Honda fined $70 million for failing to report deaths, injuries

The federal agency charged with keeping US motorists safe announced Thursday it has fined Honda $70 million for failing to report death and injury data in a timely manner. Honda failed to report 1,729 incidents involving death or injury over an 11-year period, according to National Highway Traffic Safety Administration officials. Federal law requires automakers to report deaths, injuries and certain warranty claims. Officials said Thursday that information could have been used to spot trends in automotive defects and potentially save lives. Transportation Secretary Anthony Foxx said it is possible the Department of Justice could conduct a criminal investigation into the failures, but it was not immediately known whether the Justice Department would pursue such charges. NHTSA officials still don't know much about the 1,729 incidents of death or injury that were missing from the Early Warning Reporting records, because in some cases, they still haven't been reported. Mark Rosekind, the agency's new administrator, said Honda is still in the process of sending investigators the missing information. "Our first task will be to review that, and determine actual deaths and injuries," he said. "That data is in the process of coming to us and being processed right now." The $70 million is the largest civil penalty levied against an automaker in history, officials said. It actually consists of two $35 million penalties, the maximum allowed by statute for a single TREAD Act violation. In this case, NHTSA broke the fine into separate violations, one for the missing deaths and injury information and one for the company's failure to report certain warranty-claim information. Honda reached an agreement with the federal government in late December, in which it accepted additional regulatory oversight and third-party audits that will ensure reporting is properly completed in the future. North American auto production is booming with 2014 figures just shy of the of the 17.3-million vehicle record set in 2000. With more models being built on the continent, even more are being shipped overseas. Factories in the US exported 2.1 million cars last year – the highest number ever. About half of those went to Canada and Mexico, but more than ever have been heading to places like the Middle East and China. The upswing comes in part from from after-effects from the Great Recession, according to The Wall Street Journal. With a weak dollar and lower production costs after the financial crisis, building vehicles in the US was relatively cheaper and more competitive in the world. At the same time buyers around the world are going crazy for crossovers. According to the WSJ, BMW and Mercedes-Benz are already exporting the majority of their US production of these models overseas. Both automakers have also announced investments to expand production further here to send more vehicles abroad. Even Honda has been shipping more models out of the country than it imported here. There is a concern this international strength could start slowing because the dollar is strengthening against other currencies, though it's too early to know what the actual effect of this could be, according to the WSJ. "Of course, we closely watch currency exchange, but we don't make changes in production or allocation based on temporary fluctuations in the exchange rate," Ford North American boss Joe Hinrichs told the newspaper. Honda recalls 304k Accords for sudden side-airbag deployment

Honda is recalling 303,904 US examples of the 2008-2009 Accord because the side airbags or curtains can inadvertently deploy. The automaker said the problem is not related to Takata's airbag problem or any other supplier. Instead, the issue concerns the software's deployment threshold for side impacts. These sudden deployments can happen if the ignition is on, and the door is forcefully closed. They might also occur if there's a strong enough impact to the underside of the vehicle, like from road debris. As of October 12, 2015, Honda has 19 allegations of injuries from this problem; plus 311 warranty claims and 160 field reports, according to a chronology submitted to the National Highway Traffic Safety Administration (as a Word document). The fix will be a software update to adjust the Supplemental Restraint System, and Honda will begin mailing notifications to owners in mid-December. Statement by American Honda Regarding Side Airbag Inadvertent Deployment Recall: 2008-2009 Honda Accord Sedan Oct 29, 2015 - TORRANCE, Calif. Side and/or side curtain airbags may inadvertently deploy if the ignition is on and a door is forcefully slammed or there is a significant impact to the vehicle underbody. Issue arises from side impact deployment threshold specification; Not a hardware or supplier issue. Free software update will adjust the deployment threshold. Honda will voluntarily recall 303,904 model-year 2008-2009 Accord vehicles in the United States to update the side Supplemental Restraint System (SRS) software, free of charge. The SRS threshold setting for the side impact sensor is such that with the vehicle ignition on, if there is a strong, non-vehicular collision impact to the lower body of the vehicle or if a door is shut with extreme force, the SRS control unit may interpret the input as a crash and command the side seat airbag and/or side curtain airbag to deploy. Airbags that unexpectedly deploy may increase the risk of injury. Honda has received 19 injury claims related to this issue. Honda is announcing this recall to encourage each owner of an affected vehicle to take it to an authorized dealer as soon as they receive notification of this recall from Honda. Mailed notification to customers will begin in mid-December 2015.
