Florida woman says Takata airbag deployment left her paralyzed

A malfunctioning Takata airbag left a Florida woman paralyzed from the neck down following an otherwise minor car accident last year, a lawsuit filed last week alleges. Patricia Mincey says in court documents that, instead of deploying normally, the driver-side airbag in her 2001 Honda Civic deployed with such force that it injured her neck and rendered her a quadriplegic. The lawsuit accuses Takata and Honda of deliberately concealing information about the defect and taking belated action to protect Mincey and other motorists from airbags that may harm them instead of saving their lives. At least five deaths and 139 injuries have been linked to the flawed airbags in Honda vehicles. "There is a systemic failure of these companies to come clean with information they know very early on of problems," Ted Leopold, Mincey's attorney, tells Autoblog. "Instead of doing the right thing, they try to sweep the problems under the rug until there are so many deaths and injuries they're left with no choice. We saw it with General Motors ignition switches, we saw it with the Toyota unintended acceleration cases and now we see it here." Long History Of Takata-Related Recalls Four days after Mincey's accident, Honda recalled her car as part of a 5,394,000-vehicle recall that sought to repair vehicles in which the airbag inflators could rupture. Her accident took place in Jacksonville, Florida, a state in which manufacturers have said high humidity could cause a heightened risk of problems for Takata airbags. She was wearing her seat belt at the time of the crash, according to court documents, and her car was traveling approximately 22 miles per hour. Mincey remains hospitalized in a long-term care and rehabilitation facility near her Florida home, her attorney said. She is seeking compensation in excess of $15,000 for her injuries and punitive damages. Problems with the Takata airbags were discovered as early as 2001, when Isuzu issued the first recall related to high-pressure deployments. But the company continued to manufacture defective airbags, which have subsequently been flagged in dozens of recalls over the past 14 years. Approximately 21 million vehicles have been affected in the United States. Congress conducted hearings on the companies' delayed responses to the safety crisis last year.

Honda adds tech to 2016 CR-Z, no powertrain upgrades

Rumors suggest that the next-gen Honda CR-Z could finally become a real performance machine by dropping the hybrid setup in favor of a detuned version of the European Civic Type R's 2.0-liter turbocharged four-cylinder. We aren't there yet, though, and for 2016 the wedge-shaped model instead receives a styling upgrade and some new tech. However, the hybrid powertrain is still exactly the same. As previewed by the Japanese version earlier this year, the 2016 CR-Z receives a revised face with a reshaped grille. The front diffuser now slashes through the lower air dam to create triangular niches for the foglights. At the back, a redesigned bumper further echoes the nose's styling. Honda's designers also tweak the interior by switching to an electric parking brake. This might seem minor, but because there's no longer a lever, a center console with an armrest can take up the open space. In addition, drivers can enjoy better infotainment from a standard, seven-inch Display Audio system. For the EX trim and above, the screen is used for the company's LaneWatch tech, too. Moving up to the top-spec EX-L adds navigation and heated leather seats. Even with the powertrain the same, the 2016 CR-Z might drive a little better. Honda's engineers thicken the front stabilizer bar a hair and widen the rear track by 0.4 inches. The brake discs are also now 11.1 inches at the both ends, versus 10.3-inches at the front and 10.2 inches at the back previously. For 2016, Honda revises the trims to LX, EX, and EX-L, but prices jump slightly. A base model now starts at $21,130 (with the $835 destination charge) versus $20,965 last year (with $820 destination). Perhaps these upgrades are enough to goose CR-Z sales because through September the model is down 25.1 percent with a volume of just 2,205 units. Judge allows class-action lawsuits against Honda, automakers

Millions of plaintiffs in 2014 brought a class-action lawsuit in against Takata and Honda, and the airbag manufacturer and carmaker petitioned to have the case thrown out. A US District Judge in Miami ruled against the companies on December 3, allowing the case to proceed. The case in question, Craig Dunn et al vs. Takata Corporation et al, is thought to be the first class action filed in the ongoing airbag imbroglio. Other cases have been filed, but on behalf of individuals. Takata and Honda are named defendants in the case, but the 453-page suit is also aimed at BMW, Ford, Mazda, Nissan, and Subaru. The plaintiffs claim violations of the Racketeer Influenced and Corrupt Organizations (RICO) Act specifically by Takata and Honda, alleging that those two companies conspired to hide information about airbag inflators that could rupture and spray shrapnel around a car's cockpit. Honda said Takata hid information from it and ceased doing business with the airbag company, while a recent Wall Street Journal review of documents indicated that Takata changed testing information to suppress actual results from Honda. The class-action suit charges violations of the Magnuson-Moss Warranty Act, too. Meanwhile, Takata has strengthened its legal team with the addition of Lanny Breuer, a partner at Covington & Burling LLP. Breuer was a US assistant attorney general from 2009 to 2013, heading the criminal division. Honda has been dealing with individual cases out of court, with litigation in cases of five out of six US deaths settled for undisclosed sums.
