inflator, saying that such a lack of examination meant there was "no way to ascertain what actually occurred during the incident, whether any inflator ruptured, and whether any inflator rupture that may have occurred was related to the incidents that led to the current regional campaigns." Takata alleges that NHTSA has disobeyed its own statutes. Takata also took the opportunity to take a few swipes at NHTSA's behavior during the airbag scandal, saying it was "very surprised to receive" a recall request letter because the ODI had yet to even receive the company's responses to a pair of special orders. It also alleged that NHTSA was disobeying its own statute, which says only manufacturers of vehicles and replacement equipment can "decide in good faith whether their products contain a safety related defect," and that the government can only "issue an initial decision that a safety-related defect exists" to those same entities.

Junkyard Gem: 2000 Honda Passport 4WD

The suits at American Honda Motor Company must have spent the bulk of the 1990s tearing out their hair in frustration as their rivals raked in big money from the sales of ever-more-profitable SUVs, even as American car shoppers lost interest in sedans and hatchbacks. Oh, sure, the Civic-based CR-V appeared here for the 1997 model year and sold well enough, but the lack of a larger SUV pained Honda more with each passing year. With the Acura MDX and Honda Pilot not ready for showrooms until the 2001 and 2002 model years, respectively, some stopgap had to be found. Isuzu stepped up and made a deal with Honda: the Rodeo would get Honda badges and become the Passport, while the Trooper would show up in Acura showrooms with SLX badges (for the 1994 and 1995 model years, respectively). Here's one of those Passports, found in a Denver-area self-service yard. Things got even weirder in the Isuzu/Honda world around the turn of the century, with the Honda Odyssey getting Isuzu badges and being sold as the Oasis. Fast-forward to 2009, and the only Isuzu-badged vehicles available new here were rebadged Chevrolets: the I-Series pickup (Chevy Colorado) and the Ascender (Chevy Trailblazer). The Passport name has some interesting American Honda history, stretching back to the first Honda vehicle sold here (and the biggest-selling motor vehicle in human history): the Super Cub. American Honda Motor Company couldn't use the Super Cub name on our shores, because Piper Aircraft had been selling a small plane called the Super Cub since 1949, so the motorcycle was called the Honda 50 over here. Eventually, this bike got a 70cc engine and became the Honda C70 Passport, sales of which continued through the middle 1980s. That means the Passports sitting in your local Honda dealership right now got their name from a one-cylinder motorcycle. General Motors has a Passport connection as well; when GM created the Geo brand to sell rebadged Isuzus, Suzukis, and Toyotas in the United States, it created a marque called Passport to sell the Daewoo LeMans as the Optima in Canada (all the other vehicles sold by Passport dealers were Isuzus). So, Honda's need to offer SUVs in its American dealerships led to an arrangement with GM-connected Isuzu to sell these trucks with a model name bearing links to both companies. So much history in the junkyard! Just as Geo-badged Toyota Corollas (mostly) got Delco radios, so did the Passport get Honda radios.
